special exception under Section 7(k) of the FLSA will be paid overvime or receive
compensatory time-offfor hours worked over 40 in a 7 -day work period
Non-exempt employees, who work in public safety activities, emergency response
activities, or seasonal activities, may accrue not more than 480100 hours of
compensatory time. All other non-exempt employees may accrue not more than AQ 75
hours of compensatory time for overtime hours worked.
14. The county manager may authorize overtime pay for non-exempt and exempt
employees who are needed to protect the health and/or safety of employees or the citizens of
the county in tunes of disasters or emergency.
Section 15. ftyrel!-Deductfons
CHANGE: SECTION H ADDED DUE TO THE 2004 ADMENDMENTS TO THE
FLSA. DEFINES WHEN DEDUCTIONS IN PAY CAN BE MADE AND PROVIDES A
PROCEDURE FOR CORRECTING DEDUCTIONS MADE IN ERROR.
TIHS SECTION WAS REVIWED BY OUR LABOR ATTORNEY.
I. Payroll Deductions Only payroll deductions specifically mandated or authorized by
Federal, State and/or county officials may be deducted. Other deductions may be made with
the approval of the Finance Officer if requested and authorized by the employee.
11. Pay Deductions
A. Non-exempt employees Pay will be reduced for all hours the employee a
scheduled to work but does not in a workweek if.•
1. Tke employee does not have accumulated vacation, sick or compensatory
leave to cover the absence.
2. The employee has been approved for leave without pay.
3. The employee is on FM&4 and the reason does not qualify for the use of sick
leave under the county's sick leave policy or the reason does qualify for the
use of sick leave bat it has been exhausted, and the employee opts not to use
accumulated vacation leave.
4. Disciplinary deductions are imposed for Unacceptable .lob Per and
Unacceptable Conduct as stated in the county's policies.
A ExenW Employees Subject to certain exceptions required or permitted bylaw,
exempt employees will receive their full salaryfor any workweek in which they
perform any work without regard to the number of days or horns worked
Deductions from vacation or sick leave balances for hours or days missed during
Ake workweek is not an unproper deduction under FLSA. Deductions in pay
may be made from the salaries of exempt employees under the following
cururmtances.
1. Deductions for less than a day when taken as i ntermident or reduced leave
within a workweek when FML is taken.
2. Deductions in pay for a full day absence may be made in any workweek f
a Tke employee is absent for personal reasons and does not have
accumulated vacation leave to cover the day.
& Tke employee requests and is approved for LWOP for personal
reasons.
The employee is receiving workers compensation benefits.
Tke reduction is for disco Binary reasons due to infraction of nmjor
safety rules of major significance.
Tke reduction is for disciplinary reasons due to serious violations of
Ike County's anti -harassment policy or unacceptable conduct
policies, such as abuse of clients, patients, students, or a person over
whom an employee has charge or responsibility, abuse of an animal
owned or in the casiody of the agency, faL:i kerion of any kind,
possession of unauthorized firearms or other lethal weapons on the
