Il That her appointment as Administratrix was made for the pur- pose of instituting an action in the Superior Court of Iredell County, North Carolina, azainst the Seneral Accident Life and Fire Assurance Corporation, LTD., to collect a 4500.00 accident policy issued on the life of Alonzo Bailey. Ae That the defendant company after admitting liability, refused to pay the same unto the Administratrix until it had been judicially determined that the heneficiary under the said policy, the alleged wife of the said Alonzo Bailey, is dead. IV That the Administratrix has alleged and brought her action under the seven year statute of presumption of death, and the defendant company has answered denying the presumption. V At the November, 1955 term of Superior Court of Iredell County North Carolina, this action brouvht by your Administratrix was called and non-suited over the protest of your Administratrix, for failure to prosecute the action to a corclusion. Your Administratrix has been un- able, over the years, by diligent effort to locate any witnesses to support her action, and therefore, this estate has remained with no assets with which to pay the debts of the estate, including the funeral expenses and costs of the administration, all of which remains unpaid. VI The undersigned, for the reasons set out above, herewith files with the Court this her final accounting as follows: RECZIPTS FOR AMOUNT none none none There being no property of any kind in this estate, the following is submitted: NAM?
