In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the deceased and also 7 debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt. When there is no administration, or the widow is administratrix, the widow may apply to the Justice.—Revisal, secs. 3092, 3093, 3098. -B 3 IN TH E MA T T E R OF De c e a s e d . Smith Clerk of Superior Court Iredell County Courthouse Statesville, North Carolina Re: C. B. Winberry, Successor Trustee in the Estate of Maggie Lou Adams Dear Mr. Smith: I received your notice, or card, a few days ago, in regard to an Account being filed in the above matter. All of the funds have been disbursed to the beneficary, Miss Mattie N. Adams, and I am now getting together the information to file the Final Settlement and close the estate. There are no funds in the estate to pay my fee and the cost. I have never drawn any fee whatsoever in the matter, and I am trying to contact the Attorneys-in-Fact for Mrs. Mattie N. Adams, as I know that they have some money on their account, to see if I cannot arrange for the payment of some fee to me, and the Court cost in connection with the matter. I have been doing all that I could, and it is only in the last week that I have been able to get back to work full, and I find that now I tire out very easily, and have to take it somewhat easier than I did. Within the past week, I have filed with you the Final Settlements in the following estates: 1. W. A. Templeton Estate 2. Miss Carolyn Sue Privette Estate I am now preparing the Final Settlement in the following estates, and have them ready to file within the next ten days, as follows: 1. Elam C. Lackey Estate 2. Mrs. Ada C. Keiger Estate 3. John B,. Reece Estate Because of being sick, I have been unable to get the Inheritance Tax Returns prepared in the following estates: 1. Mrs. Stella Cashion Estate 2. Charles L. Gaither Estate Mr. C. G. Smith -2- June 17, 1966 It is necessary that Inheritance Tax Returns to the North Carolina Department of Revenue, in both of the above estates, and a Federal Estate Tax Return to the Internal Revenue Service, be prepared and filed by June 30, 1966. This week I completed all of the papers in the sale of the right of way and easements in the Estate of Robert Weber, Incompetent, to Duke Power Company, and you signed an Order, and I am waiting for Mr. Avery to obtain the check from Charlotte so that we can close out the matter. I hope that this will be satisfactory to you and Mr. Weber. In view of the additional work that I have to do in the Maggie Lou Adams matter, and that I am trying to contact the Attorneys-in-Fact, and one of them lives out of the State, and the fact that we are working on these other Final Settlements, and the people are insisting that they be filed at once, I hope that you will grant me an extension of thirty days from the date of this letter, to get the Final Settlement ready in the Maggie Lou Adams matter. Your kindness in this respect will be greatly appreciated, and I assure you that I will live up to what I said about it. I have been doing all that I could to file Final Settlements and clear matters up in your office, and I believe that if you will go back and check the records, you will see that before I got sick that I had been filing Final Settlements, and getting a good many estates cleared up, and have cleared two within the last week, and am expecting to clear at least three more within the next ten days. > a f 3 r <= a G9 %. a ~ ° = I therefore trust that you will grant the thirty day extension requested , and Final Settlement can be filed in the Ma e Louw Adams matter, an e Trustee- ship closed.— ae 9r 6 1 Thanking you for your favorable consideration, and with highest personal regards, I am Sincerely yours, CBW:hdd P. The Greensboro Attorneys estimate that it will take two and one-half to three days to try it. There is certainly nothing that I can do about this trial, as it has already been set on the calendar, and I will get back to Statesville as early as possible. I am dictating the Final Settlement in the Elam C. Lackey Estate Mr. C. G. Smith -3- June 17, 1966 so that my secretary can type that while I am away. I am also working on Mrs. Ada C. Iredell County Courthouse Statesville, North Carolina Re: C. B. Winberry, Successor Trustee in the Estate of Maggie Lou Adams Dear Mr. Smith: On June 17, 1966, I wrote you in regard to the above matter. I had expected to have all of the necessary arrangements made by this time so that, the Final Settlement could be filed by the Trustee. However, one of the attorndbs/tibes out of North Carolina, that is, one of the Attorneys in fact in the Estate of Miss Mattie N, Adams, whose estate has to put up some money in order to settle the Maggie Lou Adams Matter, and this