Auten, of the County of Iredell, State of North Carolina, being of sound mind, but considerin: the uncertainty of life, Go make, publish ana ceclare this to be my Last Will ana Testament, that is to say: ITEM ONE: I direct that my body shall have decent Christian burial, gultable to the wishes of my wife and children, and that 4ll funeral expenses, together with all just debts owine by me shall be paid by my Exscutrix hereinafter named out of the first moneys coming into her handg belonzing to my estate, ITEM TWO: I give, devise and bequeath unto my wife, Mary J. Auten, all of my property, both real and personal, of every kind and description whatsoever and where soever situate, to be hers during the term of her natural life, with the right to her to gell and dispose of eny pert of it during her natural life if it shoule become necessary to do so for her proper support, ITEM THREE: I give, devise and bequeath all of the residue and remainder o my real and personal property of whatsoever kind and wheresocever located remaining at the death of my wife, Mary J. Auten, and not used by her for her own proper support as hereinbefore provided, to my children: Mrs. Bessie Henderson; Mre, “ergaret Howard; Mrs. Agnes Neel; Yrs, Emma Morris; and Lester R,. Auten, to be divided equally amon; them, and in case any of my said children shoulda die before taking under this Will and leave issue, then I direct that the issue of such child or ehildren shall take the part that its, or their, parent would have taken had such parent been living, and if any such child or children of mine should die before taking under this Will and leave no issue, then the share of such child or ehildren herein provided for shall revert to the corpus of my estate ard be divicea equally amone all of my children who are living, and the issue of such chilé or children as may be dead, such issue representing the parent, ITEM FOUR: I nominate, constitute and eppeint my wife, Mary J. They deny that they are tenants in conmon,with the Plaintiff Thomas I Ayers in the land des ribed in the complaint, but allege tha t he said Thomas [ Avers , as the hushand of Josephine ayers deceased who was the mother of these defendants, and the minor defendants, has a life estate in the land described in the petition and is in the full enjoyment of the same receiving the r ents and profits of the sane during his life, to which these defendants asse nta. 2. That they admit that the said Thomas I. Ayers is entitled to and is in possession of a life estate in said land, as tenant by the oe courtesy, tna said land, belonging to his wife, now deceased.
