P, Little, et al, This cause coming on to be heard at this term of the Superior Court of Iredell County, before his Honor, B, F, Long, Judge Presiding, and it appearing to the Court that this is an action upon @ sealed instrument for the payment of money, and that the complaint has been duly verified; and the defendant having failed to appear and answer; and it fur- ther appearing that the defendant is indebted to the plaintif? in the sum of $718.45, with 6% interest thereon from the lst day of September, 1907; and it further appearing to the Court that the said sum is secured by the real estate mentioned and described in the complaint, which is subject to a first mort- gage to J, B, Armfield, Executor of John Anderson, for a debt fully defined in the complaint, and that the said J. B. Arn- field is a party to this action; that his debt is past due, and that he is willing to accept his money: aS is; therefore, ordered and adjudged by the Court that the plaintiff recover of the defendant the sum of $718, 45, together with 6% interest thereon from the said first day of September, 1907, together with the costs of this action, It is further ordered and adjudged that if the said defendant fail to pay the said judgment, principal, interest and costs, within 20 days from the adjournment of Court, said lands shall be sold at public auction to the highest bidder fir cash at the court house door in Statesville, after thirty days advertisement, in some newspaper published in said County.
