Gardner: respectfully represents tnat he is a citizen and resident of the County of Rowan; that he is a farmer’'by occupation; that he isa married man and has one child; that Hosea Bell Redman aged about 11 years, and Edna Redman, aged about thirteen years, are orphan children of Hosea ] Redman, deceased, and his wife Elmira Redman, who is also dead, and that said orphan children are now in the custody of their grandfather Cal Sal- mons ; -2- That your petitioner married the aunt of said minor children; that the said Salmons, the grandfather of said children, as the petitioner ig informed and believes, is a confirmed drunkard, and a man of bad moral character; that he has been arrested and punished for drunkenness, and has no occupation or visible means of support, and, as your petitioner is informed and believes, has had the said children begging on the streets of Statesville for hsi benefit; that they have worked some in the cotton mill here, and that their wages have been used by the said Salmons to buy Liquor; -3- That the wife of the said Salmosn is dead, and that he lives there alone with said little girls and his son, who, as your petitioner is informed and believes, is also addicted to drunkeness; that the influences surrounding these children are such as will inevitably bring about their ruin; that a few years ago the grandmother of the said children, Mrs. Fannie Redman, instituted a habeas corpus proceeding to take said children from the custody of the said Salmons, and an order was made in the cause by Chief Justice Furches placing them in the Barium Springs Orphanage; that after being placed there, as your petitioner is informed and believes, the said Salmons enticed them away, and gave the authorities of that institu- tion so much trouble about them, that they finally refused to have any- thing more to do with them; that affiant is informed and believes that the object of the said Salmons in keeping the said children with him is to nake them work in the cotton factory at Statesville that he may live upon -l- @. and procure whiskey with the proceeds of their labor; —4- That your petitioner is a farmer, that his wife is a good woman, and a skillful housekeeper: and seamstress; that the influences and sur- roundings of his home are moral, and that he, on account of his kinship by marriage to said little girls, is willing to take them and to raise them, and to give tnem such education and training as he is able to give his own children; and to that end respectfully applies to the Court that said children may be apprenticed to the petitioner, as provided by Chapter 169 of the Laws of 1889; He alleges: -l- That they have been begging alms in Statesville, as petitioner is in- formed and believes; -2- That the grandfather of said children with whom they live is a bad character, without any visible means of obtaining an honest livlihood, and that he does not employ his time in some honest and industrious occu- pation. Hartness, Clerk of the Superior Court of Iredell Coun- ty, and his successors in office of the one part, and J. D. M. Over- eesh, of the second part, Witnesseth: That the said J. A. Hartness, C. S. C., in pursuance to the provisions of law, doth put, place and epprentice, Early Me- Clure Haynes and Ralph Hoyle Haynes, aged 10 and 12 years respect- ively, at the execution of this indenture unto the said J. D. M. That if either the employer or the apprentice,during the continuance of the apprenticeship,shall be unavoidably prevented from performing any of the confitions ; of the indenture,and a settlement with respect to the same cannot be made by the parties to the indenture »the matter shall be porerted to arbitrators for settlement,one to be selected by the employer and one on the part of the apprentice,and if they cannot decide the controversey,the arbitrators chesen to select a third,and the decision of any two of said arbitrators to be final as to the matter in contraversey.
