The letter of which we are enclosing copy of the letter and « review of is our opinion that the Owner's their contention that they were not notified or informed of what duties were expected of a bricklayer tender. his contention is set out in peragraphs four, five and thirteen of Mr. Marshall's letter. There is no question but thet the wage rate was known to be included in the Contract Documents. Eefer- te the Boller House contained in peregraph five and further reference te the duties of Mason fenders prior to November 18, 1958 as mentioned in paragraph nine was the chief topie of discussion at the meeting recently held here which was attended by Mr. Marshall, the Architect and Con- trector. We camot agree with the Owmer in‘his con- tention that the duties of Masons Tenders were not knom at the time the noncompliances oceurred. C, Dear Sir: I am protesting against conditions existing on the con- struction of the Memorial Hosrital, a PWA Project at Charlotte, - North Carolina, The McDevitt Company are the General Contractors. Leon Con-er is employed az a fireman furnishing temporary heat for the hospital which is under construction. Conner is on MeDevitt's payroll and receives fourteen dollars ($14) per week. _ He works nine (9) hours per day, seven (7) days per week, and on. Sundays he is required to act as watchman in addition to firing the boiler, It may also be advisable to look into the construction of the boiler room and the steam tunnel leading from the power plant to the hospital and nurses home. The concrete in the tunnel is very porous and the proper provisions for drainage has not been made. Recently, during heavy rains, water came in through the tunnel until-it reached a depth of sixteen inches in the bofler room, On Friday January 19, four days after a rain, water was standing between the boilers to a derth of one inch. There is no Grain in the boiler room. The drain, which is outside the boiler room, is approximately ‘wo inches higher than the opposite side of the botler room, Steam cylinder oi} hes not been furnished the fireman, and for two days prior to January 19 the pump received no oil. The pending grant requisition about which this letter was written represents only a total of 35% of the entire grant ani if it were paid the Federal Works Agency would still have $100,000.00 of the total grant from which any adjustment could be made, if it became necessary. The matter of th project apst involves a question as te whether ea $50,000.00 land purchase is eligible for grant, and even if the final ruling was thet it was not eligible, only 45% of this 950,000.00 would be the amount effected. Therefore, we d& not see why the present grant requisition is being held up. -. _Ewish to impress upon you the City's urgent need of this present requisition; the project is practically completed, a number of the contractors estimates will come due oh Februgry ist and we will not have enough money to pay them unless we obtain this $100,000.00, I em fearful thet if we camnot pay the Contrectors thet work on the project will be suspended. I sincerely hope that you can adjust this mtter for the present and check for this grent requisition can be forwarded us. Brown, who discussed the specifica-~ tions with the Chief of Squed at the time, and acted on the matter as stated in his deposition (Exhibit 21). It was realised that, in describing this highiy specialized equipment, it would be en eniless and futile tesk to get the specifications in such shape that they would satisfy all of the prospective bidders, and et the same time define and confine equipment of and to sich standards | as the Owner desixed and considered appropriate for this high-class hospital.
