Notice to Creditors is now being published, but the estate will have to stam open 12 months from the date of the fi publication thereof. IV sy reason of Notice t ii S not being published, the balance of 9312.80, shown above, is being held and retained until the 12 months period expires. All debts which have been filed with the Administratrix, or of which the Administratrix or any of the heirs had any knowledge, have been paid. An inheritance tax return has been filed with the North Carolina Depart- ment of Revenue, and the inheritance tax paid. Vil All of the personal property except a shotgun has been sold, and this shotgun will be disposed of or handled Satisfactorily with the heirs before final Settlement is filed. VIII The estate owned a one-half interest in a John Deere Tractor, and the other one-half interest therein was owned by Fred B. Allen. The heirs estimated that the tractor was worth about $500.00, and therefore, the interest of the estate in said tractor was abat $250.00. By agreement with all of the heirs, the one-half interest of the estate in the John Deere ‘Tractor was transferred and conveyed to Fred B. Allen, and he is not required to make settlement with the estate for the one-half interest of the estate therein. rm Charlie Turner owed a balance on his lumber account of $174.00. He was not able to pay this, and a note executed by Charlie Turner and his wife, dated May AG, 1954, payable to the estate of Furches B. Allen, and due 12 months after date, has, with the agreement of all the heirs, been accepted, and collection on his note will be made if possible before final Settlement is filed. Xx The heirs of Furches B. Allen purchased the dower interest of his widow, Rebecca B. Allen, in all of his real estate, and this deed is recorded in Deed Book 236, page 247, Iredell County Registry. XI Rebecca B. Allen, widow of Furches B. Allen, for value paid to her by the heirs, transferred and conveyed all of her interest in the personal property, including her year's allowance, to the heirs of furches B, Allen, and this instru- ment, dated November 12, 1952, is hereto attached, marked "Exhibit A"; that by reason of this instrument and Oy reason of the dower deed, the widow of rurches B, Allen is not entitled to any further share or interest in the personal property or in the land. XII Rebecca B. Allen, widow of rurches B. Allen, executed a receipt and re- lease which is dated November 12, 1952, and is herete attached, marked "Zxhibit 5." ALTi by a deed dated April 30, 1954, Fred B. Allen, Lillie Mae Wallace and Leota Padgett have conveyed their three-fourths undivided interest in about 51 acres of land that Furches B. Allen omed at the time of his death, to Florence Allen Renegar; that by deed dated April 30, 1954, Lillie Mae Wallace, Leota Padgett and Florence Allen Renegar have conveyed their three-fourths undivided interest in 1] acres of land, and in a tract of land cataining 43 acres, that urches B. Allen owned at the time of his death, to Fred B. Allen; that the lands described in and conveyed by the aforesaid deeds are all of the lands that Furches 3. Allen owned at the time of his death. WHEREFORE, Mrs. Lillie Mae Wallace, Administratrix of the Estate of ‘urches B. The commissioners shall make and sign three lists of articles assigned, stating the value of each, the number of the family, and deficiency to be paid by the personal representative. One of these lists shall be delivered to the widow, one to the personal representative, and one returned by the Justice, within twenty days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the de- ceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt.
