Caldwell, vs Be Ae Troutman & L. Le Troutman, Complaint trading under the firm name & a ee ee ee OO ee ee OO style of Mooresville Furniture Co. The plaintiff Complains and alleges: 1- That John E. Caldwell the plaintiff intestate, died under the cirseumstances hereinafter set forth, and that John Caldwell was duly appointed his administrator and has been qualified as such, as required by law. 2-That the defendant u. A. Troutman and L. L. Troutman are partners, doing business in the city of mooresville, Ne. Ce under the firm name and style of xooresville rurniture and are engaged in the business of operating a furniture factory and in connection therwith, used motor trucks for hauling lumber, and that on the vay of November 1918, the plaintiffs intestate, an infant under five years of age, was crossing the street in the city of mooresville accompanied by his young sister, and while crossing same for the purpose of getting on the other side of the walk, he was run into, over and against by a heavy loaded motor truck belonging to the defendants company and being run at said and operated by said company, its agent and servant time, that the plaintiff the father of said infant seeing seeing his children in a perilous condition, ran to their resucue and attempted to save their lives, and while so engaged the said motor truck came against them with great force and violence and knocked said intestate from his hands, ran over and killed him. 3- That the death of his intestate was due to and caused by the gross carelessness and negligence of the defendents company, its agents and servants, in charge of said motor truck, in running, operating and managing said motor truck, which was heavily loaded with lumber and in failing and refusing to sound a signal or give warning of its approch to said infant and his sister or check its speed or stop it in time to save the intestate from injury or death. 4-The said motor truck was being run at a dangerous and excessive rate of speed at said time and place and ina wreckless and negligent way and manner, 5- That his intestate was a mere child accompanied by his sister, who were within their rights in crossing said street and were in a dangerous and hazardous position at said time, which fact the defendents company, its agents and servants in charge od said truck, should or could have seen by the exercise of ordinary care in time to have prevented killing or injuring his intestate, but with gross carelessness and negilgence, the defendents, their agents and servants in charge of said truck, failed and refused to so run, operate and manage said motor truck, as to avoid injuring said intestate and by reason thereof the intestate was killed as aforesaid, to the plaintiffs damage, rive thousand Dollars Cc) =, Q. = oO S. = aa = 7 81 6 ] Wherefore the plaintiffs demands judgment against the defendant for the sum of rive Thousand Dollars and Mt oe. That on or about the 28th day of December 1918 , Plaintiff's son was riding plaintiff's horse along the public highway leading from the city of Statesville N.c. to the residence of plaintiffs son about 4 miles West of said City of Statesville . That as said horse was being rid across the bridge over Third Creek ,» defendant carelessly and negligently drove his automobile on said public bridge and carelessly and negligently ran same into plaintiffs horse knocking it down and draging it along said bridge and so injuring said horse that it had to be killed;that defendants negligence consisted in his Operating his automobile alongsaid highway and over said bridge ater rate of speed than 10 miles per hour, in approaching tesp descent and in traversing said bridge without having his automobile under control,in operating same over said bridge with- out regard to the trafic then on said bridge ‘,without giving war- ning of his approach and by not turning his automobile reason- ably to the right ,Or xm stoping the same when he saw,or by the exercise of reasonable care could have seen,plaintiff's son rid- Ling said horse over said bridge and recklessly ,carelessly and negligently driving his automobile against plaintiffs horse and injuring same so that it had to be killed, 2 That by reason of the carelessness and negligence of defendant in the operation of his automobile along and over said highway and bridge as above alleged plaintiffs horse was so in- 7 < jured that it had to be killed to the great damage of plaint- iff , to wit in the sum of two hundred and fifty dollars , Wherefore plaintiff demands judgment against the defendant for the sum of Two Hundred and Fifty dollars ,with interest on same from the 28th day of December 1918., at the rate of six per cent per annum til paid and for such other and further relief as may be just and proper, , ; / oa) ed P \ Xf - ® i - : | / ‘: 3 ee oe: .
