HomeMy WebLinkAbout2-16-2021 1 February 2, 2021 IREDELL COUNTY BOARD OF COMMISSIONERS PRE-AGENDA SESSION February 16, 2021 The Iredell County Board of Commissioners met in pre-agenda session on Tuesday, February 16, 2021 at 5:00 PM, in the Commissioners’ Meeting Room located in the Iredell County Government Center 200 South Center Street, Statesville, NC. Board Members Present Chairman James Mallory Vice Chairman Melissa Neader Scottie Brown Gene Houpe Board Members Participating Remotely Marvin Norman Staff present: County Manager Beth Jones, County Attorney Lisa Valdez, Deputy County Manager Susan Robertson, Assistant County Manager Joe Pierce, Finance Director Deb Cheek, and Clerk to the Board Amy Anderson. CALL TO ORDER: Chairman James Mallory called the meeting to order. ADJUSTMENTS TO THE AGENDA: County Manager Beth Jones went over the following adjustments to the agenda:  Add Economic Development (GS 143-318.11 (a) (4) Closed Session  Add Proclamation for Black History Month  Clarification: Planning Director Matthew Todd will be presenting the update on the Iredell County Transportation Master Plan. ADMINISTRATIVE MATTERS Request from the National Balloon Rally Charities Inc. for approval of a 35’ wide easement at the Fairground and adjacent park property: County Manager Beth Jones said the National Balloon Rally Charities, Inc. is interested in purchasing property directly behind the Fairground and in order for them to secure financing an easement to access Murdock Road is required. Once the property is closed on, the intent is to have a master plan conducted on all of the property to determine best ingress and regress. Jones said if National Balloon Rally Charities, Inc. is able to secure separate ingress and regress to Murdock Road the easement would go away. Commissioner Brown asked if National Balloon Rally Charities Inc. plans to use county property to hold events. Jones said the County plans on working together and being a good neighbor, however specific details will be ironed out. County Attorney Lisa Valdez said that National Balloon Charities, Inc. may need additional easements (utility, storm drainage, etc.) in the area. These type easements are more costly to relocate. The purpose of the easement currently being requested to provide access. 2 February 2, 2021 Chairman Mallory said the concept is to be able to leverage the property and resources of the groups in the area. The easement is to give them legal access but the exact placement will be determined based on the master plan. Commissioner Houpe said there were some misunderstanding and suggested Jones explain the purpose of the easement during the 7pm meeting. This item was placed on consent. Consider a request from applicants Lee & Amanda Levandowski, representing Charlotte Ski Boats, to rezone approximately 2 acres along Beech Tree Road: County Manager Beth Jones explained the Board held a public hearing for the rezoning on February 2, 2021. No one wished to speak during that time and no comments were received after the pub lic hearing. This item will be considered at 7pm. Consider a request from owner/applicants Clifton & Barbara Benge and Gary & Christine Edwards, to rezone approximately 1.3 acres along West Memorial Highway: County Manager Beth Jones explained the Board held a public hearing for the rezoning on February 2, 2021. No one wished to speak during that time and no comments were received after the public hearing. This item will be considered at 7pm. Request from Planning & Development for approval to abandon state maintenance for a portion of SR 2630 (Ebony Circle): Planning Director Matthew Todd said the request was made by ICATS and adjacent property owners to abandon state maintenance on Ebony Circle (off Mount Olive Road). The right of way on county property will still exist, but the maintenance will no longer be administered by NCDOT. Chairman Mallory asked who will be responsible for maintaining the road. Todd said the private property owners along that section of Ebony Circle. Chairman Mallory asked for a background of the request. Jones said Ebony Road dead ends at the ICATS facility. There have been two instances of where catalytic convertors were stolen off the buses and staff would like to place a fence on the property boundary to better secure the property. Jones said the County would be accepting responsibility for maintaining the road. Chairman Mallory said it looks like three properties would be effected. Todd said a few residents have signed off on the application acknowledging the request. 3 February 2, 2021 Chairman Mallory asked if the County has made a commitment of maintaining the portion between Mount Olive Road and the fence. Deputy County Manager Susan Robertson explained Solid Waste has offered to maintain the road. Mount Olive also serves as the rear entrance of the landfill. Valdez asked if the County entered into an agreement with the property owners regarding the maintenance. Jones said the fence would be located where the County’s property begins, but in order to put up a fence, the County is required to ask the State to relinquish maintenance on Ebony Circle. Todd said there is no dedicated right of way for Ebony Circle across the private properties between Mount Olive and ICATS. It is a drive the State maintains. There is a recorded right of way on the County’s property. Chairman Mallory asked for further review of the request. The intent can be accomplished if all parties agree to a right of way for the County and property owners that are contiguous to the current road. This needs to be a condition precedent to letting go of the State right of way. This item was tabled for further review and will be brought back at future meeting. Request from the Library for approval to apply for the State Library of North Carolina for Library Services and Technology Act grant in the amount of $50,000: Library director Juli Moore requested approval to apply to the State Library of North Carolina for a LSTA EZ grant in the amount of $50,000 to digitize microfilm and family files in the local history room at the Statesville Library. The digitization will allow the public to have easier access to the information by using Optical Character Recognition (OCR) software to scan the collection, thereby making it easily searchable by keyword. The project will include the purchase of a data repository for the information, user licenses to access the information through the Library's website, and the cost of