Arthurs, defendant, The defendant answering the Complaint in this cause says; First--- That she admits the allegation cotained in the first paragraph of the Complaint, and avers that her interest in the land is her dower right, set apart to her and cmtaining 85 acres, the copy of the al'otment of her said dower being hereto attached and asked to be made a part hereof, Second---The defandant admits that the gentlemen named in the complaint are her tenants and reside upon the land, but ex- pressly denies that they are cutting hickory timber and haul- ing the same from the premises for the purpose of doing injury to the free hold; but alleges the truth to be, that she is quite old and feeble, now about 70 years of age and unable to work herself. That under her directions, for the purpose of obtaining sufficient means from the land, she employed the tenants to clear up about four acres of the land for agri- cultural purposes alone; that prior to this time the defen- dant has not been able to obtain from the said land sufficient amount to sustain her in the necessaries of life, and has been compelled to call upon her friends to assist her; that to enable her to get sufficient support therefrom it is and will be necessary to clear up the amount of land now being cut, not for the purpose of selling the timber, but for agri cultugzal purposes alone €i n y 4 t y rn Vv ad Third--- Defendant admits that a notice was sent to her in regard to the cutting the timber, but she avers that in her d're extremeties ig Sustenance she was canpelled to clear + £ VW Ow ha about four aeres of the land as aforesaid. That it is not and has not been her intention to damage the estate of the plain- tiff in any respect, but simply to exist, without being a bur- den to her freinds the remainder of her Life, Defendant denies that she has cut or had cut valuable timber or committed any waste that she is not entitled to under the law. Fourth--- Defendant admits the allegat ons in the fourth par- a@graph of the Complaint Fifth--- Defendant denies that the plaintiff has suffered the damage complained of; that he knew when he purchased the land that the dower was thereon and that the defendant would be entitled to a reasonable living at least from the same; that she denies the loss to be irreperable and says that her life and existence is still dear to her and of necessity must pre- serve the same; that after clearing the land as alleged, this defendant will then have only the small amount of 25 c acres from which to get her Support; that this 25 acres will not bring her mor: than $30 or $35. per year, as part of the 25 acres cleared is unfit for cultivation.
