The petitioners complain and allege: FIRST. That He Ae Blackwelder died during the year rae, leaving a last will and testament, which will is as follows; "North Carolina) Iredell County) I, H. A. Blackwelder, of the aforesaid county and state, being of sound mind but considering the uncertainty of my earthly existence, do make and declare this my last will and testament. First. My executor, hereinafter named, shall give my body a decent burial, suitable to the wishes of my friends and relatives, and pay all funeral expenses, together with all my just debts out of the first moneys which may come into his hands belonging to my estate. Second. I give and bequeath to my beloved wife, Amanda Blackwelder, the use of all my property that I may die possessed of, both personal and real for the term of her natural life with the privilege of disposing of one-half of said proper- ty in fee-simple, at her death, the remaining one-half to revert to my heirs at her death to be theirs to do with as they please. Third. I hereby constitute and appoint my beloved wife, Amanda Blackwelder my lawful executor to all intents and purposes, to execute this my last will and testament, according to the true intent and meaning of the same, and every part and clause thereof- hereby revoking and declaring void all other wills and testaments by me made heretofore. That Amanda Blackwelder, widow of He A, Blackwelder, deceased, entered upon the administration of the said estate, but before the same was finally settled, the said Amanda Blackwelder died intestate. Black- welder, his widow, Amanda Slackwelder, converted to her own use certain personal property, namely- notes and money, that the prop- erty so converted was less than one-half the value of estate of said He ae Blackwelder. SEVENTH. That the remainder of estate of said H. Ae Blackwelder, consiewie- of personal property in the form of money and notes, amounting "i $73D0O.UD and the following described real property: hn, = Ee, "Beginning at an iron pin, Hethcox corner in center of old road, thence North 81W. 84 poles to a stone on Lipe's line; thence S. 10% W. 53 poles to a stone on Lipe'’s line; thence Ss. 84 Ee 98 poles to an iron pin on edge of sand clay road, Cloaninger's line; thence N. 19 W. 11 poles to an iron pin in center of 014 road, Harris‘ corner; thence N. 2 BE, 43-1/3 poles to the beginning, containing 30 acres more or less. Land lies in Coddle Creek Town-~ ship, Iredell County, N. C. on the Coddle Creek Road." EIGHTH. That the heirs at law of Amanda Blackwelder, deceased, and the heirs of H. aA. Blackwelder, deceased, have in writing authorized the Clerk of the Superior Court of Iredell County to make them parties to an ex parte proceeding, joining in with administrator of said H. A, Blackwelder, deceased, for the purpose of asking the Court to construe the will of the said H. A. Black- welder. NINTH. That J. M. Blackwelder, after the death of Amanda Blackwelder, was appointed administrator deben.c.t.a.of the estate of H. A. Blackwelder, deceased, and has denied the demands of both the heirs at law of Amanda Blackwelder, deceased, and the heirs at law of HK. A. Blackwelder, deceased, Aino siti he Court to construe the will of said H. A. Blackwelder, deceased, and direct him how to disburse the personal estate of said H. Ae Blackwelder, testator as aforesaid, and to direct who are the owners of the realty under the said will. wiEREpey, tre said petitioners ask that the Court construe the said will of H. Notice to Creditors was duly published in the Statesville Record for Six consecutive weeks, commencing January 10, 1961. 2. Inheritance Tax Report was filed, with the North Carolina Depart— ment of Revenue, but there was no tax due. 3. All claims which were filed with the Executrix, or of which she had any knowledge, have been paid in full. 4. Mrs. Leola W. Blalock has advanced the money to pay the debts and cost of administration, and she makes no claim against the estate, or against the property in the estate, 5. In Item III of the will of Thomas Lee Blalock, he left certain books to the Independent Baptist Direct Mission, Inc, The Executrix has notified the Independent Baptist Direct Mission, Inc. that they can pick up these books at any time that it is convenient for them to do so, and the Executrix is ready to deliver them in accordance with the will. 6. Mr. Thomas Lee Blalock is buried in Bear Creek Baptist Church burial ground between Spruce Pine and Bakersville, N. C., in Mitchell County. 7. The real estate consisted of a duplex apartment house at No. 210 Cowles Street, Statesville, Iredell County, N. C., and this was owned by Thomas Lee Blalock, and was devised in his will in fee Simple to his wife, Leola W. Blalock, 8. The only personal property in the estate consisted of the house- hold and kitchen furniture and the books, and with the exception of the books bequeathed to the Independent Baptist Direct Mission, iInc., the remaining books were bequeathed to the widow, Mrs. Leola W. Blalock, and all of the household and kitchen furniture was bequeathed to her. WHEREFORE, having fully administered on the Estate of Thomas Lee Bla- lock, the undersigned Executrix prays that this report be accepted as her final settlement, and that the same be examined, audited, approved and ordered re- corded, Respectfully submitted.
