NOTE: The widow is entitled to $500 out of the crop, stock and provisions of the deceased, and $150 addi- tional for each member of the family under fifteen years old as her year’s support. The commissioners shall make and sign three lists of articles assigned, — the value of each, the number of the family, and deficiency to be paid by the personal representative. One of these lists shall be delivered to the widow, one to the personal representative, and one returned by the Justice, within twenty days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s — may be allotted by commissioners from the personal property of the de- ceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt. That he was duly appointed administrator, with the will annexed , of the estate of Mary E. Campbell, Deceased, by the Clerk of the Court of Iredell County, and that he at once entered upon the administration of said estate. Second. Campbell, who have joined in, and been made parties to this action. Sixth. That a sale of said lands is necessary to pay the debts and obligations of the said intestate, and the charges of administration. Wherefore, your petitioner prays that this court appoint sone verson commissioner and authorize said person to make sale of said land, and apply the proceeds thereo*, or so much as shall be necessary, to the payment of the Gebts and obligations of the said intestate. Fourth, That the petitioners desire to hold their interest in said lands, or the proceeds thereof, in severalty; tut that an actual par- tition thereof cannot be made of the lands without injury to the par- ties interested, owing to the smallinumber of acres each would be entitled to by a division. Fifth. That a sale of said lands would be more advantageous tc all the parties interested, than an actual partition thereof. That on the 15th day of June, 19126, an action en- titled, L. G. Horn, Adm. et als. vs Willie Campbell, et als. was commenced in the Superior Court of Iredell County, for the purpose of selling the lands of Mary E. Campbell, deceased, for the purpose of making assets and division among the parties to the said action, who are the heirs at law of the said Mary =. Campbell, deceased; that said action was finally adjudicated, and the firal order of court corfirming the sale of said land was made on the 2th day of February, 1917: and the proceedings taken in said action were recorded in the office of the Clerk of the Court of Iredell County, and reference is hereby made to same for fuller description of parties thereto. That since said action has been adjudicated as above set forth, it has teen learned and discovered that the above named defendants, Horatio Campbell, Burgess Campbell and Narcissus Camptell, are: heirs at lay of the said Mary EF. Campbell, deceased, in that they are heirs at law of Cartwrirht Campbell, deceased: and that as such heirs at law of Mary E.
