Dear Sir:- We have your letter of October 2lst enclosing statement or final settlement sent you by Mr. John C. Sikes, attomey at law, Monroe, i. Varo. Dr. F. 4. Carpenter died some years ago, naming his brother E. C. Carpenter of Monroe Executor and the Independence Trust Company as Trustee of his estate. You will find a copy of Dr. F. A. Carpenter's Will on record in your office, and also a copy of final statement filed by HE. C. Carpenter, Executor of the estate of Dr. F. A. Carpenter. Under the Will of Dr. F. A. Carpenter, E. C. Carpenter was empowered to turn over the assets of the estate to the Independence Trust Company as Trustee, less the sum of 32,000.00 which he was authorized to invest and reinvest and to use the incone from such a fund for the benefit of his mother, Mrs. lIettitia A. Carpenter. It seems from report of Mrs. Carrie H. Carpenter, widow and Executrix of the estate of EZ. C. Carpenter, that *1250.00 of the 2000.00 was lost through these investments, leaving a balance of 2750.00, which, at the request and the approval of Mrs. Lettitia A. Carpenter, has been tumed over to the Independence Trust Company to hold for her benefit and we in turn are investing this amount, $750.0, the income from which is to te paid to Mrs. lettitia A. Carpenter during her life time and at her death the principal will revert to the estate of Dr. F. It was our suggestion that the Jlerk allow a foe in such amount as would constitute reasonable compensation to the attorneys for the Guardian ad Litem in vreparing and file ing the answer in her behalf. When we were in Statesville at the time tie final order was signed, the question as to the amount of the fee for the Guardian ad Litem was raised; and then we agreed with the opinion of Mr. Milholland and Mr. Scott, who filed an answer in behalf of all respondents except Graée F. Carpenter, to the effect that a fee of $10.00 probably would be satisfactory. So far as we and Mr. Little, the Successor Trustee, are concerned, any allowance to the Guardian ad Litem in keeping with the custom and practise of the Iredell Superior Court will be satisfactory; and if Nr. Milhol&and and Mr. Scott are of the opinion that a $25.00 allowance is reasonable under the circumstances of this mate ter we will interpose no objection whatever thereto.
