BRIEFING MINUTES
NOVEMBER 6. 2007
The Iredell County Board of Commissioners met in Briefing Session on Tuesday,
November 6, 2007, at 5:00 P.M., in the Iredell County Government Center (South Wing
Conference Room), 200 South Center Street, Statesville, NC.

CALL TO ORDER by Chairman Norman.
CASE NO. 0709-1: Penske Realty, Inc., & the South Iredell Community Development
Corporation Request to Change the Conditions on an existing M-2(CUD), Heavy
Manufacturing Conditional Use District. The property is located on Penske Way and
Mazeppa Road in Mooresville, NC; more specifically identified as PIN# 4668-66-3047
and a portion of PIN# 4668-87-6591: Planning Director Ron Smith said a letter from
Mr. Penske's attorney was received this morning requesting a withdrawal of this case. Mr.
Smith said if Penske submitted a new application, it would be necessary to have a six-month
waiting period from the date of the Planning Board's decision. (This time period would extend
from September 5, 2007 to March 5, 2008.) Smith added that if the county chose to abolish the
quasi-judicial method of handling conditional use cases, the staff would still need several months
to complete the review process.
REQUEST FOR APPROVAL TO (1) AUTHORIZE THE COUNTY MANAGER
AND THE DIRECTOR OF FINANCE & ADMINISTRATIVE SERVICES TO
PROCEED WITH THE FILING OF AN APPLICATION WITH THE LOCAL
GOVERNMENT COMMISSION (2) RETAIN SIDLEY AUSTIN LLC AS BOND
COUNSEL & (3) APPOINT CITIGROUP AS MANAGING UNDERWRITER IN
CONJUNCTION WITH A $106 MILLION CERTIFICATES OF PARTICIPATION FOR
PHASE II SCHOOL CONSTRUCTION PROJECTS: Deputy County Manager Susan
Blumenstein said a 5106 million COPS issuance was proposed that would not require a tax
increase. She said the exact size of the issuance would be determined closer to the sale date
(February of 2008).
Commissioner Steve Johnson said three factors were considered by the task force in
making the school project recommendations. He said these were (1) present value of assets (2)
the total amount of money for the specific projects, and (3) the cash flow. Johnson said
Statesville High School was in the proposed COPS due to construction already occurring onsite.
He continued by saying that Marvin Norman, Joel Mashburn, Susan Blumenstein, Iredell-
Statesville Superintendent Dr. Tent' Holliday, Iredell-Statesville Schools Finance Officer Kay
Fulp, as well as himself, all served on the task force, plus Kenny Miller, and Rob Jackson (both
with the Iredell-Statesville School System) assisted in an advisory capacity.
At the request of Commissioner Williams, this matter was not placed on the consent
agenda.

REQUEST FROM THE IREDELL PROPERTY GROUP (IREDELL
BROADCASTING , INC.) FOR THE REFUND OF $542 IN CONJUNCTION WITH
THE OVERPAYMENT OF A DEED STAMP: Iredell Broadcasting, Inc., President Mark
Sanger said that on November 28, 2006, the WSIC radio station was purchased. He said the
attorney closing the transaction filed a deed in error, but the problem was subsequently corrected
by another document. Sanger said the incorrect deed fee was $1,400 while the corrected
