CALL TO ORDER: Chairman James Mallory called the meeting to order. ADJUSTMENTS TO THE AGENDA: County Manager Beth Mull went over the following adjustments: • Remove Item VII.2 Public hearing for Project Fusion. ADMINISTRATIVE MATTERS Request from the Library for approval of budget amendment #44 in the amount of $2,500 and to accept State Library of North Carolina COVID-19 Response Mini-Grant: Finance Director Deb Cheek requested approval of budget amendment #44 in the amount of $2,500 to accept a State Library of North Carolina COVID-19 Response Mini-Grant. The funds will be used to replace 36 adult computer chairs. The grant does not require any matching funds. This item was placed on consent. Request from Parks & Recreation for approval of restrictive coven ant for Iredell County Recreation Center, and record as required for Parks and Recreation Trust Fund Grant: Parks & Recreation Director Michelle Hepler explained that in accordance with the Parks and Recreation Trust Fund requirements, approved projects must include a restrictive covenant on the deed, which must be officially recorded. The covenant states that the property will be used strictly for the purpose of recreation, in perpetuity. The land acquisition of the Recreation Center property, located at 122 Grannis Lane, Statesville is a qualified and approved PARTF project, and therefore needs the restrictive covenant added to the deed for final close out of the County's grant application. Once completed, reimbursement in the amount of $425,000 can officially begin. The grant award and reimbursement will save the County $425,000. Hepler requested approval of the restrictive covenant for the Iredell County Recreation Center. This item was placed on consent. 2 May 4, 2021 Request from ICATS for approval to sign multi-year contracts with Prepaid Health Plans: ICATS Director Bradley Johnson requested approval of multi-year contracts with Prepaid Health Plans to continue to continue to provide service to the citizens of Iredell County who are Medicaid recipients. ICATS is required to contract with two different brokers that have contracted with the PHP for this region. ICATS would like to sign contracts with two different brokers that will provide trips generated from the five PHP providers in Medicaid Region 3. The PHPs are currently building their provider networks. Medicaid Managed Care will launch in July of 2021. County Attorney Lisa Valdez is assisting in with contract reviews. This item was placed on consent. Request from Elections for approval of a sole-source purchase award request to Elections Systems & Software: Elections Director Becky Galliher requested approval to purchase the Express Vote Machine. Galliher noted this item was continued from the previous meeting. Elections has not received any comments regarding the request. Commissioner Brown said the feedback has been better once the video was available. Vice Chair Neader expressed appreciation to Galliher and her staff for going the extra mile. Chairman Mallory thanked Galliher for doing some more research on the equipment. This item was placed on consent. Request from the Finance Department for approval of surplus declaration and approval of private sale: Dean Lail requested approval of surplus declaration and private sale of retired K-9 Danny to its handler Deputy Leo Hayes. K-9 Danny is a German Shepheard purchased and placed into service in May 2015. The County's veterinarian, Dr. Nichola Gaither of Animal Hospital of Statesville, has determined that Danny is no longer able to perform his duties effectively due to his health. She recommends Danny be retired from active service. Deputy Hayes has expressed interest in buying and taking full responsibility for Danny to provide him with a safe, familiar and controlled environment befitting Danny’s service. Lail added the sale is supported by NC G.S. 160A-267, which allows the Board to sell personal property by private negotiated sale. Additionally, the County's ordinance requires Board approval for private sale to County Employees. As consideration, the County has historically sold K-9 units to handlers for $1.00 and a signed indemnity and hold harmless agreement accepting all medical and legal liability. This item was placed on consent. Reappointment of Bill Furches as Tax Collector for a four-year term: Mull explained that NCGS 105-349 requires the governing body of each county to appoint a tax collector to serve for a term determined by the appointing body and until a successor has been appointed and qualified. Bill Furches was originally appointed Tax Collector for a one-year term in June 2004, and reappointed for four-year terms in June 2005, 2009, 2013, and 2017. Under his leadership, the tax collection rate has increased from 96.17% at