Plaintiff closed. The def@m dant prayed the following Instructions: I-- If the Jury beleive that the paaintiff never demanded that the money he had expended for his ticket be refunded he canmet recover the value of his ticket in this action. IIl-- If the Jury beleive tha t Statesville was not one of the stop ping places of the tarin on which plainti ff embarked, then his ex- pulsion therefrom was not unlawful, amu unles tne Jusy beleives that the plaintiff received some injury, er some insult, or some Hier Htfer indignity was offered him, the measure of his damage is the value of his ticket and the value ef his time. IlI-- If the Jury beleive that the plaintiff was told hy the agent that he could use the ticket he had bought on the next train, but refused to attempt to use it and held it for the purpose of thie suit, he camnet recever the price ef his ticket in this @ tion. IvV-- If the Jury beleive the evidence, Statesville was net one of the stopping places ef the tain on which plaintiff embarked, and therefore, the expulsion ef plaintiff was net unlawful. This being so, the measure of damages cannot exceed the price of his ticket and the value of his time lost, unlessplaintiff was ac- tually injuredby his expulsion or some insult er indignity was off the car. To show the good faith of this witness and that he was actuated by no wanton or wilful or malicious spirit, defendant offered in evidence the following paper writ ing b to wit: SOUTHERN RAILWAY COMPANY. COLUMBIA, S. C., August 16, 1895, To ALL TICKET AGENTS: You understand you are not to sell tickets for use on Through Freight Trains except for such points as these trains are to stop,. Sig Beart charged the Jury as follows; “That the action w as brought by the plaintiff ger damages fer expelling the plaintiff while a passenger from the aefenuants train and four issues are submitted to the Jury. I---Upen the first issue the Jury mst determine f rem the evidence whether the defendant received the plaintiff as a pasenger on \ 4 its train as alleged. If you find theite wf frem the evidence and are satisfied that the plaintiff beught and paid fer a ticket frem ealisbury te statesville fer the particular train alleged in the complaint and that the plaintiff befere buying the ticket fer thié train was informed by the defenaants ticket ag ent and train dis- patcher at galisbury that said train weuld step at Statesville nee that the ticket then beught was geod fer the said train, and in censequence ef this infermation frem the defendants agents, the pl aintiff beught his ticket for said train and helding the same he teok his place in the cab en said train ef the defandant at the heur designated when said train was toe move frem salisbury te ctate ville the yury sheuld find the first issue Yes; otherwise ye. The Ceurt then recited the testimeny bearing on this issie. II--- Jf the Jury find the fact te be frem the evidence that defen dant by its agents made a centract te carry plaintiff frem Salisbuy te Statesville on the Sunday freight as alleged amd the plaintiff beught and paid defendant fer his ticket fer said train as alleged and the Jury further find the facts te be that the defendant de- clined and refused te earry plaintif f en said train agreeably Pe the centract and after he placed himself in the taain and offered hie tieke t then the ysury sheuld find the 2nd issue Yes; but if they are net se satisfied frem the evidence then they sheuld find the issue Ne. The Court here made a summary ef the evidence on this ’ dpaue on Beth sides and tela the Jury the burden ef preef was en 10 the plaintiff en all the issues. III-- The question presented by the third issue is; whether the act ef the defendant or ef its agentg, the conducter, was wregful- ly, wilfully and wantenly dene. Was it wilful? that is knowingly and intentionally done: was it wantenly?done?That is was it dene im reckless disregard ef plaintiffs rights. If the plaintiff had aticket putting the defendant cempany under centract te carry him en that train te Statesville, and Statesville was a regular step- ping place fer that train, and the cenducter knew that the piaintif had a ticket ef defendant fer statesville and that Statesville was a regular stepping place fer that train, ana the cenducter deliberately and intentienaly put the plaint ff effthe train, this weuld be a wilful and wanten act; and if the Jury find these te be the Weeks frem the evidence and are so satisfied, they sheuld answer the third issue Yes. And if Statesville was net a regular stepping place and the cen @ucter camp te plaintiff and in a reugh mamer, declining te exam ine his ticket ferced him in the dark-te get eff the train while the train was meving and he was se put eff the train by him away from any statien er residence, this weuld be a wanten and wilful act and the Jury finding these facts weuld answer the third issie YES. But if the Jury find the facts te be that Statesville was net a regular stepping place and the defemiants agent by mis- take seld the plaintiff a ticket te Stateseillle am the cenducter befere starting inmfermea the plaintiff that Statesville was net «a regular stepping place aud requested plaintiff te get eff the train in the manner described by the defendants witnesses, and the Plaintiff get eff the train while the train was still en the yard this act, while it may be a breach e€@ centract weuld be neither wilful ner wanten and if the Jury se find the facts te be, they will answer the third issue NO II The Court gave the Jury a@ sum ary eof the eviaence on bethe sides en this issue. IV-- The Court told the Jury in substance, that if the act of the defendant was only a breach of contract te cary the plaintiff te Statesville and was net wantenly and wilfuly done, the plaintiffs damages could only be that actually sufferea ana this weulda. be his wages fer actual loss ef time and prive paid fer his ticket; and as for the price paid fer his ticket, if the plaintiff exer cising erdinary care ef a prudent man, had reasen te beleive that his ticket beught fer JHA + the Sunaay train woula not be used the next day, and beleiving that it weula net be acceptea en the Mendays train, bought another, he would be allewea te receves price ef ticket; but if the plaintiff could have used the ticket on Menday which he beught en Sunday and had reasen te beleive that he eceuld in the exercise of ordinary care, anc netwithstanding beught anether ticket, his actual damages weula be less ef wages op enly. Ceurt here gave a summary ef the evidence te the Jury. If the Jury find frem the evidence that the act ef the defendant was wrengful wilful ana wantern and sheuld answer the secend and third issue Yes, then in addition te actual damages the Jury may award exemplary damages, that is Gamages te punish the defendant fer ite wrengful acts and te deter it frem again being guilty ef sueh wrengful cenduct. The ameunt ef such damages is largely in the deseretien ef the Jury. If such damages are allowed, it ia the duty ef the Pury te weigh ana censider the evidence and circum- stances efered and urged by the plaintiff and the defendant, and say what ameunt, if any, yeu will award the plaintiff. The Jury mst net diseriminate against the defendakgt ner award exefbitamt damages simply because the defen dant is a railread cerperatien; it is am institutien in eur midst, lecated here with 2 its preperty and interests and has a right te expect and will ne deubt receive exact and impartial justice at yeur hands. Om the other hand if yeu find the fact te be that the act ef the defendant was wrengful wilful and wanten , yeu will award such dam ages as will actually cempensate plaintiff fer the injury fer breah ef centract and in additien such damages as will pumish the defen dant fer iits wrengful wanten conduct- net exceeding the amount demanded in the cemplaint. Here the Ceurt gave a summary ef the evidence te the Juryao qu. _ The Jury feund all the issues in faver ef plaintif and awarded as damages $450.00 Defendant meved te set aside verdictbecause it Was excessive. Metien ever-ruled, defendant excepted. Defendant then meved fer a new traal, fer the reasen that the Ceurt refased te give instructions as prayed and fer arrers in the charg as set eut herein and fer errers ef the Ceurt in excluding the evidence effered by the defendant.
