Mrs. Angell has elected to waive the setting up of this trust for her use and benefit in order that these funds may be added to all of the other property passing under the second trust for her use and benefit so that one trust will be administered, which is the survival trust under Item V, and she joins in this report by signing the same as an indication of her waiver of her rights in the $1,183.50 and accepts the entire handling of the estate and the establishment of the trust reported herein. In order to establish the trust under Item V of the Will the Executor is now transferring to the trust, and is acknowleding the receipt of the same as Trustee, all of the following properties: 1. Corp. 200 Shares Independent Life & Accident Insurance Company 74 Shares Brookgreen, Inc. 15 shares Home Savings & Loan Association. 10.125 Shares Integon Corp. 11, 2000 Shares Northwestern Financial Corporation $ 1,500.27 All of the above properties will be administered by the Trustee under the conditions of the trust from and after the date of this report and the Trustee will continue to report to the Court as provided by law. The Executor calls to the attention of the Court that originally there were 59 shares of Catawba Valley Developers Corb. stock listed as assets. In the course of the administration of the estate it was determined that the estate was in possession of 30 shares of stock that did not belong to the estate and belonged to the corporation and this was returned to the corporation, As Executor The Northwestern Bank came into the possession of one share of stock in Iredell Realty Investment Corp. in the name of Mary Angell, 23 shares of Brookgreen, Inc. in the name of Mary Angell, 23 shares of Brook- green, Inc. in the name of Monrovie J. Angell, III, and one share of stock in Iredell Realty Investment Corp. in the name of Monrovie J. Angell, III; these stocks have been delivered in kind to the listed owners and the estate makes no claim and has no interest in this property. Particular attention is directed to this Court that while Mr.. Angell was living he, together with other stockholders of Catawba Valley Dev. Corp. andCatawba Developers Corp. signed a letter of guarantee underwriting and guaranteeing the repayment of $325,000.00 represented by notes of the two corporations; that the debt has now been reduced to $164,000.00 and it is not likely that the guarantors will ever be called upon for payment by reason of their guarantee. Jack Causey for im- , Inc. and that this indebtedness has been reduced to $16,589.30; that the corporation has ample equity in real estate and there is little likelihood that the endorsers will be called upon to pay anything on account of these endorsements. During the life of Mr. Angell he became the owner of a note and deed of trust Of William S. Sharpe, which was endorsed and guaranteed by him to the Northwestern Bank in the amount of $2,517.32 and this note appears to be amply secured and the estate is not likely to be called upon to pay any- thing by reason of this endorsement. Further attention is called to the Court that Joe Walker Brown pur- chased property in which the testator was interested and he secured a part of this original loan to the Home Savings & Loan Association by the deposit of 15 shares of stock listed in this report, and this stock will be held and sub- ject to loss until the loan is reduced by the purchaser. The Executor, in order to file this settlement, is recognizing its contingent liabilities as to the items set forth above, but is making this settlement with the approval of this Court and with the distinct understanding that if liability arises the trust will have to be reopened and the endorsements of Mr. Angell protected in the items listed in this report. Having completed all of the duties imposed in the Executor, and having filed all of the tax returns and paid all of the obligations of the estate this report is asked to be accepted by the Court under the conditions outlined herein and that the Executor be discharged. A copy of the will is attached to the return, {[ believe that I have put the fair market value of the property on both the real es and personal, 2nd I h*ve shown the accounts which were owing to the store which were collected. there were about $2,600.00 in open accounts for groceries, 1 believe it or not, the widow collected about $2,000.00 of them. I think it was remarkable. Tne 1952 Plymouth delivery truck end grocery store fixtures were sold for 810,00, and they are shown in this return for that amount. There, of course, was merchandise and stock in the grocery store at the time of the death of Mr. Archer. Mrs. Archer operated the store for some two or three months after his death before she sold out. e, of course, did not have an inventory made at the time of his death, but we used the inventory shown on the income tax return as of the close of business on December 31, 1963. Notice to Creditors was duly published in the Statesville Record once a week for four consecutive weeks, commencing with the issue of June bi 1964, and the Notice to Creditors required all claims should be filed with the Executrix duly itemized, and verified, on, or before, December 10, 1964, and that this time has now elapsed. ‘a pe l y “J o y o r y 96 1 An Inheritance Tax Return was filed with the North Carolina Department of Revenue, and the same has been duly accepted and approved, and the Inheritance Tax has been paid in full, 3. The decedent, Fred R. Archer was engaged in the operation of a grocery store at 1009 West End Avenue, Statesville, North Carolina, under the name of Archer's Food Store, at the time of his death. At the time of the death of Fred R. Archer, the accounts to the grocery store amounted to $3,309.42. The Executrix compromised some of the accounts, and deducted from the amount owing, a total of $435.07. That the Executrix collected on the accounts $2,283.84, and this left owing and unpaid, accounts due to the store in the sum of $590.51. These unpaid accounts in the sum of $590.51 are not collectable at this time, and the Executrix has completely marked them off. S 2+ The Executrix operated the store for about three months after the death of Fred R. Archer, and all of the accounts due and owing by the store, and expenses and costs of operating the store, and all debts and claims of any and every kind against the Estate of Fred R. Archer which were filed with the Executrix, or of which she had any knowledge, have been paid in full. 6. Fred R. Archer had life insurance payable to his wife, Helen G. Archer, as follows: (1) Southland Insurance Company -— $1,840.00 (2) Occidental Insurance Company -$5,000.00 (3) Durham Life Insurance Company-$1,000.00 7. In addition to the property show in this report, Fred R. Archer owned a 1959 4-Door Buick, and this Buick automobile was devised to his wife, Helen G. Archer, under his Will. 8. The household and kitchen furniture all belong to the widow, Helen G. Archer. 9. Under the Will of Fred R. Archer, all of his property, both real and personal, was devised in fee simple, and absolutely, to his wife, Helen G. Archer. 10. Fred R. Archer and his wife, Helen G. Archer, owned as an estate by the entirety, the following real estate: (1) Their dwelling house at No. 917 West End Avenue. In the Inheritance Tax Return, a total value of $14,000.00 was placed on this dwelling "Y po l y “w a y o r y 96 1 house, with one-half of the same for Inheritance Tax purposes being $7,000.00. (2) The store building at No. 1009 West End Avenue, Statesville, North Carolina. The stor¢ building was place in the Inheritance Tax Return at a total valuation of $6,000.00, and for Inheritance Tax purposes, one-half of the valuation was taken, which was $3,000.00, The County tax value on the dwelling house was $6,605.00. The County tax valuation on the store building was $3,945.00. ll. The Executrix made an advancement of $67.02 in order to close this estate, but she, of course, makes no claim for a refund of this, in any way. 12. The Executrix does not charge any commissions in the handling and settlement of this estate. 13. That the Estate of Fred R. Archer has been fully and completely administered, and Final Settlement can now be filed and made in the estate. WHEREFORE, having fully and completely administered the Estate of Fred R. Archer, the undersigned Executrix prays that this report be accepted as the Final Settlement in said estate, and that the same be examined, audited and approved, and that it be ordered recorded, and that the Executrix be discharged as by law provided.