June 30, 2004 to 99.20% at June 30, 2020. In 3 May 4, 2021 addition, Furches was appointed Tax Administrator in January, 2011 providing leadership for the County Assessor and Mapping/GIS departments. This item was placed on consent. Reappointment of Deputy Tax Collectors N.C.G.S. 105-349(f) to a four-year term ending June 30, 2025: Tax Collector Bill Furches requested the reappointment of Ann Gray Ray, Shannon Lester, Laura Stroud, Kellie Roper and Susan Warren as Deputy Tax Collectors in accordance with N.C.G.S. 105-349(f) to a four-year term ending June 30, 2025. Ann Gray has served as Deputy Collector for 18 years, Shannon for 13 years, Laura for 6 years, Kellie for 3 years and Susan for 3 years. Mull added appointment allows the Deputy, under the direction of the Tax Collector, to perform any act that the Tax Collector may perform. This item was placed on consent. Request from Planning & Development to consider calling for a public hearing on May 18, 2021 at 7:00 p.m. in regard to a text amendment to the Land Development Code : Planning Director Matthew Todd requested to call for a public hearing on May 18, 2021 in regard to text amendments to the Land Development Code for the Airport Overlay. The ordinance regulates the heights of structures in the approach zone of the airport. Over the years, the County and City’s overlays had been amended separately. Todd said County and City staff, and Airport Manager John Ferguson worked with on a new overlay. The City recently adopted the new overlay. Todd noted the Airport Commission has recommended in favor of the text amendment. The biggest change, recommended by the consultant, in the overlay is the east is the only path in which the height restrictions need to be protected. Commissioner Brown asked why the west was not included. Airport Manager John Ferguson said the airport will not ever have a precision approach coming from the west. A non-precision approach is a smaller approach zone. The east side is the instrument landing approach and must be better protected. In order to have precision approaches on both ends of the runway the airport must have a FAA control tower. Commissioner Houpe, member of the Airport Commission, shared support of the request. This item was placed on consent. Consideration of a request by Charles Myers to release zoning and subdivision jurisdiction to the Town of Mooresville: There were no comments received after the public hearing. This item was placed on consent. Consideration of a request by Jennifer Holt to release zoning and subdivision jurisdiction to the Town of Mooresville: A comment was received regarding the lack of need of further development. This item was placed on consent. 4 May 4, 2021 Consideration of a request from Planning & Development in regard to a text amendment to the Land Development Code: There were no comments received after the public hearing. This item was placed on consent. Request from Administration for approval of a License Agreement between Iredell County and Kiwanis Club of Statesville, Inc: Deputy County Manager Susan Robertson requested approval of a license agreement with the Kiwanis Club of Statesville, Inc. In years past, the fairground site was leased to the Kiwanis Club year-round. Staff and Valdez worked together and is proposing a license agreement allowing the Kiwanis Club use of the fairground property from August 1 – September 20, 2021 to prepare for, conduct, and clean up after the Annual Agricultural Fair. The Kiwanis Club will pay the cost of everything except the tents the County rent. The agreement is for one-year and written permission of the County Manager it can be extended one-year at time for four additional years. Chairman Mallory asked if the Kiwanis Club will have exclusive use during the 60 days. Robertson said no. Commissioner Houpe shared disagreement over the request and asked that it be tabled. Houpe feels the County should charge for the use of the fairground. Houpe also asked for expenditures on the property that Kiwanis Club has paid for. Robertson added the Kiwanis Club pays the County from $8-10,000 per year towards the cost of work at the fairground. The Kiwanis Club will be billed actual cost for the utilities from August 1 – September 30. Commissioner Houpe suggested setting a fee schedule to rent the fairground for the Kiwanis and other organizations. Houpe asked for more time to discuss the matter. Robertson said the Kiwanis Club invests money in college scholarships in the community. Commissioner Houpe asked staff to contact Kiwanis Club and gather more information on the scholarships. This item was not placed on consent. Request from Clerk to the Board for approval of minutes from the meeting on April 20, 2021: There were no additions or corrections. This item was