He shall also return to the clerk, on oath within three months after each sale made by him, a full and itemized account thereof, which shall be signed by him and recorded by the clerk. Revisal of 1905, section 42 Every executor, administrator and collector shall, within twelve months from the date of his qualification or appointment, and annually so long as any of the estate remains in his control, file in the office of the Clerk of the Superior Court, an inventory and account, under oath, of the amount of property received by him, or invested by him, and the manner and nature of such investment, and his receipts and disburse- ments for the past year in the form of debit and credit. He must produce vouchers for all payments. The clerk may examine, on oath, such ac- counting party, or any other person, concerning the receipts, disbursements, or any other matters relating to the estate; and having carefully revised and audited such account, if he approve the same, he must endorse his approval thereon, which shall be deemed prima facie evidence of correctness. Cass, of the State and County aforesaad, being of sound mind and disposing memory, do hereby make and declare this to be my last Will and Testament in manner and form as follows, viz: Item 1. My executor, hereinafter named, shall give my body a suitable burial and pay the expenses thereof, together with any just debts I Owe, except as hereinafter provided, out of the first moneys that shall come into his hands available for that purpose. I wish to be interred at Friendship Church beside my departed wife, Harriett L. Cass. Item 2. In order to carry out an arrangement that I have made in my lifetime with my ffPtend, Fred Parks Hamm, I give, devised ard bequeath in fee simple, unto the said Fred Parks Hamm that part of my home place in Sharpesburg Town- ship, containing 99 acres, more or less, that is described in two deeds to me made by C. B. Jurney and wife, dated Jan. 12, 1899, containing 69 acres, more or less, which deed is recorded in Deed Book 39 at page 514.6, in the office of the Register of Deeds of Iredell County and another tract conveyed to me by deed of M. 0. Jurney and wife dated Nov. 21, 1919, containing 40 acres, more or less, which deed is recorded in Book 6 at page 7, in the office of the Register of Deeds of Iredell County, to be his in fee simple and forever, provided and on condition that the said Fred Hamm shall, at the time of my death, be living with me at my said home and shall have carried out the agreement existing between us with reference to living together. If the said Fred Parks Hamm shall be act- ually residing and living with me at the time of my death, he shall be deemed conclusively to have complied with all the conditions and agreements of the contract and no action at law, or otherwise, by me personal representative or heirs at law shall be brought against him on account of said 99 acre tracts of land, unless the same is commenced within sixty days after the date of my death. If, however, in my lifetime, by mutual agreement, or otherwise, the said Frec Parks Hamm shall have terminated the agreement to live together and moved off the place, he shall be entitled to compensation in full of all services rendered, at the rate of Five Hundred Dollars ($500.00) a year, commencing with the year beginning January lst, 1948, up to the time of my death. As an in- Gident of said agreement, it is understood that the income from the said farm is to be first applied to the ordinary living expenses of the household and after these expenses are paid, I am to have one-half of the surplus and Bed ‘q we I I A “S s e 1S 6 l t 3 £ . ; Parks Hamm the other one-half during our respective lives. IftTI should become bedridden or by physical iliness, unable to do the housework around the place, before my death, Fred Parks Hamm will, at his own expense, supply the necessary housekeeper, or if I am unable to look after myself, a nurse while I am down at home, out I am to pay my own doctor's and hospital bills, I likewise give ad bequeath unto the said Fred Parks Hamm any Crops, grain, supplies and provisions on hand at the time of my death, together with the growing crops on the 99 acre tract of land, upon the same conditions here- inabove set out with respect to the land. All the above conditions shall be conclusively deemed complied with if Fred Parks Hamm is still living with me at my home at the time of my death. Item 4, I give, devise and bequeath unto the Trustees of Friendship Methodist Church, in Iredell County, or their successors in office, the sum of TWO HUNDRED DOLLARS ($200.00), of which One Hundred Dollars is to be applied to the upkeep of my family burial plot in Friendship Cemetery, and the other One Hundred Dollars is to be used for the upkeep of the friendship Church itself, I likewise give and dDequeath unto the Trusteas of St. Paul's Methodist Church, near Buck Shoal, in Yadkin County, the sum of TWO HUNDRED DOLLARS ($200.00), of which One Hundred Dollars is to be applied to the upkeep of my family burial plot in St. Paults cemetery and the other One Hundred Dollars is to be used for the upkeep of Ste Paul's Church, itself. After making the above specific devises and legacies, and subject to the payment of my funeral expenses end the costs of settling my estate, it is my will and I give, devise and bequeath all the rest and remainder of my property not otherwise disposed of herein, unto my own next of kin under the Intestate Laws of the State of North Carolina, to be divided