That the plaintiff is now, and was at and before the commission of the grievances hereinafter tentinnred, the owner, and in possession,of a tract of farming land in the county of Iredell, State aforesaid and én G plot, Crit Tfownship bounded as follows: On the North by lands of JSopy as on the . 7 East by the lands of 77]: W.wl Le on the South by lands of yrvoe/ and on the West by lands of 7), S224, containing ¥ 7G acres more or less and through which the waters of a certain stream, known as creek, were accustomed to flow, and plaintiff was and is entitled to the free and unobstructed flow of said waters in the channel of said stream below said property. Second. That the defendant Mrs. Tay Reed Morrison, as plaintiff is informed ond believes, is, and was at the time hereinafter men= tioned, the owner of w tract of land lying about 6@ yards south of the lands of the plaintiff above described. That said dam so erected and maintained by said defend- ants, has caused the chxnnel of said creek, through, and for a con- siderable distance above plaintiffs lands, to betome filled up with sand and other foreigh matter to the height of three or four feet in the bed of said channel, rencering a valuable tract of abcut threc acres of plaintiffs bottom land incapable of being drained or culti- vated. | Phat. prior to the erection and maintainance of said dam plaintiff wes cultivating said three acres of bottom land, and gather- ing therefrom yeerly crops, of an annuel value of $50.00. That the erection of said dam as aforesaid, has rendered this lot of land too wet and swampy to cultivete, and incapable of being successfully drain ed, so that plaintiff since the erection of oata dem has annually lost use of said lard to tis damage in the sum of $50.00 per year. Fifth. That by reason of the erection of the dem as aforesaid by the defendants as aforesaid and the filling up of the channel of said stream caused by the erection of said cam, the waters of said s stream have been caused to over-flow the banks of agaid stream , leav® ing its channel and to flow over and wash away and through a part of the bottom land of plaintiff above mentioned and his ditches thereon to become filled up, to the damage of plaintiff, in addition to the oo loss of annual crops from said land, in the sum of $50 —. ene Sixth, That th@ defendants have refused to remove said dam from the channel of said stream, as plaintiff is informed and believes, but still continue to maintin the same. Cc. - Dear Sir:- On a recent t¥ip to Statesville, our Mr. Brett dis- cussed with a number of your leading men the subject of land drainage, and it is the intention of these gentlemen, we be- lieve to form a drainage district. As you know, the Clerk of the Court is empowered to appoint an engineer to make the va- rious surveys, and it is in view of this fact that we are writ- ing to you to request that you give us consideration at the time the appointment is made. Our Engineering Department numbers among its staff several of the most skilled engineers in the country, and as We make a specialty of Drainage Engineering, we believe we are competent to handle and perform this work ina thoroughly expert manner. Our Mr. Brett was formerly with the U. 3. Government and has been employed on such projects as the Drainage of the Florida Everglades, the Neosho Valley Reclamation in Kansas, the Logan River project in Nebraska, the reclamation of Newark Meadows in New Jersey, and the Drainage of the St. Francis Basin in Arkansas, In North Carolina, Mr. Brett served as Engineer for the Moyock Drainage District in Currituck County, and is now Mr. Jd. A. Hartness,---#2. acting in that capacity for the Lake Mattamuskeet Drainage Dis- trict in Hyde County. Mr. George R. Boyd, who is now associat- ed with us, was also formerly with the Drainage Investigations, Department of Agriculture, and has been engaged on a number of large projects. If you see your way clear to appoint us Engineer for the proposed district, we shall be wery pleased to accept the same, and shall do everything possible to merit your kind consideration. C, Williams, Commissioner, respectfully reports that he was appointed drainage commissioner in said District on March 2nd, 1911. With the otaoer commissioners efforts were made to let the contract for the dredging, but after prolonged effort no bids were received except at a price which the drainage Commissioners consi@ered excessive and we decided to buy a drainage outfit and do t the work ourselves. For this reason the drainage commissioners had to do a great deal more work and devote more time than in ordinary Cases where the work is done by contract. The actual dredging was b@gun om October the 10th, 1911, and was completed in Mey, 1913. I gave approximately, as nearly as I now can estimate, the following time to my duties, namely: Visiting saw mills and lumbermen, procuring lumber and materiel for the dredge boat about twenty days. Having lumber Placed on the creek and mooving machinery from Bloomfield to the place of construction, gettin; tools and material for the workmen, ana taking the superintendent of construction to and from place where dredge boat was built, about forty five days. Meeting with dredge boat and machine men, meeting bidders, visiting Clark's Creek twice, attending two meetings in Rowan county, in an effort to have the drainage extended on Tuird Creek in Rowan County, and attending meetings of drainage commissioners, about. eme hundred days. Looking after the work along the creek as it progressed, abdout two hundred and toirty five days, a part of which Sime I used my horse and buggy, for which I do not now make any Charge. This low- land i8 very fertile and if not subject to too froquent overflows is very valuable for asricultural purposes. The wet and sour condition of the soil furthermore 15 cnusing malaria. ‘The people living near the strean and its tribu- taries have for many years been subject to malaria. In our opinion these streams can be peudiy dredged, most of the excavation being of sand or of a goft mucky loam. In our Opinion no shoals or rock of consequence will be encountered. Therefore, we recormend: First: That the proposed drainage is practicable. Second: That the public health of the community will be henofitted,. NORTH CAROLINA : IN SUPERIOR COURT IREDELL COUNTY Before the Clerk In the matter of the Withrows RESOLUTION Creek Drainage District Whereas, the Withrows Creek Drainage District was duly estab- lished and a canal made, assessments were made against the land owners to pay for the same, and Whereas, the entire assessments have been payed in full, and Whereas, the canal has filled up, the bottom lands have over- flowed and grown up in bushes and weeds, and Whereas, the condition of the District has become a menace to the public health of the community, and Whereas, the District is now being redrained and cleaned up by the WPA, and Whereas, the District's part of this work will amount to $8.00 per acre. Now, therefore, the Drainage Commissioners of the Withrows Creek Drainage District do hereby levy an assessment of $8.00 per acre on all lands within the said Withrows Creek Dreinage District for the purpose of paying the District's part of the costs of Drainage and Cleaning the said bottom lands in the said District. The chenseutg of the said Drainage Commissioners is hereby author- ized to proceed and collect from each land owner at once the sum of $5.00 per acre and when the drainage is two-thftds complete, to col- lect the balance of $3.00 per acre.
