The commissioners shall make and sign three lists of articles assigned, — the value of each, the number of the ey. and deficiency to be paid by the personal representative. One of these lists shall be delivered to the widow, one to the personal representative, and one returned by the Justice, within twenty days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the de- ceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt. Item 1 ~ I will and bequeath to my husaand, W. L. Brown, 10 acres of land, the old home place, arid the two (2) acres joining the home place, deeded to me and my husband, four (4) acres joining the home place by Grandfather Brown, my husband to have this during his lifetime and at his death to my children, Vallie May Cone, E. L. Brown, D. G. Brown and M. K. Brown. 2 - I will and bequeath to Mary and Mary Ann Brown one thousand dollars as their share in my estate. They are to get Willie Brown a tomb. Item 3 - I also will and bequeath the balance of my estate (50 acres@ to Vallie May Cone, E. L. Brown, D. G. Brown and M. K. Brown. D. G. Brown has two acres of his part with his home on it and he gets his joining two acres on by his barn joining the Manton Young Land. Item 4 - My children are to take care of me and put a tomb to my grave, and if Vallie Cone or anyone does more to look after me than the others they pay them their part. The one paying Mary and Mary Ann the $1,000.00 is to get the cabin and the open space around it. He shall also return to the clerk, on oath within three months after each sale made by him, a full and itemized account thereof, which shall be signed by him and recorded by the clerk. Revisal of 1905, section 42. Every executor, administrator and collector shall, within twelve months from the date of his qualification or appointment, and annually so long as any of the estate remains in his control, file in the office of the Clerk of the Superior Court, an inventory and account, under oath, of the arnount of property received by him, or invested by him, and the manner and nature of such investment, and his receipts and disburse- ments for the past year in the form of debit and credit. He must produce vouchers for all payments. C., costs of this Final Report Current store accounts due at the time of the death of testator and paid by the Executrix during the normal course of business 4,147.86 Total General Disbursements 16,800.88 The Executrix, in order to make a full and complete account, wishes to make this explanation in addition to the handling of receipts and disbursements reported above. At the time of the death of the testator, he was operating a grocery store in the Town of Troutman and the Executrix was thoroughly familiar with the business. Under the terms of the will, she immediately took over, as the owner of the store, and in the course of the operation during the past year, has discharged all of the current dperating bills owed by the business. She has paid all other bills and has made an Inheritance Tax return, paying all taxes appearine to be due. In order not to sacrifice any of the property that she desired to retain, she has advanced out of her versonal funds a sufficient amount of money to discharge all obligations. She has delivered to her daughter, Ann Brown, stocks belonging to her or her husband equivalent to the bequest which the daughter, being of age, has accepted in full settlement. All the other property of the estate has been delivered in kind to the beneficiary and there are no further duties to be performed. WHEREFORE, the Executrix respectfully prays the Court that this report be accepted and that she be discharged from further duties to the estate. AL) Goer Executrix of J.
