On December 16, Mr. Edward Saupt, the Mayor¥Newter, personally called by this office, bringing with him the original Proposals of the three low bidders, each attached te the Specifications and preposed contract documents.uponm which the propesals were based. Im exaxining the Proposal ‘orm it was noticed that it had been rewritten since it was oricinally filed in this office. it provided for wumit price proposal on steel water pipe and also om cast iron w,ter pipe; the latter having the sinele word "alternate" abeve. ‘The tabulation sheets werg made up in a rather complicated mammer tut, besec om some instructions to bidders covered in an aAccendus issued tr the engineer, the three bids were able to be compered with each other on the same ape The Prorosals were in “ivisions namely 2) r Pipe Lines, (2) Seware Disposal ' Etaders rere asked to make separate te deductions, if any, if two or same bicder. There seemed to be no contention as te the bids on the sewer lines and the sewage treatment plant. As to the bids on the Water lines, the question arose as to whether the bids should be considered on the basis of steel pipe or the tesis of S58 iron pipe. The Specifications were written tten concerning beth types of pipe. The Proposal ‘orm, as stated before, provided for bids on each tupe separately, the only word distinguishing between the two was that the steel pipe was listed firstly on the Proposal Sheet and the Cast irom secondly with the word "alternate" above it. Nothing was found im the Specifications or Instructions te Bidders indicating that the Owner had any preference one above the other, making it inferable that the Ower could chose either one. ‘urthermore, nothing was found that designated either pipe as a Base Sid, or that indicated any deductive alternate. The three low bids as received, after considering all deductions offered for combinations awards, stood as follows: (1) Sewer Lines” : By Reed and Abee $ 32,307.45 (2) Sewage Treatment Plant ‘ By A. E. OGuion $ 59,906.00 (3) Water Lines (using cast iron Pipe) By Blythe Bros. 2.889. Total $195 ,103.40 The above total ficure was the lowest combination of amy bids, and included the use of cast iron pipe, which in this case was bid at a considerably lower figuer than the steel pipe. Mr. Haupt, the Mayor, made the statement in this dfice that the Owner preferred the use of cast iron pipe and understood amd believed that the Specifications would permit making this choice, if the bids were found to be within the available funds. As the case developed, and it was indicated th,t the steel pipe was bid at a higher price, there seemed to be all the more reason for the ome perferring the cast iron pipe. Some of those present at the letting, however, were under the impression that because the steel pipe was mentioned first, that it was an obligation of the OQwer to a steel pipe since the bid including that type of mterial was within t available funds. Therefore, before miking any actual awards, on Baupt brought the ee to this office for advice thereon. it was show sel pipe had been used that — bidder, mamely: Reed and d be low = on ‘all three sections Based on a combination bic : : amounting to $200,094.90. Although this bid was approximately $5,000.00 higher than the sum of individual bids listed above, there mas con- siderable pressure placed upon the 5oard by parties interested in selling steel pipe fo-ferce the Owner to accept the higher bid. In view of the circumstances and conditions above outlined, this office denied this obligation and saw fit to concur with the Omer in Making the eward on the basis of cast iron pipe and to the three separate parties mentioned, adjudicating the question in accordance with Admin- istrative O,dei 125 (Sun. 6) Pars 6, last sentence.
