Allison, Jr., husband of the decedent, for the purpose of acquiring stocks, as gifts to his children, and as personal withdrawals, the sum of $8,231.45; that as Surviving husband, he is entitled to a distributive share of one-third (1/3) of said estate but that he waives and renounces his claim to such one-third (1/3), and accepts in lieu thereof, the said sum of $8,231.45 in full of his distributive share. The commissioners shall make and sign three lists of articles assigned, stating the value of each, the number of the family, and deficiency to be paid by the personal representative. One of these lists shall be delivered to the widow, one to the per onal representative, and one returned by the Justice, within twenty days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the de- ceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt.
