There being a defi iency of the articles on hand to make up the year’s support, we assess such deficiency at Dollars, to be paid by the personal representative. Thing LL NOTE. The widow is entitled to $500 out of the crop, stock and provisions of the deceased, and $150 additional for each member of the family under fifteen years old, as her year’s support. The commissioners shall make and sign three liste of articles assigned, stating the value of each, the number of the family, and deficiency to be paid by the personal represent- ative. One of these lists shall be delivered to the widow, one to the personal representative, and one returned by the Jus- tice, within twenty days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the deceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt. Sinks, renounced her right to qualify as Executrix in this estate. 2. The funeral bill at Nicholson Funeral Home was $922.45, The estate paid $448.54 as shown above. The balance of $473.91 was paid as follows: A. Mrs. Ellen B. Sinks turned over on this bijl the proceeds of an insurance policy which was payable to her in the sum of $223.00, and she makes no claim against the estate for this. B. Mrs. Bonnie R. Speaks advanced and paid personally the balance of the funeral bill in the sum of $250.91, and she makes no claim against the estate, but her brothers and sisters are making settlement with her for this advancement, and the said Mrs. Bonnie R. Speaks does in all respects release the estate, and the property of the estate in connection with said advancement. 3. Mrs. Bonnie R. Speaks advanced and paid personally to Winecoff farble and Granite Company for the monument $154.50. She does not make any claim egainst the estate for this, but her brothers and sisters are settling with her. Mrs. Bonnie R. Speaks in all respects releases fully and completely the estate and the property in connection with said advancement. 4. Notice to creditors was duly published in the Statesville Record once a week for four consecutive weeks, commencing with the issue of January 30, 1963, and the notice notified all persons to file their claims on or before the 5th day of August, 1963. 5, All debts, claims and cost of administration which were filed with the Executrix, or of which she had any knowledge, have been paid in full. 6. An inheritance tax return was made to the North Carolina Department of Revenue, but there was no tax due. 7, Under the codicil to the will of Mrs. Mattie Ellen Beaver dated July 1, 1960, she stated that she had advanced to her oldest son, James Leonard Rayle, the sum of $1,000.00, and that in the settlement of her estate, she wanted ud ] we y “d A r o g © ON Ww each of the other children to have $1,000.00 before James Leonard Rayle received anything, and thereafter any property remaining in her estate be divided equally between her six children. The distribution has been made in that manner as appears from the foregoing settlement. 8. Some of the household and kitchen furniture was divided among the legatees. The refrigerator and stove in the home belonged to Mrs. Ellen B. Sinks, and this was sold by the Executrix at her request for $150.00, and the money sent to her. All of the other household and kitchen furniture was sold and the money from the sale is reported under Receipts. 9. The Executrix does not make any charge against the estate for her commissions or services. WHEREFORE, having fully administered on the Estate of Mrs. Mattie Ellen Beaver, Mrs. Bonnie R. Speaks, Executrix, prays that this report be accepted as her final settlement, and that the same be audited, examined and approved, and that she be discharged as by law provided. Beaver, and the Executrix in this Estate, has advanced personally in order to complete the payment of the debts, the sum of $534.52, for which she has not been reimbursed. (See under Receipts. ) She also advanced personally and paid the medical bill of Dr. S. A. Rhyne amount ing to about $445 ‘ = » for which she has not been reimbursed. (This is not shown in disbursements.) She has also advanced and paid some interest which is not shown in disbursements. As Executrix she is entitled to commissions on receipts and disbursements which would amount to more than $800.00, and she has not received any part of this. The rents and crops raised in 1946 and 1947 have not been put into the estate, nor any expenses in connection therewith. The taxes for the year 1946 and 1947 were not paid out of the estate, but by Mrs, Rena Drye Beaver personally. She has been advised by counsel that since the land was devised to her for life she was not required to put 1946 and 1947 crops and rents in the estate; however, if any demand is made for her to account for said crops and rents, she resumes the right to assent and claim payment therefrom of the $534.52 advanced by her, and for the commissions she is entitled to receive as Executrix, for payment of the medical bill to Dr. S. A. Rhyne, and interest paid by her, for payment of taxes, and all other expenses in raising the same, together with the rental she is entitled to, and for use of her machinery in work. ing said crops. (There would be very little net, if any, from the 1946 and 1947 crops and rents after payment of taxes, fertilizer, and other charges in connection therewith are paid.) Notice was duly published to creditors