placed on consent. ANNOUNCEMENTS OF VACANCIES OCCURING ON BOARDS & COMMISSIONS (None) APPOINTMENTS TO BOARDS & COMMISSIONS (None) 5 May 4, 2021 OLD BUSINESS (None) NEW BUSINESS (None) COUNTY MANAGER’S REPORT County Manager Beth Mull provided an update on the following: • Will present the Budget Message • Budget Session, May 6, 11am – 3pm; May 10, 8am – noon; May 11, noon – 5pm. All of the sessions will be held at the East Iredell Lions Club. • Mull approved a transfer of $850 from the Health Department to the Parks & Recreation Department. The Health Department received a grant to provide swim lessons. The lessons will be held at the Fitness Center. The money transferred in order to conduct the swim lessons. CLOSED SESSION Chairman Mallory said the Board will enter into Closed Session to include litigation by Skip McCall and others versus Iredell County and Iredell County Board of Commissioners. The Board entered into Closed Session at 5:49pm. IREDELL COUNTY BOARD OF COMMISSIONERS REGULAR MINUTES May 4, 2021 The Iredell County Board of Commissioners met in regular session on Tuesday, May 4, 2021 at 7:00 PM, in the Commissioners’ Meeting Room of the Iredell County Government Center, 200 South Center Street, Statesville, NC. VOTING: Ayes – 5; Nays – 0 PRESENTATION OF SPECIAL RECOGNITIONS & AWARDS APPOINTMENTS BEFORE THE BOARD (None) PUBLIC HEARINGS Chairman Mallory explained the meeting is considered a remote meeting therefore the Board is unable to vote on the public hearings until 24-hours after the hearing. The Board will vote on the public hearings during the Budget Sessions, which begin Thursday, May 6 at 11am. Public hearing to consider a request from owner/applicants Kent & Vicky Moore, representing KM Electrical Heating and Air, to rezone approximately 6.98 acres along Wilkesboro Highway: Planning Director Matthew Todd said the owner is requesting to have the property rezoned from Residential Office – Conditional Use District to General Business – Conditional Use District. There are conditions on the request and excluded uses are listed in the staff report. The rezoning would bring the property into better conformity with the code. There is some outdoor storage and the owner plans to build an additional building. The proposed zoning change will allow more flexibility with the use of the property. There has been no opposition to the request. Planning staff supports the request and the Planning Board voted unanimously in favor of the request. Chairman Mallory opened the public hearing. No one wished to speak. Chairman Mallory closed the public hearing. Iredell County PLANNING & DEVELOPMENT PLANNING STAFF REPORT REZONING CASE # 2104-1 STAFF PROJECT CONTACT: Leslie M. Meadows EXPLANATION OF THE REQUEST This is a request to rezone an existing commercially used property along Wilkesboro Highway, approximately 6.98 acres, from Residential Office Conditional Use District (RO -CUD) to General 7 May 4, 2021 Business Conditional District (GBCD). This request is conditional per the submitted application, and will be limited by excluding certain GB uses as attached to the request. OWNER/APPLICANT OWNER/APPLICANT: Kent & Vicky Moore, KM Electrical Heating & Air PROPERTY INFORMATION ADDRESS/LOCATION: 2865 Wilkesboro Hwy; more specifically, PIN#: 4727641239.000. SURROUNDING LAND USE: The site is surrounded by residential R-20 and RA properties, with several large tracts of agricultural lands. Trinity Methodist Church lies diagonally to the northwest. The adjoining property to the south will remain RO-CUD. SIZE: The total acreage to be rezoned includes approximately 6.98 acres. EXISTING LAND USE: Contractor’s Office for KM Electrical Heating & Air, built in 2006. ZONING HISTORY: The property was zoned Residential Agricultural (RA) when county -wide zoning was established in 1990. However, in 1996, this island of properties along Coachman Loop was part of a large non-owner rezoning petition to become Single-Family Residential (R-20). In 2005, the property was rezoned to Residential Office Conditional Use District (RO -CUD), along with the neighboring property to the south. OTHER JURISDICTIONAL INFORMATION: This primarily rural area is located entirely within the County’s jurisdiction, and is not in close proximity to any municipal Urban Service Area. OTHER SITE CHARACTERISTICS: This property is located within the regulated South Yadkin WS-IV-PA Protected Watershed Area. Proposed new development will be governed by the 70% or 10/70 Rule: 24% built-upon area with curb and gutter (36% without), after 10% is developed. The property is not located in a flood hazard zone. UTILITIES: This site is currently served by well and septic. However, it is noted that Iredell Water Cooperation does service the area. IMPACTS ON LOCAL INFRASTRUCTURE