Boling Dear Mr. Smith: Esther C. Boling was fatally injured in an automobile accident in Iredell County in September of 1959. On the 3rd day of November, 1959 Mr. Eugene C. Hicks, III qualified as Administrator of Mrs. Boling's estate in order to bring an action for wrongful death. This action was duly prosecuted in the Superior Court of Mecklenburg County and a Judgment in the amount of $2,114.00 was obtained against her husband, Ruben C. Boling. However, the insurance company refused to pay the Judgment and after much discussion the heirs agreed to take a settle- ment of $1400.00 in full satisfaction of the Judgment, In the meantime since the Judgment appeared to be uncollectible Mr. Hicks filed his final account on January 28, 1961, I enclose herewith a copy of a Petition which we would like to present to you on behalf of the Administrator along with an Order which we would like for you to enter if it meets with your approval, Please advise me what action will be necessary in order to have Mr. Hicks reopen the estate and settle the Judgment, pay the expenses and make distribution. Boling Administrator File # 2921 Dear Judge Smith: Please refer to my letter of July 10, 1962 in subject case requesting that you give approval to a settlement of the $2114.00 Mecklenburg County Judgment for the sum of $1400, 00 as requested by the next of kin of the deceased, and to your letter to me of July 11, 1962. We had felt that you could give approval to such a matter just as you do any matter contained in a Final Account. However, in view of your decision, I am now in the process of obtaining affidavits from each of the next of kin of the deceased stating that they request me to settle the Judgment in the manner stated, cancel the Judgment, and make disbursement of said $1400.00, and I believe the insurance carrier of the de- fendant husband of the deceased may pay said sum to me on that authority with- out a Court Order. Of course, I certainly would not want to take the settlement, cancel the Judgment, and disburse the money and then have my Final Account disapproved in any respect. For this reason, I have filled it out exactly as I plan to submit it, setting out all the facts for record purposes, and accounting for each disbursement which I must make after receiving the $1400.00 assets, I also intend to present the cancelled checks for each expenditure noted as a receipt therefor. Smith, Clerk of Superior Court of Iredell County, N. C. KNOW ALL MEN BY THESE PRESENTS, that in consideration of the premises, the undersigned affiants, being first duly sworn, on their oath depose and say: l. That Esther C. Boling died intestate (without leaving a Will) as the result of an automobile accident in Iredell County, North Carolina, on September 16, 1959. 2. That Esther C. Boling left as her sole surviving next-of-kin and heirs her husband, Ruben Donald Boling, and three children all over twenty-one years of age, Elsie O, Gillespie, daughter, John Robert Young, son, and George Chester Young, son, and no other children or children of deceased children, 3. That with the knowledge and consent of said next-of-kin named in Paragraph #2, Eugene C. Hicks, II., of Mecklenburg County, North Carolina qualified as Administrator of the Estate of the deceased in Iredell County, North Carolina on November 3, 1959 for the sole purpose of bringing a civil action to recover damages for the wrongful death of the deceased, and said Administrator did institute such action in the Superior Court of Mecklenburg County, North Carolina designated as SD #36-820 and entitled "Eugene C. Hicks, II., Administrator of the Estate of Esther C. Boling, Deceased, Plaintiff vs. Nehi Beverage Company of Salisbury, Keith Ray McGee and Ruben D, Boling, Defendants," 4. That said civil action resulted in a verdict and judgraent in favor of the plaintiff, Eugene C, Hicks, Ill,, as Administrator of the Estate of Esther C, Boling, in the amount of $2, 114.00 and costs, against Ruben D. Boling, defendant (husband of the deceased), said Judgment being duly docketed in the office of the Clerk of Superior Court of Mecklenburg County, in Judgment Book 27, pagelll on November 22, 1960; but inasmuch as there were no assets of said defendant available upon which to levy execution and his liability insurance carrier, The Metropolitan Casualty Insurance Company of New York, denied coverage and refused to pay said Judgment, or any of it, the Administrator of the Estate, upon the advice of attorneys for said Estate, Myron N, Lane of Wollaston, Massachusetts, and Ernest