That Ben Ballard is dead and that 7.".Hall was properly appointed administrator of the estate of the said deceased by the clerk of the superior court of Iredell county,N.C. end. That the defendant,the Carolina and Northwestern Railway Company is e corporation duly organized under,and existing by law,and,is now,and at the time hereinafter mentioned, was oncaged in operating a line of railroad from the State line botween South Carolina and North Caroline by the way a of Dallas,N.C. to Lenoir,N.C. and elsewhere in said ate of North Caroline 1s a common carrier of passenrers anc ht for hire. on or about the 15th day of November,1905 the plaintiff's intestate was going from Gastonia,!.C. to Dallas,N.C. along the track of the defendant's road and while on the trestle,a long,high pridge over Big, Long Creek,one of the defendant's trains under the control of cone ef the seid defendant's engineers,came in sight and the said engineer seeing the said deceased on the track and on the said high bridge,blew an alarm signal but made no effort to slacken the speed of his said train or to stop the same - but wilfully and negligently rushed on and ran over the said deceucsed with his engine and cars and horibly mangled his body and instantly killed the said deceased- that at this ppace 4+ was easy for the defendant's enrineer to have seen that the said intestate was a perlious position on 4 no offort wes made to stop the said train or to"slo7 107 -¢tee madly on voll knowing that the said deceased was life or sustaining great podily harm. 4th. E.
