Shepherd, Commissioner, hereto- fore appointed by the court to sell the lands described in the com plaint or petition, and it appearing to the eourt that the said con missioner did, on the 30th day of November 1908, at 12 o'clock M., at the court house door in said county, after due advertisement as provided by law, exnose to sale to the highest bidder gaid lands upon the terms, one-third cash: one-third in Six months and one- third in twelve months time, interest on deferred Dayments, with securty, title retained until deferred payments are made, said terms Of sale being changed by consent of all parties and their e@ounsel of record as stated in said report of J. The commissioners shall make and sign three lists of articles assigned, stating the value of each, the number of the a and deficiency to be paid by the personal representative. One of these lists shall be delivered to the widow, one to the personal representative, and one returned by the Justice, within twenty days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the de- ceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt.
