Sec 1319-—Every executor, administrator and collector shall, within twelve months from date of his qualification or appointment, and annually, so long as any of the estate re- mains in his control, file, in the office of the Clerk ot the Superior Court, an inventory and account, under oath, of the amount of property received by him, or invested by him, ang the manner and nature ot such investment, and his receipts and disbursements for the past year in the form of debit and credit. This cause coming on to be heard, and being heard before the Honorable C. G. Smith, Clerk of the Superior Court of Iredell County, North Carolina, at his office in the Iredell County Courthouse, on Monday, October 8, 1956, at 3:00 o'clock, P. Me, upon the application of Mrs, Margaret B, Bristol to be appointed administratrix of the estate of Mrs. Margaret S. Brawley, and the application of Robert Vance Brawley, Jr. to be appointed administrator of the estate of Mrs. Margaret S, Brawley, and the Court finds the following facts: 1. That Mrs, Margaret B. Bristol is present and represented by her attorney, C. B. Winberry, Statesville, North Carolina, and that Robert Vance Brawley, Jr., is present and represented by his attorney, T. That the applicant, Robert Vance Brawley, Jr., is a resident of the City of Hickory, Catawba County, North Carolina, 6. All debts, claims and cost of administration in the estate have been paid, except as hereinafter set forth. 2. Mrs. Margaret B. Bristol rendered personal services for several months to her mother, Mrs. Margaret S. Brawley, and she made advancements and paid for nursing, maintenance, housekeeping and other care that is not included in the claims which she has shown paid to her in this Final Settlement, and for these services not shown in the claims herein, she is entitled to more than $300.00; however, since there was some question, she has not included this item of $300.00 and more in this settlement. Mrs. Margaret B. Bristol has letters from her sister, Mrs. Elizabeth B. Wolfe, which came after her mother's death, setting forth that Mrs. Bristol] was entitled to be paid for all of the personal services, care and advancements which she had made, and that she wanted her paid from any property in the estate. If any of the heirs should raise any question about any of the claims paid in the estate, then in such event, it is specifically understood and set forth herein that the further claim of Mrs. Margaret B. Bristol is not waived and that she will assert her claim to the fullest extent. The other claims paid herein were all justly due; in fact, the claim of H. C. Bristol, Sr. paid herein was less than it should have been; and if there is any question about it, or about any other claim, Mr. Bristol says that he is not waiving his right to the larger claim, but in such event will assert it. The Administratrix knows of her own personal knowledge that Johnny Kimball, Robert B. Bristol, and H. C, Bristol, Jr., advanced the money shown herein as claims to them for the maintenance, benefit and care of Mrs. Margaret S. Brawley, and that said claims, and each of them, are correct and justly due. 3. Robert Vance Brawley, Jr., a son of Mrs. Margaret S. Brawley, and who lived in Hickory, North Carolina, died September 3, 1960. w = © = o > a ae ae & oO - a LS 6 l C C. 8, Winberry, Attorney, has made an investigation of the factual situ- ation in connection with his heirs, his estate, and other matters pertinent there- to, which are as follows: A. Robert Vance Brawley, Jr. died September 3, 1960. At the time of his death, he was living in Hickory, North Carolina. He did not leave a will. There has been no administration on his estate. He left surviving him his widow, Carolyn Legrand Brawley, who now lives in Hickory, North Carolina. F, In 1952, Mr. and Mrs. Robert Vance Brawley, Jr. filed a Petition before the Clerk of Superior Court of Catawba County to adopt Carolyn Legrand Brawley, who was then four years old, and the Welfare Department placed this child in their home; that since 1952, Carolyn Legrand Brawley has lived in the home of Mr. and Mrs. Robert Vance Brawley, Jr., but because of some irregularity or some question, the final order of adoption was not entered until after Mr. Brawley's death. The question then arises whether or not Mrs. Brawley, widow of Robert Vance Brawley, Jr., is entitled to all of the distributive share of Robert Vance Brawley, Jr. herein, or whether she is entitled to one-half and the minor child one-half. Since there is no administrator or executor in the estate, and since there is a minor child, the Administratrix has been advised by her attorney to pay the distributive share of Robert Vance Brawley, Jr., Deceased, herein, to C. G. Smith, Clerk of Superior Court of Iredell County, North Carolina, for the use and benefit of the Estate of Robert Vance Brawley, Jr., and his heirs. 4. The Administratrix had not purchased a monument or marker for the grave of Mrs. Margaret S. Brawley, and after the Final Settlement had been written up, and the checks written, the Administratrix found a written note of instructions specifically requesting that if there was sufficient money left from the sale of the house, that a suitable monument be purchased for her grave. The Administratrix talked to her attorney, C. B. Winberry, about the matter, and he discussed it with Mr. C. G. Smith, Clerk of Superior Court of Iredell County, and Mr. Smith said that she had a right to purchase from the proceeds in her hands, a suitable monument and marker for the grave. The Administratrix contacted Winecoff Marble and Granite Company, Statesville, N. C., and she found a monument that she deemed satisfactory and on which Mr, Winecoff was willing to give her a discount of $100.00. The total ~5- cost of the monument, including the sales tax, was $283.25. The Administratrix wanted to pay as much as she could afford to herself, and she wishes that she could have paid for the whole thing personally, but she has paid the sum of $25.75 on the monument, and has paid from the estate the balance of $257.50. WHEREFORE, the undersigned, Mrs. Margaret B. Bristol, Administratrix of the Estate of Mrs. Margaret S. Brawley, prays that this report be accepted as her Final Settlement, that the same be audited, examined, approved and ordered re- corded, as provided by law, and that she and the sureties on her bond be dis- charged as provided by law.
