Miller, files his petition and re- spectively shows to the Court: Hirao == That prior to the year 1892, he hed becn a citizen of the State of North Carolina , and Iredell County; that at the Fall Term 1892 of Iredell Superior Court, he was wmnvicted of a felony, namely’, a feloneo's slaving; that sentence of the Court was duly pronounced upon him, that upon appeal to the Supreme Court in the cause , a new trial was granted. See Vol. 112, page 878 and 886 inclusive. | Thereafter, at the Term of Iredell Superior Court, your petitioner, with the consent of the State pleaded guilty to man-slaugniter, which plca was accepted by re State, and your pet:.tioner was sentenced to serve a term of years in the State Prison, at Raleigh, N. C.; that, soon after his said plea and sentence of the Court, your petitinner was transported to the State's Prison where he began the service of said Term, and con- tinued the same about five yars, when, by an Act of clemency, of the then Governor of the State af North Carolina, on or about the , your petitioner was granted a full, complete and unconditimal pardon. --Second-- That , immediately thereafter, your petitimer returned to bis former home in Iredell County, North Carolina, where he has re-_ aided until the present time, engaged in farming and running a lit- tle store. oe Pea That for years, and for all time, your petitioner has and wiil recall with horror and sadness the act comiitted by him, which brought upon him the condemnation of the law and service fsr=the State, but he arlégés that there was no matice-in- the—act,-ne -pre-— -~-——---_-_- paration for the fatal encounter, nor crulty or coolness in the man ner in wach he inflicted the fatal wound, gut "there: was testimony tending to show that the killing was justifiable on the grounds of self-defense", as appears in the opinion of the Supreme Court, and your petitioner avers, that as he was then advised and velieved, under the opinion of the Supreme Court, he could have been acquitted upon a new trial, which was granted him, yet, for his act committed, he accepted punishment, grievous to be borne,and entered upon the: service of his term without further Cost or trouble. --Four th-- That about five years of his young manhood was consimed by the State for his hasty act, and he avers that during all said time, no demerit was placed against him by any officer of the State Brison, and no act of his,while serving his term, was even reproved, but your petitioner tried in all respects to comply with the rules of the institution and bear in humility the punishment inflicted upon hin. vee ee ee ABP the- LL a That your petitioner has not before been restored tq the lost rights of citizenship; that he has lived since his release from Prison mme six years in the said County of Eredell, ina quiet, orderly and becoming manner and a bona fide citizen of said county. That he is ,and for more than five years next before the filing of this petition has been, a resident of the Co- unty of Iredell State of North carolina. Second. I am enclosing a copy of the declaration of intention of Side Mack that was filed in the State Court in Statesville, N. C., by o former member of our bar, who is now in the United States Army. I am writing to inquire if this declaration is regular and in due form and if the renunciation is sufficient. Also please let me know if an alien cay be naturalised by the State Court where there is a Federal Court and Clerk in the same county and city? There are not a dozen aliens in our county and I know nothing of the pro- cedure and our courts are in the same position with me, I mean of course the State Courts.
