RESOLUTION
WHEREAS, the Board of county Commissioners of Iredell County has
authorized and encouraged boards of education in Iredell County to
reserve capital outlay funds for future projects; and
WHEREAS, the Iredell County .Board of Education has stated its
intent to reserve a substantial portion of its 1987-88 capital
outlay funds for construction of a new Troutman Elementary School;
and
WHEREAS, the Board of County Commissioners intends to appropriate
for 1988-89 school capital outlay an amount at least equal to the
level of appropriation for 1987-88; and
WHEREAS, the passage of H.B. 1155 will provide additional
funds for school capital outlay needs with these funds becoming
available beginning in 1989;
THEREFORE, BE IT RESOLVED, that the Board of County Commissioners
of Iredell County feels comfortable with and supports efforts
by the lredell County Board of Education to proceed with design
and receipt of bids for a new Troutman Elementary School.

County Attorney, Bill Pope, discussed with the Board the fact that the Holly Farms attorney
7' believes that the County's Solid Waste Disposal Ordinance may be a zoning ordinance. Under North
Carolina law zoning ordinances must be challenged within a specific period of time. Mr. Pope
advised that the statute of limitation controlling the solid waste ordinance would be effective on
August 1, 1987. Following a brief discussion, the Board instructed Mr. Pope not to use the statute
of limitation as a legal defense to the suit. This instruction being given in the event that Holly
Farms challenges the validity of the County's ordinance within ninety (90) days of August 1, 1987.