among them absolutely and in fee simple, in accordance with the Intestate Laws of the State of North Carolina, Item 5. I hereby constitute and appoint my nephew, Stanford Cass, of Yadkin County, as Executor of this my last Will and Testamen, to execute the sane, and every part thereof, according to its true intent and meaning. I do hereby ex- pressly authorize and empower my said Executor to sell at private sale, without any court order, for cash or upon terms approved by him, any land or personal property that it my be necessary to sell in the ousiness-like administration of my estate and to make all necessary deeds to land in fee simple and personal property absolutely, at private sale and without any court order, in the event of such a sale. In the event it should, in the opinion of my executor, be advisable or necessary, in order to make a division of the remainder of my estate under Paragraph Four above of my will, among my next of kin, rather than to divide the property itself, I authorize him, in his sole discretion, and in lieu of a division of the property in kind, to sell the property at private sale, or otherwise, for the best price, in his discretion, obtainable and divide the proceeds in cash in lieu of the land itself. Notice to creditors was duly published in the Statesville Record week, for four consecutive weeks, commencing with the issue of October l, nd creditors were required to file their claims within six months. 2. All debts of which the Executors had any knowledge, and all claims hich were filed with them, have been paid in full. 3. An inheritance tax return was filed with the North Caroline Devart- ment of Revenue. There was no tax due on the property bequeathed to the nine children. There was inheritance tax of $31.54 due on the real estate devised to the widow, Mrs. Ida H. Cates, and one-half of the joint savings account at the North Carolina National Bank, Statesville, N. The Executors would be entitled to commissions of 5% on Receipts of — 99,270.46 and Disbursements of $1,439.50, and these commissions would amount to Co-ixecutor, says that he does not wish ake any com- missions, Clyde A, Cates has spent considerable time in looking after the cattle, and looking after the sale of the roperty, and in looking after other things in the estate, since he was actually living here and was the one who was in charge of the property and matters, since he was living here, and he has actually had some expense in connection with looking after md carrying on the administration of the estate. therefore, Clyde A. Cates, in- cluding the widow, Mrs. Ida H. Cates, the Executors have included in the estate of John I, Cates, for distribution under Item V of his will, one-half of the joint savings account at the North Carolina National Bank, Statesville, N. C., in the amount of $2,458.35, and this is shown under Receipts; and the Executors, in ordance with the powers referred to, have turned over to Mrs. Ida H. Cates the other one-half of the joint savings account, to-wit: the sum of $2,458.35. 7. ‘The following items of personal property shown in the Inventory heve not been sold, to-wit: (a) Item No. 10 - 13 inch Oliver horse-drawn turning plow, and the reason the same has not been sold is because it was of no value and no one would ake an offer of any kind for it. No. 11 shown in the Inventory as miscellaneous small tools and these items of personal property were not sold for the reason they able, and no one was i ) i aying anything at all for them. item No. 2 own in the Inventory as approximately 250 bales of hay. This hay was musty, and was of very little value. Some of it was cattle, some of it was used in the stable, and the remainder was not not used, and no one would make an offer of any kind for it, and, therefore, it was not sold. Cates owned a tract of land in Shiloh township, Iredell County, North ( ine, containing 98 écres, more or less, and being his farm and home where he lived, and the title to this roperty was in his name and was devised under Item II of his will to his wife, Ida H. Cates, in fee simple. In the inheritance tax return, the Executors placed a value of $10, 780.00 on this tract of land, including all of the buildings and improvements. In Paragraph Ill of his will, John I. Cates devised all of his house- hold AND kitchen furniture, and all electrical appliances, equipment and fixtures Situate in the home, in fee Simple to his wife, Ida H. Cates; however, this pro- perty already belonged to the wife, Ida H. Cates, and did not vass to her under Item III of the will, and she is in possession of said property. lO. John I Cates did not have any life insurance on his life. li. The Executors were anxious to make a distribution of the property and divide the money prior to Christmas; however, they found, upon investigation, during the first part of December, 1964, that if the savings account was with- ‘[ uy o r ‘s o y e g £9 6 1 drawn before December 30, 1964, interest would be lost in the amount of $36.63, and the Executors felt that it was advisable to wait until the account could be withdrawn with this interest. £. The estate has been administered in accordance with the power and authority contained in the will, and under the laws of the State of Narth Carolina, and in accordance with instructions and agreements executed by the legatees and devisees hereto attached, marked Exhibits "A" and "BY, and a Distribution of the Receipts shown herein has been made to the legatees named in Item V of the will of John I, Cates.