attorney in fact has not yet come to Statesville. I have been expecting him, but it may be two or three weeks before he comes. Disbursement of all proceeds in my hands as Trustee was made several years ago, and this matter was gone over with Miss Mattie N. Adams at that time, and also with her nephew who lives out of North Carolina, Mr. Keiger has a company who is surety on a bond, and I am trying to work out an adjustment on the bond also. I would appreciate it if you will hold this matter in abeyance until I can get all of these parties together. I have never received any fee out of this matter whatsoever, and there is nothing in the Trustee Account to pay me with, and I am trying to work that out also with the two persons who are attorneys in fact for Miss Mattie N. Adams, who is confined to the Presbyterian Home in High Point, N. C, I certainly will appreciate your consideration in this matter, and since no one is pushing for a Final Settlement to be filed, except Mr. Keiger, and he wants his bond premium money, and I certainly cannot pay that until the attorneys in fact advance me somg@money. I have told Mr. Keiger all of this, and I am sure that he will understand. He has been out of town for nearly three weeks now on a flying trip with Mrs. Keiger to France, Spain, the Holy Land and Léndon. Keiger is the representative of the bonding company, and I have talked to him several times. Through an error, the funds were disbursed to the ben- eficiary, and there are no funds in the Trust to pay the bonding premium, but I told Mr. Keiger that I, personally, would take care of it. Mr. Keiger owes me several times what the amount of the bonding premium is, and last week when he called me, I told him that I was preparing a statement for him, and that when that was ready, and my final report was ready, we would make a settlement. Apparently, he was not satisfied with that, and went to you. I have been working night and day, and doing everything possible to get all the matters that I have, in good standing, and I think you are aware of the fact that within the past two months, I have filed several Final Settlements, and have done other things through your office. I am surprised that Mr. Keiger would keep on hounding me like this. I trust that you will give me sufficient time to complete all of these matters, as I have several matters that I am working on now that must be attended to within the next week, and I certainly will not be able to get to this matter until after that. I hope Mr. Keiger will be kind enough not to push the matter, and try to em- barrass me further in this respect. I am trying to be fair and square, and I told him that I would take care of it personally, and this I intend to do. Mr. C. G. You were appointed as Substitute Trustee in this matter June 19, 1951 which has been seventeen years and you have not filed an account of any nature. I have in my file a letter dated June 17, 1966 in which you request an additional 30 days to file your report and giving as your reason that you had other pressing matters to attend to. Smith Clerk of Superior Court of Iredell County Iredell County Court House Statesville, North Carolina 28677 Re: C. B. Winberry, Trustee under the Will of Miss Maggie Lou Adams Dear Mr. Smith: I acknowledge receipt of your letter of June 26, 1968, in the above matter. I am very sorry that you construed my letter of June 25th, in a manner that you felt that I was critical with Keiger Insurance Company. This was not my purpose or intention at all, and I realize full well, that they had a right to ask for an accounting in this matter. Mr. C. E. Keiger has been one of my best friends through- out the years. I have served on the Board of Deacons with him, and for more than 15 years, I have prepared instruments, wills, and other documents for him, and I always stopped what I was doing in order to get his done, because he usually wanted it done immedi- ately. I still regard Mr. Keiger very highly, and I know that he is one of the outstanding citizens of this community. I knew his farmer wife well, and she was a fine lady, and the present Mrs. Keiger is one of the finest women that I have met anywhere. I enjoy talking to her, and going to their home on visits. It was about a week or ten days before I received your first letter, dated June 24, 1968, that Mr. Keiger called me on the telephone, and when I mentioned to him that I was preparing my statement, and that we would credit the bond premium amy statement, he hung up and did not discuss the matter any further with me. I am sure that he meant no offense by it, and I do not take any offense, because I regard him as a friend and a gentle- man; however, the next thing that I knew, or heard about this matter, was your