HomeMy WebLinkAbout12-20-2022 1 December 20, 2022 IREDELL COUNTY BOARD OF COMMISSIONERS PRE-AGENDA SESSION December 20, 2022 The Iredell County Board of Commissioners met in pre-agenda session on Tuesday, December 20, 2022 at 5:00 PM, in the Commissioners’ Meeting Room located in the Iredell County Government Center 200 South Center Street, Statesville, NC. Board Members Present Chair Melissa Neader Vice Chair Bert Connolly Scottie Brown Gene Hope Brad Stroud, Sr. Staff present: County Manager Beth Mull, County Attorney Lisa Valdez, Deputy County Manager Susan Robertson, Finance Director Deb Cheek, and Clerk to the Board Amy Anderson. CALL TO ORDER: Chair Neader called the meeting to order. ADJUSTMENTS TO THE AGENDA: There were no adjustments to the agenda. ADMINISTRATIVE MATTERS Request from Emergency Management for approval to apply for the North Carolina Emergency Management Consolidated Grant Program: Kent Greene requested approval to apply for the NC Emergency Management Consolidated Grant Program. Grant funds are used to offset the cost of our emergency management program and to conduct hazardous materials exercises. This item was placed on consent. Request from the Finance department for approval for an amendment to a lease agreement with the United States Department of Agricultural: Purchasing Agent David Sifford requested approval of amendment to a lease agreement with the US Department of Agricultural. The USDA fell behind on the lease payments due to staffing shortages and not using the space during the COVID Outbreak. They are now requesting to extend the lease through July 31, 2025. If approved, the agency will pay to Iredell County $37,326.60 in arrears for the rent not paid from August 1, 2020 through September 30, 2022. This amounts to $8.90 per square foot for 4,194 square feet of office space. Effective October 1, 2022, the agency will pay to Iredell County a rate of $10.62 per square foot of office space for the 4,194 square feet, which amounts to a monthly lease rate of $3,711.69. They are requesting the lease to be extended through July 31, 2025. The lease amendment is attached. This item was placed on consent. 2 December 20, 2022 Request from the Finance Department to consider an Offer to Purchase and Contract for surplus real property located on Harmony Highway and approval to begin the upset bid process: David Sifford said in July, 2020, the Board of Commissioners adopted a resolution authorizing staff to work with Allen Tate Realtors in conducting an upset bid process for a parcel of surplus real property owned by Iredell County. The property is located at 4600 Harmony Highway. If the Board chooses to accept the current offer of $400, the upset bid process will begin. The Board agreed to not accept the offer. Request from Womble Bond Dickinson to waive any conflict of interest that exist or arise regarding a client they represent as it relates to the County: County Attorney Lisa Valdez said Womble Bond Dickinson has requested Iredell County waive any conflict of interest that may exist or arise regarding a client they represent as it relates to the County. Womble serves as the County’s bond counsel and also does insurance defense work for the County. They also represent a developer who is acquiring an easement near James Farm Rd and will need an easement across land owned by the County. Womble has not in the past been involved in any aspect of easement acquisition for the County. This item was placed on consent. Request from Tax Administration for approval of November 2022 Refunds and Releases: This item was placed on consent. Request from Iredell-Statesville Schools to deed the main track of Shepherd Elementary property to the school system in order to combine property and density share with the Parkertown Property: Tim Ivey said the school system is applying for a density sharing between the property on Parkertown Road and Shepherd School. The main track of land at Shepherd is deeded in the county's name. Ivey requested the County to deed the main track back to the school system in order to combine all the property they own around Shepherd into one track and density share with Parkertown Property. This is needed so mobile classrooms can be added to the school which will be well over capacity next school year. This item was placed on consent. Board Members Present Chair Melissa Neader Vice Chair Bert Connolly Scottie Brown Gene Houpe Brad Stroud, Sr. Staff present: County Manager Beth Mull, County Attorney Lisa Valdez, Deputy County Manager Susan Robertson, and Clerk to the Board Amy Anderson. CALL TO ORDER by Chair Neader. INVOCATION: Commissioner Houpe led the invocation. PLEDGE OF ALLEGIANCE led by Chair Neader. ADJUSTMENTS TO THE AGENDA There were no adjustments to the agenda. MOTION by Commissioner Houpe to approve the agenda as presented. VOTING: Ayes – 5; Nays – 0 SPECIAL PRESENTATION & RECOGNITIONS Recognition of Iredell Council on Aging Executive Director Anna Rice: Chair Melissa Neader presented the following resolution to Iredell Council on Aging Executive Director Anna Rice: Resolution of Appreciation To Anna Rice WHEREAS, Anna