Carter are of legal ave and desire to have said sale confirmed; it is, therefore, now ordered, considered and adjudged that the said lands mentioned and described in the petition for sale, be sold ¢ ivate sale, subject to the dower of lirs. Carter her year's allowance for the amount of $500.00, which consumed all of said personal property, with the exception of a small amount of Weedtachinery, which the administrators subsequmtly sold at cublic auction for $105.00, which came into their hands; that in addition, the Administrators have collected rents in the total amount of {116.01, from which receipts they have paid the funeral expenses in the amount oi $99.80 and certain costs of administration, and other exmenses, aggregating $20.30, leaving approximately 394.91 to the credit of the administrators at the present time; in addition to the above personal property the o ly other assets belonging to the intestate are certain farm lands or vacant lots in Iredell Counts hs ch will have to be sold to make assets with which to pay the remaining indebtedness of the estate, which indebtedness is approximately $4500.00. (HEREFORE, the petitioners pray for the reasons set forth, the Court will make an order that they may substitute a surety bond for the personal bond heretofore executed in the above matter. Beaver, the Commissioner appointed in this cause by order of the Court signed on Nov. 18th, 1940, respectfully shows to the Court: lst. ‘hat after the original petition was filed, Mrs. Jane wW Carter, the widow, moved in this proceeding to have her dower allotted and that the proceeding for the allotment of her dower has now been completed and confirmed, as provided by law, all of which appears in the original file in this proceeding, 2nd. Your Commissioner further reports that pursuant to the order appointing her, she has negotiated for a sale of said tracts of land set forth in the petition, after excluding the dower of lirs. Jane i. Carter, the widow, and that she has received a bona fide offer to purchase the first tract described in the petition, containing 126 acres, more or less, for immediate acceptance at private sale from H. P. Carter at the price of $5,000.00; that she obtained three bids for this tract of land, one for $4890.00 from Sam M. Miller and the bid for $5,000.00 from Henry P. Carter, being the two highest . 3rd. That the sale of Tract No, 1 is sufficient to pay off the debts and costs of administration of the estate and your Commissioner is of the opinion that the price of #5,000 offered at private sale by H. P. Carter is a fair and reasonable price for said land and all that the same is reasonably worth and she recommends that the Court will make an order, authorizing her to sell the said Tract No, 1, containing 126 acres, as described by metes and bounds in the petition as the First Tract, to H. P. Carter for $5,000 cash at private sale, unless a better bid is received by Monday, Feb. 17th, 1940, at 12 o'clock Noon, and that a notice of the bid of $5,000 be sent to each of the heirs with the order to show cause why said bid should not be accepted on or before the 17th day of February, 1941, at 12 o'clock Noon, All of which is respectfully submitted, this Feb. J. Beaver, February 24th, 1941, and being Commissioner, and the supplemental proceeding subsequent thereto, and it appearing to the Court that by an order duly signed in this Cause, the said Commissioner was authorized and empowered to negotiate for 4 private sale of the 106 acre tract of land describe: in the petition in this cause at private sale, or otherwise, and to report her proceedings to the Court for contirmation or rejection, That pursuant to said negotiations, the Commissioner reported that she had received a bona fider offer from Henry P - Carter to purchase said land at private sale for the sum of $5,000.00 and recuested the Court to sive notice in writing to each of the heirs to show cause on or before 12 o'clock Noon, Monday, Feb, 17th, 1941, why said bid 1 should not be accented, That pursuant to said notice to the heirs and in Consequence thereof, + 4 Lr. White and described by metes and bounds in said petition, be sold at private sale to Henry P. Carter, for the sum of $5300.00 cash, the purchaser to assume the 1941 county ad valorem taxes, It is further ordered that Mrs. A. J. Beaver appointed by the Court, be, and she is hereby authorized, empowered and directed to make, execute and deliver to the said Henry P. Carter a deed conveying said land in fee simple, subject to the 1941 taxes,upon his complying with the terms of sale. » the Commissioner heretofore It is further ordered that the Commissioner shall, out of the proceeds of said sale, pay the costs of this proceeding to be taxed by the Clerk, the mortgage, taxes and other specific liens against the property and pay over the surplus to Mrs. C. Carter, deceased, which said funds shall be condemned and are hereby declared to be necessary assets for the administration of said estate, to the extent necessary to pay up all the debts and charges of administration.
