He shall also return to the clerk, on oath within three months after each sale made by him, a full and itemized account thereof, which shall be signed by him and recorded by the clerk. Revisal of 1905, section 42. Every executor, administrator and collector shall, within twelve months from the date of his qualification or appointment, and annually so long as any of the estate remains in his control, file in the office of the Clerk of the Superior Court, an inventory and account, under oath, of the amount of property received by him, or invested by him, and the manner and nature of such investment, and his receipts and disburse- ments for the past year in the form of debit and credit. He must produce vouchers for all payments. The clerk may examine, on oath, such ac- counting party, or any other person, concerning the receipts, disbursements, or any other matters relating to the estate; and having carefully revised and audited such account, if he approve the sarne, he must endorse his approval thereon, which shall be deemed prima facie evidence of correctness. Baker, deceased. There is no question about the hushand havin: the right to administer upon the estate of his wife, unless he is under some disability. The Code, Sec. 1576. The disquali*ications are enumerated in section 1377 of The Code; and the Clerk has no discretion except what is civen in the statute. This is decided in H»ghes vs. Pipkin, 61 N. C., at bottom of page 5. The person having the prior right to administer, has also the right to nominate some other person for appointment; and if that person is suitable in character, habits and intellect, to demand his appointment, and the clerk, likewise, has no discretion to refuse to appoint such nominee. This was first decided in the 2N. C., at page 22 0, and has been approved in the following cases:- Little vs. Berry, 94 N. C., 4357; Williams vs Neville, 108 N. C., at top of pae 561; In re Meyers, 113 N. C., at page 548. It is contended by the petitioner that although the respondent had the right to administer, and that prior to all other persons, and that he should have been appointed (unless disqualified), and that having this right to administer, he could, by renunciation have declined to exercise it and nominate some other person for appointment, still, since the Court had adjudged him disquali*ied to exercise this rigit to administer himself - not that he does not have the right - but that he is incompetent to exercise it - he cannot now nominate and demand the appointment of his nominee. This cannot be the law. The statute gives him this prior right to administer with the power exercise it, unless adjudged incompetent upon proof by the Clerk. Code 1377; and the Court cannot take away the right itself, but can upon proof adjudge that the person having such right is incompetent exeré€ise it. In this case of Willis vs Willis, the widow had the right to ad- minister, and was appointed; but when it was found that she was a minor and therefore disquali*ied - as it is found by the Court in this case —_—— that the respondent is disqualified by reason of drunkeness - the letters were revoted; but the Court said, that she nevertheless had the power, after the judgment revoking the letters and adjudging her —— £ incompetent to exercise her risht to administer by reason of infancy, —_ to nominate some other person, even while she was under this disability of infancy and that the Court should have appointed such nominee. —_— Can it be said that an infant can emercise this -ight, and that one s the right to administer - ¢iven by law - is sti'l in the res- pondent, althouw h he is adjudged incompetent to exercise it, he never- theless has the power to nominate some one for appointment; and to demand his appointment; and the Clerk will be in error if he refuses to appoint such nominee. The attention of the Clerk is respectfu ly called to *he case of Willis vs Willis, supra, which decides the point as to the power to appoint even after an adjudication o° disquali*ication to administer. The cOMmmissioners shall make and sign three lists of articles assigned, stating the value of each, the number of the family, and deficiency to be paid by the personal representative. One of these lists shall be delivered to the widow, one to the personal repre- sentative, and one returned by the Justice, within twenty days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the deceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt.