AND/OR FACILITES TRAFFIC: The closest traffic count along Wilkesboro Highway (NC115) is to the south just before Midway Road, which had a traffic count of 7,000 vehicles per day in 2018. According to the Comprehensive Transportation Plan 2008 Study Report for Iredell County, the capacity for this section of Wilkesboro Highway is approximately 13,800 vehicles per day through the year 2030. The speed limit along this portion of Wilkesboro Highway is 55 mph. SCHOOLS: This is a commercial rezoning and should have no implications on local schools. EMERGENCY SERVICES: This proposal has been reviewed by the Iredell County Fire Marshal’s Office and Iredell County EMS. Neither office addressed any concerns regarding the request. 8 May 4, 2021 REQUIRED REVIEWS BY OTHER AGENCIES LOCAL: The applicant must provide a site plan to the Planning & Development Department for review to develop the properties. Zoning requirements such as parking, landscaping, and buffering will be reviewed at such time. Erosion & sedimentation control standards will also be reviewed for compliance. STATE: Other than building code, there should be no formal state agency review at this time. FEDERAL: None at this time. STAFF AND BOARD COMMENTS STAFF COMMENTS: The applicant/owner, Mr. Kent Moore, represents KM Electricial Heating & Air, offering electrical and HVAC equipment and services in partnership with Trane systems. Since opening in 2005, the business has steadily grown from a mere contractor’s office space to a contractor’s facility with an amount of necessary equi pment, increased employees, outdoor storage, and product staging areas. Thus, an additional shop/warehouse type structure is needed. A rezoning from RO-CUD to GB-CD at this site, brings the use more into compliance as an actual contractor’s facility. As a conditional rezoning request, agreed upon conditions should help mitigate possible future GB use concerns. The specific conditions imposed as part of the conditional rezoning application are as follows: 1.) The following GB uses would be excluded, not permitted: Amusement arcades and indoor places of entertainment; including bowling alleys, pool rooms, skating rinks, & batting cages, Bingo games, Correctional institutions, Dance halls; including night clubs, Go -kart, motorcycle, & similar vehicle tracks, Indoor shooting ranges, Adult oriented businesses, Bars, Bus stations, Crematories not associated with a funeral home, Drive -in theaters, Liquor stores, Motels & hotels, Pawn shops, Private clubs. Being along a major thoroughfare, Wilkesboro Highway (NC115), the parcel in question is less than half a mile south of what the 2030 Horizon Plan calls a Rural Commercial area. Rural Commercial areas include existing commercial uses or areas intended for future commercial uses that are located along major roadways in rural areas. The intent of these areas is that they will remain rural in character for the planning period and will not be served by public or private water and sanitary sewer systems. Land uses appropriate within Rural Commercial areas include supporting farm services, small-scale commercial uses, small-scale neighborhood service businesses, restaurants, churches, and institutional uses. However, the 2030 Horizon Plan does state that other commercial and office uses could be permissible in the Rural Commercial designation, provided the property is rezoned to a conditional district, as in this case. Land use plan designations are typically viewed as conceptual, but staff feels that with th is particular request being an increase in intensity of use, an amendment to the land use plan would be needed. Staff feels comfortable including the entire parcel within the rural commercial designation due to the fact it is fixed between two roadways, and adjoins a RO commercial use zoning designation. The Planning staff can support the proposed rezoning request, and subsequent 2030 Horizon Plan map amendment, based on the following: The property is already used commercially and is fixed between two roadways, it will bring an existing use into appropriate zoning compliance, and the proposed conditions mitigate possible future GB use concerns. PUBLIC INPUT MEETING: A public input meeting was held on Thursday, February 18, 2021, from 5:30pm - 6:30 pm, onsite at KM Electrical Heating & Air along Wilkesboro Highway. Approximately 9 May 4, 2021 six property owners from the area were in attendance to hear the Contractor’s Facility proposal, and to deliberate the permitted GB uses list. Those present were in favor of the additional storage structure vs. current tractor-trailer bed. A copy of the applicant’s summary of said public input meeting has been included at the end of this report. SITE REVIEW COMMITTEE: Staff performed a site visit on