The plaintiff complains and says; First.--- That on the first day of May 1903 she was duly qualified as Administratrix of the estate of F.}).carlton, deceased, and at once entered upon the duties required of her. That she and her intestate F.>.Cariton, married on the 9th day of March 1869 and lived together as man ans wife until his death on the 14th day of February 1878. That during her coverture with the said F.1).carlton,her husband and intestate, chilgen were born to them. Second.---- That on or about the day of 1902 there went into the hands of the defendant, a certain bond, issued for value and for val ue, by some corporation, to this plaintiff unknown, of the face value of one thousand dollars, and saié bond was worth on the markets the sum of one thousand dollars and was sold and converted into cash by the defendant for the said sum of one thousand dollars, which cash Was a@ppropr'ated by the defendant, unlawfully and with the full knowl edge that he was rot the owner thereof, but that the same helonged to the estate of the plaintiff's intestate. Third.---- That as the plaintiff is informed and heleives, the said bond, issued as aforesaid and of the value aforesaid, was made paya ble to F .Decariton, the husband and intestate of he plaintiff, and was the property of and belonged to said e:tate, but that the defm dant has unlawfully and wilfully mis-used the same in his own affairs That as plaintiff is informed and belcives the said bond madc payable as aforesaid to her husband and intestate has been unlawfully and knowinglyt turned into cash, by the improper signature of the nam of plaintiffs intestate to said bond, and the cash so realized mis used by the defendant, when the said sum of one thousand dollars be longs to the plaintiff by reason of her administration of the estate of the said F. .Carliton. Fourth.---- That the plaintiff has made demand woon the defendant for the payment to her of the said one thousand dollars, but the defen- dant declines and refuses to comply therewith, but silently and se- cretly attempts to with-hold from this plaintiff, not only the said one thousand collars, but all knowledge or information whence the same camc. One of these lists shall be delivered to the widow, one to the personal representative, and one returned by the Jus- tice, within twenty days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the deceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her ri ght to collect said debt.
