He shall also return to the clerk, on oath within three months after each sale made by him, a full and itemized account thereof, which shall be signed by him and recorded by the clerk. Revisal of 1905, section 42. Every executor, administrator and collector shall, within twelve months from the date of his qualification or appointment, and annually so long as any of the estate remains in his control, file in the office of the Clerk of the Superior Court, an inventory and account, under oath, of the amount of property received by him, or invested by him, and the manner and nature of such investment, and his receipts and disburse- ments for the past year in the form of debit and credit. He must produce vouchers for all payments. One of these lists shall be delivered to the widow, one to the personal representative, and one returned by the Jus- tice, within twenty days after the assignment, to the Clerk of the Superior Court of the covnty, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into hig hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the deceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt. Chamblee, Administrator of the estate of Lucille M. Abernathy, and respectfully shows to the Court: 1. That Ralvh A. Abernathy died testate on November 26, 1961, leaving a last Will and Testament, naming as his sole beneficiary and Executrix, his wife, Lucille M. Abernathy. 2. Thet Lucille M. Abernathy oualified as Executrix of the estate of Ralph A. Abernathy and during her lifetime she caused to be run a creditor's notice in the Statesville Record and Landmark and from the procee that she received from an insurance policy, she caused to be paid during her lifetime the funeral expenses, but on account of her untimely death within one year of her husband's, she had mot filed a final settlement and a tax return f the said estate. 3e That your Administrator is informed and believes that the only assets of Ralph A. Abernathy were his one-half interest by entirety in a house and lot located on Davie Avenue, in the City of Statesville, having an approximate total value of $14,000.00; that he is informed and believes that Ralph A. Abernathy had a policy in the principal amount of $1,000.00 with the Aetna Life Insurance Company, which was collected by Mrs. Abernathy prior to her death and that the household and kitchen furniture was mostly owned by Ralph A. Abernathy and that all of said property was received by his wife under the terms of his will. That at the time of the death of Ralph A. Abernathy, he owned in his own name an old two-passenger automobile which was transferred by his Executrix during her lifetime to herself under the terms of the will. 4. Your Administrator is further informed and believes that all funeral expenses and any small incidental debts of her husband's estate were paid by Mrs. Abernathy and there are no Estate or Inheritance Taxes due; that a proper return has been made to the Department of Hevenue. Dearman, Administrator of the Estate of Mrs. Beulah Bollinger Absher, respectfully shows the Court: ele That he has heretofore been duly appointed by this Court as Administrator of the Estate of Mrs. Beulah Bollinver Absher, and is now discharging his duties as such. olin That there is no personal property in this Estate from which to satisfy the just indebtedness; that the Administrator is informs and believes, and therefore, alleges, that there are no debts against the Estate, except the funeral expenses which were paid by the deceased Mother, Mrs. W. A. Bollinger; that there still remains due and unpaid to Mrs. Bollinger the sum of Two Hundred Dollers ($200.00), which represents the amount which she advanced to the Funeral Directors for the burial of the deceased. -3- That on the 2lst day of October, 1930, the father of Mrs. Absher died intestate, seized and in possession of certain lands situated in Iredell County; that on the 5th dey of August, 1931, Mrs. Beulah Bollinger Absher died intestate, and leaving surviving her her husband, S. E. Absher, and the following children: Paul T. Absher, Age 16 years, Dick R. Absher, Age 15 years, Edith M. Absher, Age 13 years, Charles Absher, Age 10 years, and Archie C. Absher, Age 9 years; that a Special Proceeding was not instituted by the heirs of the late W. A. Bollinger until in September, 1932; that on that date, a Special Petition to Allot Dower and for Partition among Heirs of W. A. Bollinger, Deceased, was instituted before the Clerk in the Superior Court of Iredell County, entitled, "Mrs. W. A. Bollinger, et al, Ex Parte.” wu That the Commissioners duly appointed by the Court allotted to the heirs of Mrs. Beulah Bollinger Absher, subject to the courtesy right of her husband, S. E. Absher, a certain tract of land, containing Fourteen and one-eighth (14-1/8th) acres, more or less, of the lands of which W. A. Bollinger died seized and in possession, together with the sum of Two Hundred Dollars (3200.00) to make the share equal; that the sum of Two Hundred Dollars ($200.00) has been paid to the Clerk of the Super- ior Court, and has not been distributed. aie The Administrator is of the opinion that an Order from this Court should be made, turning over to your Petitioner the sum of Two Hundred Dollars ($200.00) which was thus allotted to make the share which was allotted to Mrs. Beulah Bollinger Absher's heirs equal, in order that your Petitioner will have sufficient cash with which to pay off the indebted- ness of this Estate. ~6= It would be injurious and unwise to decrease the small tract of land now held by the heirs of Mrs. Beulah Bollinger Absher. WHEREFORE, the Administrator prays the Court that an Order be entered in this cause, directing the Clerk of Superior Court of Iredell County to turn over to the Petitioner the sum of Two Hundred Dollars ($200.00) from the funds which he now holds and which were paid in to his Office under and by virtue of the Report of the Commissioners in the Special Proceeding entitled, "Mrs. W. A. Bollinger, et al, Ex Parte”, for the purpose of paying the funeral expenses, which constitute the only indebtedness against the Estate of Mrs. Beulah Bollinger Absher, deceased, to the end that the Administrator can proceed with the settle- ment of this Estate.