March 19, 2021, accompanied by Planning Board members: Raymond Burnette, Andy Webster and Ronda Hoke. PLANNING BOARD ACTION: On April 7, 2021, the Planning Board held a public meeting to hear the rezoning request. The applicant was present for questioning. No neighboring landowners attended in opposition. The board voted 9-0 to recommend approval of the rezoning. Public Hearing to consider a request from owner/applicant Phillip M. Rotella, to rezone approximately 1.25 acres along Brawley School Road: Planning Director Matthew Todd explained the request. The property is currently rezoning Residential Agricultural. Staff supports the request. The property lies within the 2030 Horizon Plan’s Corridor Commercial Designation and is surrounded by various commercial uses. Todd said the properties existing watershed restrictions should limit development to smaller-scale General Business uses in the future. Chairman Mallory opened the public hearing. No one wished to speak. Chairman Mallory closed the public hearing. Iredell County PLANNING & DEVELOPMENT PLANNING STAFF REPORT REZONING CASE # 2104-2 STAFF PROJECT CONTACT: Leslie M. Meadows EXPLANATION OF THE REQUEST This is a request to rezone a parcel of land along Brawley School Road, approximately 1.25 acres, from Residential Agricultural (RA) to Highway Business (HB). This is a conventional rezoning request, with no conditions proposed at this time. OWNER/APPLICANT OWNER/APPLICANT: Phillip M. Rotella PROPERTY INFORMATION ADDRESS/LOCATION: 10 May 4, 2021 754 Brawley School Road; more specifically, PIN#: 4637919474.000. SURROUNDING LAND USE: Adjoining and adjacent to this site are a variety of NB and CB/CB-CUD (which now converts to HB/HB- CUD under the current LDC) in the surrounding area. Properties directly to the east, north, and south are still residential in nature. SIZE: The total acreage to be rezoned includes approximately 1.25 acres. EXISTING LAND USE: Former single-family dwelling that has been removed. ZONING HISTORY: The property has been zoned, Residential Agricultural (RA) since county-wide zoning was established in 1990. OTHER JURISDICTIONAL INFORMATION: The property is inside of the Town of Mooresville’s Long-Range Urban Service Area. The Town of Mooresville was made aware, and seems to agree the request appears to be consistent with most of the existing surrounding development. OTHER SITE CHARACTERISTICS: This property is located within the regulated WS-IV-CA Critical Watershed Area for Catawba/Lake Norman. Proposed new development will be limited to the Non-Residential Low Density Option for 24% built-upon area. The Non- Residential High Density Option is not an option along Brawley School Road in the County’s jurisdiction. The property is not located in a flood hazard zone. UTILITIES: This site is currently served by well and septic, but could have access to public utilities through the Town of Mooresville. IMPACTS ON LOCAL INFRASTRUCTURE AND/OR FACILITES TRAFFIC: Brawley School Road is considered an existing boulevard according to the current CRTPO Comprehensive Transportation Plan. The closest and most recent traffic count, east of this property along Brawley School Road, had a traffic count of 31,000 vehicles per day in 2017. According to the Comprehensive Transportation Plan 2008 Study Report for Iredell County, the capacity for this section of Brawley School Road is approximately 36,600 vehicles per day through the year 2030. The speed limit along this section of Brawley School Road is 55 mph. SCHOOLS: This is a commercial rezoning and should have no implications on local schools. EMERGENCY SERVICES: This proposal has been reviewed by the Iredell County Fire Marshal’s Office and Iredell County EMS. STAFF AND BOARD COMMENTS STAFF COMMENTS: The owner/applicant, Mr. Phil Rotella, represents Lake Vision Development, Inc., a construction company that specializes in designing and building luxury outdoor living spaces: pools, cabanas, and other hardscapes. Future plans include use of the property in question for a warehouse-type structure to house a building supply dealership. However, strict Catawba/Lake Norman WS-IV-CA Critical Watershed restrictions along Brawley School Road should limit development to smaller-scale HB uses into the future. Being along Brawley School Road, the parcel in question is inside what the 2030 Horizon Plan calls the Corridor Commercial area. Corridor Commercial areas include existing commercial, office, and/or retail uses that exist along major thoroughfares and highways or areas that will include commercial development in the future, and can contain both large and small mixed-use commercial centers. These areas are both within and outside the Iredell County Urban Service Areas. They may be serviced by and incorporated into one