Box 186 Statesville, North Carolina Dear Mr. Smith: I had planned to finish the settlement of the J. E. Brawley Executor account this week, but this snow and ice came Saturday and I do not feel like calling Mrs. Brawley to come out in this weather so I will have to wait to make the settlement until the weather gets better. I call your attention to this - there is a certificate of stock from Burlington Industries; also a certificate of stock in the North Carolina National Bank, together with a certificate of deposit in the Mooresville Federal Savings and Loan Association and a certificate of deposit in the Citizens Savings and Loan Assoc- iation. I can see no difficulty in getting the cash transferred from the bank nor in getting the certificate of deposit in the Mooresville Federal Savings and Loan Association and the certificate of deposit in the Citizens Savings and Loan Association transferred. However, I see difficulty in getting the Burlington Industries stock transferred and the North Carolina National Bank stock transferred. As soon as it seems feasible and safe for Mrs. Brawley to come out, I will contact her and prepare the settlement. This weather has confined me to the house and to the office. Pressley comes for me and brings me to the back door of our office where the ice has all been cleared away. I have not attempted to cross the street and go to the bank, and since I see conditions of the weather relating to myself, I am sure it would not be safe for Mrs. Brawley to come out. SMITH, C. S. C. OF IREDELL COUNTY, N. C.: The undersigned would respectfully show to the court that J. E, Brawley and L. T. Brawley were appointed by letters testamentary as executors of the estate of A. D. Brawley, deceased, and by authority of said letters testamentary, the said J, E. Brawley and L. T. Brawley took control and possession of the assets of the A. D. Brawley, deceased, estate, and continued under the terms of the will until one of the executors, L, T, Brawley, died, and from then on to December 8, 1964, J. E. Brawley conducted and controlled the estate of A. D. Brawley as executor and made annual settlements with the Clerk Superior Court of Iredell County. J. E, Brawley, exedutor of the A. D. Brasley estate, died on December 8, 1964 before an annual accounting had been made, and the executrix of his estate made up an accounting and forwarded it to the Clerk Superior Court of Iredell County; that the said executrix has not done anything more toward the A. D. Brawley estate, and now hereby delivers to the Hon. C. G. Smith, C. S. C. of Iredell County, the follow- ing assets that were left in the name of J. E. Brawley, executor of the A. D. Brawley estate, viz: Certificates of deposit in the Mooresville Federal Savings and Loan Association in the amount of $10,000.00; 375 shares capital stock in North Carolina National Bank; 288 shares common stock of Burlington Industries, Inc.; 187.69 shares of the preferred stock of Farmers Cooperative Exchange, Inc., and certificates of deposit in the Citizens Savings and Loan Association of Mooresville, N. C., in the sum of $4300. In addition thereto, deposit in the First National Bank of Moores- ville on checking account $3711.14, a savings account as evidenced by a pass book for First National Bank of Mooresville in the sum of $949.60 as of February 1, 1963, and cash on hand in J. E. Brawley's possession at the time of his death, $143.16. On or about December 30, 194, a check was received from the Citizens Savings and Loan Association in the amount of $66.00 payable to the "A. D. Brawley Estate, J. E. Brawley, Executor", which check is now being handed to the court; also, a check dated December 31, 1964 payable to the "Estate of A. D. Brawley" as a dividend from North Carolina National Bank in the amount of $93.75; another check from the Mooresville Federal Savings and Loan Association payable to the order of J. E, Brawley, executor of A. D. Brawley Estate, $200.00; house rent in the sum of $45.00 was handed to Mrs. Marie G. Brawley, executrix, which amount is also paid over to the Clerk Superior Court of Iredell County for the estate of A. D. Brawley. In addition to the above cash items, Wordy Mills left $12.50 for house rent on January 11, 1965, which is included in the amount paid over to the Clerk Superior Court. A certi- ficate of stock issued by the Burlington Industries to the A. D. Brawley Estate for 288 shares common stock. The above constitutes all the assets belonging to the A. D, Brawley Estate which were in the possession of J. E. Brawley, executor of A. D. Brawley estate, at the time of his death, Mrs. Marie G. Brawley, executrix of the will of J. E. Brawley's estate during the month of August 1964, and in carrying out the contract, he broke 42 acres of land in preparation for planting cotton during the 1965 season. Later, Mr. Gibson, the successor to J. —. Brawley, executor, has rented the same land to other people. Francis went to see Mr. Gibson and he told him that he wanted to talk it over with you and that is why I am writing you now. As I understand the law, Mr. Brawley had the legal right to rent this land for 1965 at the time the contract was made. August is the month shat contracts of this kind are usually entered into. This has left Francis in a very bad position as to working 4 crop for this year. I think you will agree with me that Mr. Brawley as executor of the A. 0). Brawley estate had the legal right to enter into this contract, and I am sure that oir.