once a week for six consecutive weeks in the Statesville Daily, the first publication being on the day of June, 1945. H. A. Ervin, Administrator of the Estate of Marvin A. Beaver, filed a claim on June 10, 1946, in the amount of $83.70, which he claimed represented commissions due him in said estate, and which he contended M. A. Beaver, the decedent in this matter, had agreed to pay. This claim was investigated, and on July 18, 1946, Mr. Ervin was notified in writing that the claim was denied and disallowed, and he has not instituted suit or taken any further action, and the time allowed by law for him to institute suit has now expired. All claims filed with the Executrix, or of which she had any knowledge, except the one referred to in the preceding paragraph, have been paid in full, M. A, Beaver died on June 13, 1945, and the crops which were then grow. ing were cultivated and harvested, and the receipts from the sale of the crops for the year 194§ @re shown in this report, The expenses in connection with the cultivation and harvesting of said crops are also shown. Some of the cows, all of which were devised under the Will to Mrs. Rena Drye Beaver, were sold, and the money received from the sale of these cows has been included in the receipts. The money received from the sale of milk in the year 1945, after the death of M. A. Beaver, and the milk program checks from the United States have been included in the receipts, With the exception of $57.86, all of the milk checks came from milk sold after the death of M. A. Beaver, The check from the sale of milk and the milk program check were probably not required to be included herein, but since the hay and other feed on hand at the time of the death of M, A, Beaver was used to feed the cows to produce the milk, these items have been shown as receipts. The Will of Moses A, Beaver is recorded in Will Book 12, page 454, in the office of the Clerk of the Superior Court of Iredell County. Sometimes in this report and in some of the other papers in connection with this Estate, Moses! A. Beaver has been referred to as M, A, Beaver, and the said Moses A. Beaver and | M. A. Beaver is one and the same person. WHEREFORE, having fully administered on the Estate of Md, A. Beaver, and having fully accounted for all receipts and property coming into her hands as Executrix of the Estate,Mrs. Rena Drye Beaver, Executrix of the Estate of M. A. Beaver, prays that this report be accepted as her final settlement, and that the same be audited, approved and recorded, and that she be discharged as by law provided, Respectfully submitted, this the 9th day of April, 1948. Beaver - Administrator of Estate of Rober Marvin Beaver, Deceased Dear Mr. Smiths In examining the file in connection with the above captioned case I find that apparently no accounting has been filed and I would say that not even a complete inventory. As you know this case was written in May 1951 and as your records will show it was not until May 1952 that any thing at all was filed. The filing then consist of nothing more than a report by the administrator civing an itemized inventory of personal property. I hate to be critical of the method of handling an estate but I believe that you will agree with me that complete inventory certainly should have been filed and that by now a complete accounting of all receipts and disbursements should have been filed with you. I know that you made every attempt to get the administrator to co-operate with you and I also realize that you dislike to exercise the full authority given you under the state statue but in this particular case it appears to me that the administrator will show no regard what so ever for your authority as probate judge and I would certainly like to see a citation issued for them to appear before you and show cause why then should not be forced to make the proper filing as required by law. If you agree with my thoughts on this matter I trust that you will take the appropriate action. Aiso, on several occasions I have checked with Mr. Neil Sowers, Attorney at Law, in regard to this matter. I have been very disappointed to find that accountings @s required by North Carolina law have not been filed. In November 1955 we were furnished with a copy of an auditor's statement prepared by Mr. E. E. Bowyer which apparently was pre~ pared with the intent of bringing aii information up to date through May 31, 4955, and I wouid assume was preparatory to filing an accounting. As I said, I have been disappointed that accounting has not been properly filed with the Cierk of Superior Court. We are also somewhat disturbed in the comment made in this auditor's statement which points out the fact that Federal and State Fiduciary Income Tax Keturns have apparently never been fiied. It is imperative that you immediately contact your attorney and with his assistance prepare filings jin connection with the administration of this estate and bring them up to date. Beaver Dear Mr. Smith: The foregoing partial final settlement of the Estate of R. M. Beaver was compiled from the audits made from time to time by the accounting firms of Jano & Jones and E. E. Boyer, all C. P. A.'s; and we have checked the final totals and they conform to the penny with the audits filed. The report shows that at the time of the death of R. M. Beaver the indebtedness was a total of $35,330.18; and as the record now indicates, there are no outstanding bills remaining unpaid, with the exception of $19,000 due to Prudential Insur- ance Company, on a first mortgage on real estate. In addition there is an indebtedness due the Estate by Grady Beaver of $6,464.01; this figure is subject to further adjustments for payments since the audit was made. When this is collected, it is supposed to be paid towards the reduction of the Prudential Insurance Company mortgage, leaving this indebtedness to the Prudential Insurance Company, approximately $14,000. The personal property sold was handled in the best available manner, as at the time of the death of R. M. Beaver, the herd of cattle was under quar- antine by reason of having had Bang's Disease in the herd; and the only pos~ sible sale could have been for beef purposes. The Administrators continued to work to improve the herd and with quarterly checks, they finally got the herd released from quarantine, so they could be sold as a milk herd, which was the only way for it to bring its real worth. The appraisal of the herd and equipment was made by three competent, top-notch farmers and dairymen, namely, Howard M. Stamey, C. L. Reitzel, and Ralph Shepard. The handling of the personal property and the administration of the Estate have been with family conferences from time to time determining the course that should be taken, because, at the time that R. M. Beaver died, a forced sale would have made the Estate insolvent. As it is, if the present course, as has been plan- ned by the family is carried out, the Estate should have a net worth of between $15,000 and $25,000. Mr. C. G. Smith Page two July 16, 1956 The only matters remaining to be completed in the matter of the Estate are as follow: 1. The filing of inheritance tax, which can now be easily done, as the Estate is where the worth can be more accurately computed. 2. Filing of income taxes on the Estate from year to year. This should have been done, and, of course, this office was under the impression that the auditors were filing the reports at the time of making their annual audits; apparently, they were not instructed to do so. 3. The collecting of the remainder of the money due the Estate by Grady Beaver. This is in the process of being done, and can be done immedi- ately upon the settling of the inheritance tax matter, as Mrs. Ada Belle Beaver, the widow of R. M. Beaver, is allowing him to put up as security 160 acres of farm land, of which she is the owner as the deed to this particular tract of land was by the entirities. We are of the opinion that a careful study of the audit will reveal that the administration of the Estate, while drawn out, has been in a business-like manner, and that the greatest good has been accomplished by proceeding in the manner and method in which the administration has been done. The 1956 audit reveals that Mrs. Ada Belle Beaver is due the sum of $2,721.06 for her remaining share of the administration fee, and that Robert L. Beaver is entitled to $770.09. It is our understanding that Robert L. Bea- ver's administration fee is subject to a credit of $353 on the Smith-Douglas account which was paid by the Estate. Beaver worked out a settlement of the balance of the estate among themselves, which upon calculation amounted to $4,039.00 for each of the 8 children and in order to finally settle the estate one tract of land was conveyed to C. W, Beaver and one tract of land was conveyed to Grady Beaver. The tract conveyed to Grady Beaver was 141.6 acres. The purchase price was $22,000.00. The tract of land conveyed to C, W. Beaver was 144.5 acres. The purchase price was $15,000.00. Each of them, Grady Beaver and C. W. Beaver, obtained loans from the Prudential Life Insurance Company totaling $17,000.00 which liquidated the Prudential mortgage on all of the lands of R. M. Beaver, and the same was marked paid and cancelled of record. Six of the heirs, to wit: Robert L. Beaver, Thelma Beaver Brown, Naomi Beaver, single, John L. Beaver, Ella Mae Harkey and Odessa Stutts, were conveyed by C. W. Beaver, Grady Beaver and Mrs. Ada Belle Beaver the fee simple title to 2 tracts of land, one containing 27 acres and the other 59 acres, more or less, which they in turn by agreement divided among themselves. The widow, Ada Belle Beaver, accepted in lieu of a dower a life estate in the homeplace containing 20 acres, more or less, and appropriate deeds have been executed for the same, And in further settlement there was executed by Grady Beaver and wife, a note and deed of trust in the amount of $10,000.00 payable to Robert L. Beaver, Thelma B. Brown, Naomi Beaver, John L. Beaver, Ella Mae Harkey and Odessa B. Stutts. Clifford W. Beaver and wife, executed a note and deed of trust in the amount of $4,315.26 payble to Robert L. Beaver, Thelma B. Brown, Naomi Beaver, John L. Beaver, Ella Mae Harkey and Odessa B. Stutts. Both deeds of trust are second to the Prudential deed of trust which the above Grantors borrowed upon the land in order to obtain money to pay the Prudential deed of trust against all of R. M. Beaver's land and to obtain funds for paying all of the remaining debts of the estate. The settlement and adjustment of the estate among the heirs at law was based upon an agreed valuation that all of them put on the estate, after payment of all debts, of $4,039.00.
