Carl G,Smith,Clerk euperior Court,Iredell County,North Carolina: Comes now ~eb V.Long,Jr.,Cuardim of Carolyn Alley, Jean Alley, Frank Alley and Clyde Gay Alley,Minor Children of AC. Alley,deceased, late of Iredell County,ana showeth to the Court : 1. Theat or the 17th day of December,1938, said Zeb V.Lone,Jr. was duly evpointed Guardian for said minor children. 2. That said minor children reside,and have resided,with their mother,Mrs. Ted 0, ctevens,and thet saic minor children are under the care and protection of said Mrs. Ted O.otevens. 3. That on Jan.13,1928, the sum of Two Hundred Dollers($200.00) was paid to said Guardian by the Wachovia Bank & Trust Co. as a artial payment of the share of the Estate of A.S.Alley to which said minor children are entitled. That said funds have been distribu. ted periodically to the mother of said minor children by said Guardien,as will appea: in the report of said Guerdien,filed in the office of Clerk of Superior Court of Iredel) Coun ty. 4. That on August 24,1939, the further sum of Five Hundred Dollars($500.00) was paid to said Guardian by Wachovia Bank & Trust Co. as a further partial payment of the share of the Estate of Aeve Alley to which said minor children are entitled. That a portion of of said funds has beer distributed to the mother of said minor children by said Guardian, as will amecr in the renort of said Guardien,filed in the office of Clerk of superior Court of Iredell County. 5. That it aprears necessary to said Guardian that a regular monthly sum be “eid to the said mother of the minor children,in order to clothe and feed saia children,and that it is the opinion of said Guardian that the sum of Eighteen Dollers($18.00) ver month shoul’ be paid to said lirs. Ted O,Stevens,mother of said children, for the suprort and maintenance of said children. WHEREFORE, said Zeb V.Long,Jr.,Guardien, respectfully petitions the Court that he be ordered to psy monthly to the mother of saia minor children of A.C.Alley the sum of Eighteen Dollars($18.00) from the funds at said Guardian's disposal for such period of time @s said funds shall last; and that at such time as said funds shell be supplemented said order be reconsidered by the Court in the light of the needs of said children and the funds then available, This l6th dey of November, 1929, id es Guardien \Vinor Children g? $C Alley North Carolina In the Superior Court Iredell County In Re Minor Children of A.C. Alley ORDER To GUARDIAN This cause being heard on the Petition of Zeb V.eLong,Jr., duly anvointed Guardian of the Minor Children of AeC.Alley, to wit,Carolyn Alley, Jean Alley, Frank Alley and Clyde Gay Alley,erd it ap euring to the Court from Saic Petition: 1. Theat said mincr children are,and have been, residing with their mother,Mrs. Ted 0, vtevens,and that said minor children are under the care and protection of said urs, Ted U.Stevens. Theat certain funds have been received by said Guardian from The Wachovia Bank & Trust Co. as distributive share of the said children in the Estate of Ae. Alley; that a part of said funds heve been distributed to said Mrs. Ted O..tevens,for use and benefit of said children,as will appear in Guardian's report; that said Guardian now has on hand a portion of the distribution made to him by said bank on August 24, 1939. Theat said Guardian is of the opinion that a regular monthly peyment to the mother of said minor children is advisable,and that the said beyment should be the sum of Eighteen Dollers($18,00) per month, to be used for the supvart and maintenance of said children, specifically for clothes, food,schcol books,ete. NOW, THEREFORE, it is hereby considered and ordered that said Guardian pay to Mrs, Ted O,otevens,mother of said minor children of A.C,Alley, the sum of Zighteen Dollars( $18.00) per month beginnine with the month of December, 1939, for such period of time as the funds now On hand shall lest,and that such monthly distribution be used for the suvport and maintenance of the minor children of A.C. That it is the duly qualified and acting Executor of the last ill and Testament of Avery S. Alley, deceased, late of Iredell vounty, North Carolina, having been appointed as such Executor on the 6th day of November, 1936, and immediately qualified. 2nd. ‘That your petitioner forthwith entered upon the dis- charge of its duties ami has, to the best of its ability, collected the debts and oblisations due to the estate and that there now remains on hand quite a list in number and amount of uncollected notes, chattels and open accounts which have been standing due and uncollected for more than twelve months since the appointment of the xxecutor and that after using every effort to collect said accounts, your petitioner has been unable to do so, and it is advisable and necessary that the same be advertised and sold as provided b law. 3rd. That a detailed list and schedule of ssid accounts is hereto attached, marked kxhibit A, and asked to be taken as a part of this paragraph of the petition as fully as if written herein. WHIRLFORE, the petitioner asks that the Court will make an order autnorizing it to sell said evidences of indebtedness, notes and open accounts and chattels at public auction, as provided by law, without any manner of recourse on it and without any guarantee as to the correctnes of the said accounts, many of which are disputed.
