Te shall also return to the Clerk, on oath, within three months after each sale made by him, a full and itemized account thereof, which shall be signed by him and recorded by the Clerk. : 1399.—Every executor, administrator, and collector shall within twelve months from date of his qualification or appointment, and annually, so long as any of the estate remains in his control, file, in the office of the Clerk ot the Superior Court an inventory and account, under oath, of the amount of property received by him, or invested by him, and the manner and nature of such investment, and his receipts and disburse- ments for the past yearin the form of debit and ¢ t. He must produce vouchers for all payments. The Clerk may examine on oath, such accounting party or any other person, conce ig the receipts, disbursements, or any other matter relating to the estate; and having carefully revised and audited such account, if he approve the same, he must endorse his approval thereon, which shall be deemed prima face evidence of correctness. One-third cash; one-third in three months; and one-third in six months time, and report his proceedings without delay to this Court, and this cause is retained for further direction. Bell, commissioner appointed by the Court to sell the lands described in the petition of the plaintiff on the 2né dey of April, 1900, sold at public auction to pr. Je G. Houston the tract mentioned ana described in said Peti- tion as containing five acres, at the price of Twelve Dollars (#12) per acre, to be paid upon the terms hereinbefore ordered. Ane it appearing that the said sale is reasonable and just, It is therefore ordered and decreed that the sale of the said five-acre tract to the said Dr. J- G Houston be and the same is hereby in all respects confirmed, and that the said J. Bell, died intestate in Iredell County some years ago and the said Samuel Bell left him surviving the following children, to-wit: Lula Bradford and Emma Brown, and that the said M. W. Bell left him surviving the following children, to-wit: Bessie Templeton, Cora Bell, Willie Bell and Janie Bell as their only heirs at law, of whom the said Willie Bell and Janie Bell, children of M. W. Bell are infants under Twenty~one years of age and without any general or testamentary guardian.
