One of these lists shall be delivered to the widow, one to the personal repre- sentative, and one returned by the Justice, within twenty days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the deceased and also —_ debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt. This cause coming on to be heard upon the verified petition of the plaintiffs and being heard and it appearing to the satisfaction of the Court that the personal estate of the said John M. Byers, in- testate is insufficent to pay his debts and charges of administration and that a sale of a portion of his real estate will be necessary to pay the samerand that it would be more advantageous to all the parties interested to sell all of said land then to sell a sufficent amount thereof to pay off the debts of said intestate and charges of admin- istration and divide the remainder among the several tenants in com- mon owing to the small number of acres to which each would be entitled to in a division thereof, &nd it further appearing to the Court that the petitioner Mrs. Jennie Byers, widow of said intestate, whom the Court finds to be years old, is entitled to dower in the land described in the petition and that in lieu of dower in said land she desires to have her interest therein ascertained under the mortuary table and paid to her in cash. He shall also return to the clerk, on oath within three months after each sale made by him, a full and itemized account thereof, which shall be signed by him and recorded by the clerk. Revisal of 1905, section 42. Every executor, administrator and collector shall, within twelve months from the date of his qualification or appointment, and annually so long as any of the estate remains in his control, file in the office of the Clerk of the Superior Court, an inventory and account, under oath, of the amount of Property received by him, or invested by him, and the manner and nature of such investment, and his receipts and disburse- ments for the past year in the form of debit and credit.