of the municipalities at some point in the future. According to the plan, commercial uses within this area generally should include retail, restaurants, entertainment centers, automobile services, personal services, other commercial uses, and office developments. The Planning staff can support the proposed rezoning request based on the following: The property lies within the 2030 Horizon Plan Corridor Commercial area, it is surrounded by various existing commercial uses, and existing watershed restrictions should limit development to smaller-scale HB uses into the future. The proposed use of the property is a residential development with 41 units. OWNER/APPLICANT OWNER: Michael Nelin MAGJCC FARMS LLC 1018 Brawley School Road Mooresville, NC 28117 PROPERTY INFORMATION LOCATION: 1018 Brawley School Road in Mooresville; more specifically identified as PIN # 4636573996. DIRECTIONS: Brawley School Road, on the right before Esquire Lane. SURROUNDING LAND USE: This property is surrounded by residential and commercial uses. SIZE: The property is 6.8 acres. EXISTING LAND USE: The property currently has a home on it that will be used as an office. ZONING HISTORY: This property has been zoned RA since County-wide zoning in 1990. OTHER JURISDICTIONAL INFORMATION: This property is located inside Mooresville’s short range USA boundary. The property to the west is already in the Town’s jurisdiction. This property is located in Tier 2 Tiered Growth Map, which was adopted as part of their Mooresville One Plan on September 16, 2019. This area has been identified on Mooresville’s Future Character and Land Use Map as a Village Center, which is a community destination that include an integrated mix of commercial (shopping, restaurants, and services) office, hospitality, and residential uses. 13 May 4, 2021 OTHER SITE CHARACTERISTICS: This property is located in a WSIV-Critical Area water supply watershed. IMPACTS ON LOCAL INFRASTRUCTURE AND/OR FACILITES TRAFFIC: The most recent traffic count for this section of Brawley School Road was completed in 2016 and was 26,000 vehicles per day. SCHOOLS: The proposed use is a residential development with a density of approximately six units per acre. STAFF COMMENTS STAFF COMMENTS: From a Planning perspective, this request meets the criteria for release of zoning and subdivision jurisdiction. The Town Planning staff has provided a letter that states the property is located in Tier 2 of their Tiered Growth Map. The 2030 Horizon Plan recommends Transitional Commercial uses for this area, which can include residential uses as secondary uses. The Town of Mooresville has regulations in their code to require a Traffic Impact Analysis to try to mitigate that impact. The Planning staff recommends in favor of this request. Public hearing to consider an economic development incentive for Project Mountain : Jenn Bosser presented Doosan Bobcat North America, an existing industry company also known as Project Mountain, for consideration for an incentive from Iredell County for an expansion at their current location, the northwest quadrant of I-40 and I-77. Doosan Bobcat has acquired additional acreage at the site with plans to invest $70 million to construct over 580,000 square feet of new manufacturing and warehouse distribution space by May 2022. The Statesville site currently employs approximately 400 full-time employees with plans to add nearly 300 more jobs within the next five years. In addition to its operation in Statesville, Doosan Bobcat has an extensive presence in the US. Doosan means “little grains that can build mountains.” The company partners with the school systems and supports the local community. State’s participation is significant and it speaks to the company’s commitment to create jobs at or above at Iredell County’s current wage. The JDIG is performance base and is discretionary incentive p rogram awarded only in competitive recruitment or retention projects. The State requires a local match for the JDIG. Last night, the City of Statesville approved an incentive grant for the project up to $143,608,000 based on their policy. In accordance with Iredell County’s Economic Development Policy, Bosser requested an economic incentive grant to Doosan Bobcat North America for up to $1,762,216 based on a capital investment total of $70 million and creation of 175 jobs. The grant would be payable over 5 years and is performance based. Payment is tied to the amount of new incremental assessed value generated from the private investment by the company. The City of Statesville approved the incentive. On behalf of Iredell County Economic Development Corporation, Bosser expressed appreciation to the Board for their consideration of the grant. 14 May 4, 2021 Chairman Mallory opened the public hearing.