Rice has completed an extraordinary and respectable 45-year tenure as the Executive Director of the Iredell Council on Aging, and WHEREAS, Anna Rice has dedicated her career to the aging population of Iredell County as evidenced by the many lives she has impacted; and WHEREAS, Anna Rice developed and integrated diverse programs and services for the aging including transportation, nutrition, health screening programs, Meals on Wheels and congregate meal sites, in-home services, caregiver support including Iredell’s first Alzheimer’s Support Group, Senior 4 December 20, 2022 Community Service Employment Program (SCSEP), Seniors’ Health Insurance Information Program (SHIIP), Iredell Senior Center, and South Iredell Senior Center; and WHEREAS, Anna Rice has promoted a positive attitude toward aging among all age groups while bringing the needs of the aging to the public’s attention; and WHEREAS, Anna Rice has served on many community clubs and organizations such as the National Council on Aging, North Carolina Association on Aging, Home and Community Care Block Grant Committee, Iredell County Transportation Authority Board, Statesville Human Relations Council, Altrusa Club, and Rotary Club of Statesville; and WHEREAS, Anna Rice has served as the official advisor to the Iredell County Board of Commissioners on matters pertaining to objectives adopted by the Council on Aging, and WHEREAS, Anna Rice may best be known for her passion and dedication for the aging population in Iredell County by seeing her in action, hearing one of the thousands of energetic presentations she has given over the years, or her thoughtful assistance to families seeking her advice for an aging family member. NOW, THEREFORE BE IT RESOLVED, the Iredell County Board of Commissioners and staff hereby express their sincere appreciation and deep gratitude for the devotion and dedicated service of Anna Rice. ADOPTED, this 20h day of December 2022. VOTING: Ayes – 5; Nays – 0 ANNCOUNCEMENT OF VACANCIES OCCURING ON BOARDS & COMMISSIONS APPOINTMENTS TO BOARDS & COMMISSIONS (None) Animal Services Grievance Committee - 3 appointments. Jason Benge and Lori Root have volunteered to serve again. Amy Miller has volunteered to serve for the first time. MOTION by Commissioner Houpe to appoint the abovementioned to the Animal Services Grievance Committee. VOTING: Ayes – 5; Nays – 0 Board of Equalization & Review - 6 appointments Carl Lombardo, Hal Jolly, Allen Simmons, Pressly Mattox, and Kathy Hoover have volunteered to serve again. John "Skip" Douglas has volunteered to serve for the first time. MOTION by Commissioner Brown to appoint the abovementioned to the Board of Equalization and Review. VOTING: Ayes – 5; Nays – 0 Recreation Advisory Board - 5 appointments Jane Laney, Deb Tatu, & Barbara Thorson have volunteered to serve again. Richard Coleman and Joseph Cooke have volunteered to serve for the first time. MOTION by Vice Chair Connolly to appoint the abovementioned to the Recreation Advisory Board. VOTING: Ayes – 5; Nays – 0 Zoning Board of Adjustment - 4 appointments John Allen, Mac McCombs, Don West (alt.) have volunteered to serve again. Richard Coleman and Ken M. Robertson, III have volunteered to serve for the first time. MOTION by Commissioner Brown to appoint John Allen, Mac McCombs, and Richard Coleman as a full-time members and Don West as an alternate to the Zoning Board of Adjustment. Commissioner Houpe said historically the Board reappointed members already serving. Mr. Coleman is currently serving on several boards. Mr. Robertson is not. 6 December 20, 2022 VOTING: Ayes – 1; Nays – 4 Motion failed. MOTION by Commissioner Stroud to appoint John Allen, Mac McCombs, and Ken M. Robertson III as a full-time members and Don West as an alternate to the Zoning Bo ard of Adjustment. VOTING: Ayes – 5; Nays – 0 Commissioner Brown said some members of the Board of Adjustment have asked for there to be three alternates. County Attorney Lisa Valdez said in order to increase the number of alternates the Land Development Code would have to be amended. UNFINISHED BUSINESS (None) PUBLIC COMMENT PERIOD Jack Benyon, 263 Beaten Path Road, represented several multiple communities and committees. He shared concerns over short-term rentals. There are 13 short-term rentals within three miles on Beaten Path Road. Benyon said the short-term rentals create health, safety, water safety, traffic, and noise nuisance issues. There is one house in the neighborhood that was built as a one bedroom septic and it is currently being run as a seven bedroom (14 beds) house. Benyon asked the Board to recognize, regulate, and enforce. Cheryl Pletcher spoke on the sanctity of life. NEW BUSINESS (None) County Manager Beth Mull gave an update on the following:  Employee & Retiree Luncheon – January 24 from 11am – 1:30pm at the Statesville Civic Center CLOSED SESSION There were no Closed Session items. ADJOURNMENT MOTION by Commissioner Brown to adjourn at 7:26PM. The Board will meet for a regular meeting Tuesday, January 3, 2022 at 7pm in the Commissioners’ Meeting Room, Government Center, 200 South Center Street, Statesville, NC.