letter. I am going to do my best to have this final accounting ready to file by July 10, 1968, but I have so many things to do and I am so far behind, that it could be possible that I will not Mr. C. G. Smith Page 2 July 1, 1968 Tax finish. I have several Inheritance/Returns that must be made, and some other reports that must be filed with you. In the mean- time, I am going to have to spend one or possibly two days, in Yadkin County, this week, on a matter that a Company in St. Louis is demanding that I go immediately and look after it. I also have a matter with Ray Jennings in Alexander County that's going to take one day and maybe two days. I also have a matter in Rowan County that is going to take more than two days, to get ready, and I am going to have to put some time on these matters. However, I am going to continue working at night, and I will do all possible to have this report ready, and to have Mr. Keiger's statement ready, so that the bond premium can be taken care of at that time; however, I hope that if I am a few days late, that you and Mr. Keiger will consider giving me a few days more time. I hope that it will not be necessary for me to ask for it, and I assure you that I will not ask for it unless it is an imperative necessity. FURTHER INFORMATION: The house and lot at #358 North Center Street, Statesville, North Carolina, was owned as follows: 1. Miss Maggie Lou Adams a 1/2 undivided interest, and Miss Mattie N. Adams, a 1/2 undivided interest. During the period of this Trust, and up until she was taken to the home at High Point, North Carolina, Miss Mattie N. Adams occupied the premises above described, and she paid no rent. A Court Order was obtained upon a Petition filed by C. B. Winberry, Successor Trustee, in 1951, authorizing payment of street assessments, taxes, and other items, and authorizing that C. B. Winberry, Successor Trustee, pay to Miss Mattie N. Adams, from the funds in his hands, the sum of $25.00 per month. This Trust was active from June, 1951, through 1959, under C. B. Winberry, Successor Trustee; that it was necessary to file a Petition for the appointment of C. B. Winberry, Successor Trustee, and to pre- pare a Petition and Order for the payment of street assessments, and the monthly amount to Miss Mattie N. Adams, and for the payment of certain other items; that no Attorney fee has been charged by C. B. Winberry, or his Law Firm; that Commissions of $316.84, charged by C. B. Winberry, and which are unpaid, are not unreasonable, and in fact, they are inadequate for the services rendered, and the time an > = 3 2 = 2 go B. oO é ° oc 96 1 expended in this matter. That C. B. Winberry has received no compensation whatever in connection with this Trust. That the overpayment to Miss Mattie N. Adams was caused by an error, and he did not have information of the overpayment until it had already occurred, and the $213.85 paid. That the 1/2 undivided interest of Miss Maggie Lou Adams, in the house and lot at #358, North Center Street, Statesville, North Carolina, passed to her heirs at law, and these heirs were thirteen (13) in mnber, after the death of Miss Mattie N. Adams, and they were scattered from Iredell County, to Georgia, New Jersey, Virginia, Texas, South America, and other places. That in 1960, at the request of Miss Mattie N. Adams, C. B. Winberry, prepared three Deeds, and sent to the respective heirs to be signed, and without consideration, all of the heirs signed the Deeds, and con- veyed their 1/2 undivided interest in the property hereinabove referred to, to Miss Mattie N. Adams, so that she became the owner, in fee simple, of the entire interest in the house and lot at #358 North Center Street, Statesville, North Carolina. The Deeds above referred to, are found of record, as follows: 1. James H. Adams, and others, to Miss Mattie N. Adams, recorded in Deed Book 342, page 3, Iredell County Registry. Deed from Rex Adams and others, to Miss Mattie N. Adams, recorded in Deed Book 342, page 8, Iredell County Registry. Deed from John Wood Adams and others, to Miss Mattie N. Adams, re- corded in Deed Book 398, page 551, Iredell County Registry. Deed from C. B. Winberry, Successor, or Substituted Trustee, recorded in Deed Book 398, page 555, Iredell County Registry. . C. B. Winberry has received no compensation whatever for preparing and getting these Deeds signed. The Deeds were all long, and he had con- siderable correspondence and postage in getting it done. . C. B. Winberry also advanced $14.25, to probate and record these Deeds, and he has not been reimbursed for this. p- = 3 r = & go %. o e ° = 96 1 That the Trust under the Will of Miss Maggie Lou Adams, has now been fully administered, and all assets completely disbursed, and disposed of.
