Land & Sowers, Attorneys, for the plaintiffs in the above entitled matter, espectfully showeth to the Vourt:- 1. That this is an action filed in this vourt, entitled as above, w ich action is for the purpose of securing authority to sell certain iand in Iredell County, North VUarolina, lich tract of land is described in the petition, ssid petition being dated on the 20th day of September,1936. 2. that the undersigned is informed and believes that the defendants, Cuther Austin and Mildred Austin, are minors, without general or testamentary guardian as alleged in the petition in this cause. 3. That on the ZOth day of Sertember, 936, a summons in this cause, together witn a copy of the complaint was served upon the defendants and also upon the other defendants, and at the same time they were notified to have a guardian or guardian ad litem appointed within ten days from the date of the servise of said summons, otherwise the undersigned would apply to the Vourt for an order appointins sor suitable and competent person to act as Guardian Ad Litem for the defendants, and that he would be authorized and directed to appear and defend or take any action necessary on behalf of said minors whom he represented. 4. Morton as the Assignee in dower of Lucinda Austin widow, lately filed his petition in thig Court against P. M. The only property that the Administrator took charge of was real estate consisting of a house and lot, and storebuilding md lot, valued at $2000.00. The only debts owing by this estate were as follows: Funeral expenses, $115.10, medical bill - Rhyne-Little Clinic (30.00, and a monument erected to the grave, {55.00, making a total of ¢185.10. DISBURSEMENTS As shown above there was no money coming tnto the hands of the Administrator belonging to the estate but the Administrator paid the above accounts of 7183.10 out of money received from the proceeds of an insurance policy which was payable to T. B. Austin, individually, as beneficiary. The reel estate has not been sold but all debts have been raid and the heirs at law have agreed to hold the real estate and work out a private sale of the same.
