LOth day of June 19.46 Ne AReeubing sce Poet AE QS i Clerk Superior Court. §$1396—Every executor, administrator, collector and guardian shall, within three months after his qualiificaton, or appointment, make return, on oath. to the Clerk Superior Oourt, of all the estate in his hands, or received by him up to that time; but such time may be extended by the Clerk Superior Court on good cause shown, not exceeding six months. $1398—Whenever further property of any kind, not included in any previous return, shall come to the hands or knowledge of any executor, administrator or collector, he must cause the same to be returned as hereinbefore prescribed, within three months after the possession or discovery thereof, and the making of such return of new assets from time to time, may be enforced in the same manner as in the case of the first inventory SECTION 1399 OF THE CODE-ANNUAL ACCOUNTS—Every executor, administrator and collector shall within twelve months from the date of his qualifica tion or appointment, and annually, eo long as any of the estate remains in his control, file in the office of the Clerk of the Superior Court, an inventory and account, under oath, of the amount of property received by him or invested by him, and the manner and nature of such investment, and his receipts and disbursements for the past year in the form of debit and credit He must produce vouchers for all payments. The Clerk may examine on oath such accounting party, or any other per- son concerning the receipts, disbursements or any other matter relating to the estate; and having carefully revised and audited such account, if he approved the same, he must endorse his —- thereon, which shall be deemed PRIMA FACIE evidence or correctness. Each Clerk must annex or attach a copy of this sec tion to all letters issued by him $1488—No executor, administrator, or collector, after two years from his qualifications, shall hold or retain in his hands more of the deceased's estate than amounts to his necessary charges and dishursements and such debts as he shall legally pay but oll such estate so remaining shall be immediately after two years, be divided and be delivered and paid to such person to whom the same may be due by law or the will of the deceased.—See Code, Sec. 1396, 1398, 1399 and 1488 IN THE SUPERIOR COURT, mrrrn IREDELL COUNTY. § BEFORE THE CLERK. Notice to Creditors was duly published in the Statesville Record, once a week for four consecutive weeks, commencing on October 23, 1964, and the time set forth therein for filing claims has already expired. 4. The Executrix did not charge any commissions or anything for ser- vices herein, 7+ A public sale of the personal property at public auction at the home of the late P. L. Cartner was held on Saturday, December 12, 1964, and in thig report is an itemized, detailed list of the purchasers, the name of the article of personal property sold, and the price which it brought; that Buford York of Harmony, N. C,, acted as auctioneer, and C. B. Winberry, Attorney, was present and assisted in conducting the sale. 8. That some of the personal property in the estate was not sold at public sale, and that is listed under Receipts herein, with the estimated value thereon; that in other words, all of the personal property of P. L. Cartner at the time of his death, is listed in this Final Settlement under Receipts. 9. That the inheritance tax to the State of North Carolina has been | paid, and a Report filed as required by law, and the same has been duly approved, || and a certificate of release issued for the bank accounts and the stocks listed i therein. 10. That there was found among the papers of P. L. Cartner, a cer- tificate for one share of stock in Coble Dairy Products, Lexington, N. C., and after Paul Cartner made a trip there to confer with some of them, it was established that when Mr. P. L. Cartner sold his cattle, the share of stock was supposed to have been transferred | to the purchaser, and that because of other financial difficulties, the Directors | of Coble Dairy Products Cooperative, Inc. had declared that the equity ceptificate and revolving fund certificate issued in the years in question would not be re- cognized, and, therefore, there was no value in the aforesaid stock, revolving fund certificate or equity certificate. Cartner; that said real estate had a tax valuation in Iredell County of $3,002.50, and the value placed thereon in the Inheritance Tax Report was $5,588.00. (2) 32-1/4 acres of land in Turnersburg Township, Iredell County, North Carolina, with no buildings thereon; that this real estate had a tax valuatin | in Iredell County of $1,350.00, and the value of $4,033.00 was placed thereon in | the inheritance tax return. 14. The only real estate left by Robert Lee Cash was the dwelling house and lot at 235 North Lackey Street, Statesville, N. C. Ali claims, advancements and matters concerning the Estate were settled between Mrs. Elsie C. Weeks and Mrs. Ruby Lee Cash Hartness, and Mrs. Elsie C. Weeks conveyed her one-half interest in the real estate hereinabove referred to to Mrs. Ruby Lee Cash Hartness, by deed dated March 28, 1957. WHEREFORE, having fully administered the Estate of Robert Lee Cash, the undersigned Administratrix prays that this report be accepted as her final settle- ment and that the same be examined, audited and approved, and that she and the sureties on her bond be discharged as by law provided.