S. DeLaney, Jr., of Bradley, Gebhardt, DeLaney and Millette, Charlotte, North Carolina, caused said Estate to be closed by the filing of a Final Account on February l, 1961, showing that no funds had ever come into the hands of the Administrator, 5. That under North Carolina law, Ruben D, Boling, husband of Esther C, Boling, deceased, having been adjudged legally responsible for the death of said decedent, is not entitled co distribution of any part of the assets resulting from said civil action, but that your affiants, Elsie O, Gillespie, daughter, John Robert Young, son, and George Chester Young, son, are the only parties having any interest in the distribution of said assets by the Administrator, Eugene C, Hicks, II, 6. That after the Estate of Esther C, Boling was closed by the Administrator, as aforesaid, the next-of-kin of the deceased determined through the attorneys for the Estate and communicated to the Administrator that the defendant in said civil action, Ruben D, Boling, and his liability insurance carrier, desired to compromise and settle the aforementioned ‘udgment in the amount of $2, 114,00 and costs upon payment of the total amount of $1, 400,00, from which $1, 400.00 sum should be paid by the Administrator all expenses of the Estate, all expenses and attorneys fees of the said civil action, all Court costs and other expenses, and the re- mainder, if any, distributed to the next-of-kin of the deceased entitled under the laws of North Carolina. 7. That the next-of-kin of Esther C,. Boling, your affiants, Elsie O, Gillespie, daughter, John Robert Young, son, and George Chester Young, son, acting of their own free will and without coercion or under the influ- ence of others, and being fully aware that no execution or other legal proceeding had been brought to enforce the payment in full of the entire Judgment for $2, 114,00, interest, and costs, docketed in Judgment Book 27, page 111, in the Office of the Clerk of Superior Court of Mecklenburg County, North Carolina against the defendant, Ruben D, Boling or his liability insurance carrier, petitioned, advised and requested Eugene C, Hicks, II, to re-open the Estate of Esther C. Boling, to accept the said $1, 400.00 in full satisfaction of said Judgment for $2, 114.00, interest, and costs, to execute Releases of said Judgment and fully cancel the same from the public records, to pay from said $1, 400,00 all expenses of the Estate, all expenses and attorneys fees of the said civil action, all Court costs and other expenses, and to distribute the remainder, if any, to the next-of- kin of the deceased entitled thereto under the laws of North Carolina, namely, Elsie O, Gillespie, daughter, John Robert Young, son, and George Chester Young, son. 8. That acting on the request of said next-of-kin and the attorneys for the Estate of Esther C, Boling, the aforesaid Myron N, Lane, and Ernest S, DeLaney, Jr., the said Eugene C, Hicks, III, re-opened the ie Estate of Esther C. Boling in Iredell County, North Carolina pursuant to the Order of said Court signed July 9, 1962 permitting the re-opening of the Estate to administer on new assets, 9. That your affiants, being all the next-of-kin of Esther C, Boling entitled to share in any way in the distribution of the assets of $1, 400, 00 in the hands of Eugene C, Hicks, Il,, Administrator, together with their respective spouses who execute this Instrument to signify their knowledge and approval of the same as well as of the Final Account attached hereto, do hereby expressly approve said settlement and authorize Eugene C, Hicks, Ill., Administrator, to accept $1, 400.00 in full and complete settlement of the aforementioned Judgnent for $2,114.00, interest and costs, to exe- cute full Releases releasing the defendant, Ruben D, Boling and his lia- bility insurance carrier from all further liability in connection with the death of Esther C. Boling and from said Judgment, to cancel said Judgment docketed in Judgment Book 27, page 111 in the Office of the Clerk of Su- perior Court of Mecklenburg County, and to pay from said $1, 400,00 all ex- penses of the Estate, all expenses and attorneys fees of the said civil action, all Court costs and other expenses, and to distribute the remainder, if any, to the next-of-kin of Esther C, Boling entitled under the laws of North Carolina, and the reafter to close said Estate. 