In the Matter of the Liquidation (§ APPLICATION FOR THE APPOINTMENT OF of Eagle Marble and Granite Co., } A COLLECTOR UNDER SECTION a Partnership. { 3278 OF CONSOLIDATED STATUTES To the Honorable C. G. Smith, Clerk Superior Court of Iredell County: Your petitioner respectfully shows: ist. That the Kagle Marble and Granite Company is a general partnership heretofore existing between George F. Eagle and Sterling P. Eagle, now deceased, and is engaged in the business of constructing and selling monuments, tombstones and other ornamental marble products. 2nd. That Sterling P. Eagle, one of the partners in said firm, died intestate during the year 1933, owning an interest in said partnership. 3rd. That George F. Eagle, the surviving partner, has not executed the bond provided for in Article 2 of Chapter 64 of the Consolidated Statutes of North Carolina, providing for the liquidation of a partnership by the surviving partner, in the event of the death of one partner, and that the affairs of said partnership have never been liquidated or closed, although five years have elapsed since the death of the deceased partner. 4th. That it is necessary and advisable under the statute, that the Court will appoint a Collector for said estate to liquidate the same, collect the assets and pay the debts, as provided by law. 5th. That the petitioner is a creditor of said partner- ship and interested in the affairs of the estate of the deceased partner. WHEREFORE, the petitioner prays that the Court will appoint some suitable and competent person, as Collector for the said Eagle Marble and Granite Company and upon the execution of a satisfactory bond, the amount of which is to be fixed by the Court, that said Collector shall be authorized and empowered to enter into possession of all of the assets of said partnership and take charge thereof and administer the same, as provided by law. In the Matter of the PETITION BY THE COLLECTOR FOR AUTHBRITY Administration of the FROM THE COURT TO COMPLETE UNFINISHED Partnership Estate of Lagle ORDERS AND TO PROVIDE FOR MODIFIED FORM Marble and Granite Co. OF OPERATING THE BUSINESS To the Clerk of the Superior Court of Iredell County: Neil S. Sowers, Collector, your petitioner, respectfully shows: lst. That he is the duly and regularly appointed Collector and in charge of the assets of the Eagle Marble and Granite Co., which business heretofore owned and maintained a monument shop in the City of Statesville. 2nd. That the Collector has in stock in the assets of said business certain markers and monuments unlettered and unfinished, which he may probably have an offer to sell at private sale as a fin- ished job in such a way as to realize more out of the inventory than if the same were sold as unfinished material. 3rd. That the petitioner does not desire to operate said business in a normal way, but does desire the court to give him authority, in the event he is able to secure a sale for cash, or its equivalent, of any of the merchandise on hand, to secure the services of kr. George Eagle to complete the same and to use any material on hand for that purpose and pay the labor aost of completing the same, provided such material when so finished, can be sold advantageously and in a way to reimburse the collector for the costs incurred and obtain the ordinary market price for similar work, pending a sale of the entire assets. 4th. The Collector further desires authority to com- plete and deliver any unfihished or partially completed contracts on hand at the date of his appointment and to do all things necessary to that end. WHEREFORE, the petitioner prays the court will make an order giving him authority to operate the business to the extent and in the manner that he may deem wise and advisable to realize the best price possible on any of the stock on hand for which he may be able to secure a private sale. It is further ordered that upon any such trans- action, the Vollector shall keep an itemized and detailed account of the costs of the article sold and the price obtained and shall not sell the same on credit, without express authority being granted therefor.