10. That your affiants, and all of them, do certify that they have seen and examined and been provided with a copy of the Final Account of Eugene C, Hicks, IIl,, Administrator of the Estate of Esther C. Boling, a copy of which is attached, showing the receipt of the said $1, 400,00 settlement, accompanied by a copy of all itemized bills attached thereto and made a part of said Final Report, as well as the distribution of the remainder of assets after all said disbursements, and that affiants do hereby expressly approve said Final Account and all said disbursements made, especially the disbursement of a total of $429.44 to the law firm of Bradley, Gebhardt, DeLaney and Millette, of a total of $200. 20 to attorney Myron N, Lane, of a total of $141.65 to Eugene C, Hicks, III., Administrator, and of a total of $136.75 to the Clerk of Superior Court of Mecklenburg County, and affiants do hereby expressly approve of the distribution of the remaining assets of $161.89 to Elsie O, Gillespie, of $161.89 to John Robert Young, and of $161.88 to George Chester Young, and further, affiants to hereby agree and covenant to save and keep harmless and indemnify Eugene C, Hicks, IIl., Administrator of the Estate of Esther C. Boling was fatally injured in an automobile accident in Iredell County in September of 1959. On the 3rd day of November, 1959 Mr. Eugene C. Hicks, III qualified as Administrator of Mrs. Boling's estate in order to bring an action for wrongful death. This action was duly prosecuted in the Superior Court of Mecklenburg County and a Judgment in the amount of $2,114.00 was obtained against her husband, Ruben C. Boling. However, the insurance company refused to pay the Judgment and after much discussion the heirs agreed to take a settle - ment of $1400.00 in full satisfaction of the Judgment, In the meantime since the Judgment appeared to be uncollectible Mr. Hicks filed his final account on January 28, 1961, I enclose herewith a copy of a Petition which we would like to present to you on behalf of the Administrator along with an Order which we would like for you to enter if it meets with your approval, Please advise me what action will be necessary in order to have Mr. Hicks reopen the estate and settle the Judgment, pay the expenses and make distribution. A. Bollinger estate, filed a verified inventory, listing all the personal property belonging to Mrs. W. A. Bollinger at the time of her death; that among the items listed in the inventory was three shares of stock in the Farmers and Merchants Bank of Newton, North Carolina, upon which a value was placed of three hundred dollars ($300.00), which is the par value of the stock; that on 23 November, 1935, your petitioner, the Administrator, offered for sale at public auction all of the items of personel property belonging to the estate except the bank stocks and three notes, and that these are still in the hands of your petitioner, the Administrator, unsold. aSe That your petitioner is informed and believes, and, therefore, states that in his opinion it would be unwise to offer the bank stocks and the notes for sale at public auction, and that it would be to the interest of the heirs of the estate to have these items of personal property sold at a private sale; that the notes can all be collected in full, unless it is the note of one hundred dollars ($100.00) due by Mrs. P. M. Cline, which has thus far not been paid. wha That among the items listed unsold is three shares of stock in the Farmers and Merchants Bank of Newton, North Carolina, with the par value of one hundred dollars (3100.00); that your petitioner, the Administrator, has made inquiry as to the value of this stock, and upon information he alleges that a number of shares have been bought and sold; that the highest price which has been paid has been eighty dollars ($80.00) per share; that he has conferred with Mr. J. W. Abernathy, of Newton, North Caroline, and Mr. A. L. Shuford, of Conover, North Carolina, and that he has succeeded in securing offers from these gentlemen in the amount of three hundred dollars ($300.00), which represents the par value of the three shares of stock; that in his Opinion the offer should be accepted and it would be advantageous to all the heirs, and thet he is of the Opinion that this offer is more than he can secure from any other sources or by public sale. WHEREFORE, he prays the Court: 1. That an order be issued by the Court directing him to accept the offer of three hundred dollars ($300.00) made by J. W. Abernathy, of Newton, North Carolina, and A. L. Shuford, of Conover, North Carolina, and thet upon the payment of this money, he deliver the three shares of stock in the Farmers and Merchants Bank of Newton, North Carolina, properly endorsed. 2.