having the items professionally scanned. The grant does require a 25% match that will be included next year’s fiscal year budget request if approval to apply is granted. This item was placed on consent. Request from the Library for approval of a 3-year contract with Spectrum to provide internet access at the Statesville and Troutman libraries: Library Director Juli Moore requested approval of a 3-year contract with Spectrum to provide internet access at the Statesville and Troutman Libraries. The current 3-year contract with Spectrum is up for renewal. The new contract will begin July 1, 2021 and end on June 30, 2024. Both locations are electing to maintain the same level of service. The new contract will reflect a decrease in the monthly cost of internet service at each location - Statesville will decrease by $290 per month and Troutman will decrease by $250 per month. The cost of the phone service in Troutman will remain the same at $19.99 per line/per month. Contracts Manager Dean Lail has reviewed the contract and the terms of service, made necessary redline changes, and approved Spectrum's revisions. This item was placed on consent. 4 February 2, 2021 Request from the Library for approval to apply for E-Rate discounts: Library Director Juli Moore requested approval to apply for discounter Internet access under the Federal Communications Commission's E-Rate program for FY22. The total cost for Internet access for the Statesville, Harmony and Troutman libraries for FY22 will be $15,660. E-Rate funds 60% of the cost of services, so E-Rate discounts will cover $9,396. Internet for the Statesville Library and Troutman Library will be under a new 3-year contracts with Spectrum. Internet service for the Harmony Library will be on a month-to-month service with Yadtel. This item was placed on consent. Request from the Finance Department for approval of an audit contract with Martin Starnes & Associates, CPAs, P.A. for fiscal year ending June 30, 2021: Finance Director Deb Cheek explained that the County is required to have an audit performed each year by an external auditing firm. The County has used Martin Starnes and Associates, CPAs, P.A., for sixteen years and I am pleased to continue that working relationship. This audit includes the financial statements of the governmental activities, the business-type activities, each major fund, and the aggregate remaining fund information of Iredell County, NC, as of June 30, 2021 and the related notes to the financial statements. In addition, they will audit the entity's compliance over major federal and State award programs for the period ending June 30, 2021. The cost of the audit has a modest increase of 3% in agreement with the three-year contract negotiated in FY2019. The compliance programs are billed separately once the number of files to be audited is determined. The fee remains at $3,000 per program this year for programs in excess of five. The first five are included in the base price. This item was placed on consent. Request from Administration for approval of Departmental Strategic Goals: Budget Analyst Carolina Taylor explained that each department has created Strategic Goals as part of the continued growth of our Strategic Planning process. An Iredell County Task Force reviewed each of these goals and have a favorable recommendation. Each of these Strategic Goals has a direct tie to at least one Board of Commissioner approved Strategic Objective. Jones added approval of the goals helps guide staff into the budget process. Commissioner Brown shared his appreciation of the task forces he serves on. This item was placed on consent. Request from Tax Administration for approval of January 2021 Refunds and Releases: This item was placed on consent. ANNOUNCEMENTS OF VACANCIES OCCURING ON BOARDS & COMMISSIONS Child Fatality Prevention Team – 1 announcement 5 February 2, 2021 APPOINTMENTS TO BOARDS & COMMISSIONS Child Fatality Prevention Team – 1 appointment Amy Eisele has volunteered to serve on the team. Troutman Board of Adjustment (ETJ) – 1 appointment Lee Geiger has volunteered to serve for the first time. Troutman Town Council voted to recommend in favor of the appointment. OLD BUSINESS (None) NEW BUSINESS (None) COUNTY MANAGER’S REPORT County Manager Beth Jones provided an update on the following:  Distributed a printed COVID Update as prepared by Health Director Jane Hinson. As of February 15, 2021 there were 15,659 positive cases, 30 hospitalizations, and 188 deaths. CLOSED SESSION The Board entered into Closed Session at 6:05pm. VOTING: Ayes – 5; Nays – 0 PRESENTATION OF SPECIAL RECOGNITIONS & AWARDS APPOINTMENTS BEFORE THE BOARD Planning Director Matthew Todd will present an update on the Iredell County Transportation Master Plan: Planning Director Matthew Todd said the County was awarded a grant to create a Strategic Transportation Plan. RS&H was hired as consultant and setup a Project Technical Team made up of representatives from jurisdictions in the County along with ICATS, CRTPO, LNTC, and NCDOT. The project started in October 2020 and should be done by late summer 2021. The study is of the whole county, but will focus on unincorporated areas. Todd said the plan will connect the dots between jurisdictions and identify projects that need to move forward. Stakeholders, including the Economic Development Corporation, Iredell-Statesville Schools, Parks & Recreation Department, ICATS, Centralina Regional Council on Government, NCDOT have been interviewed. Todd said that in the next month there will online surveys posted on the County’s website for public input. After the surveys are conducted, the consultant will begin working on design ideas. PUBLIC HEARINGS Chairman Mallory explained the Board is unable vote on public hearing because of the current Executive Order in place. The Board will conduct the public hearing and vote on the matter during the March 2, 2021 meeting. Public hearing on an installment financing agreement for energy conservation projects with Iredell Statesville School System and executing a deed of trust on the CATS property: 7 February 2, 2021 Chairman Mallory explained the Board is unable vote on public hearing because of the current Executive Order in place. The Board will conduct the public hearing and vote on the matter during the March 2, 2021 meeting. MOTION by Commissioner Houpe to approve the zoning map amendment, and to make a finding that said approval is reasonable and in the public interest because the property lies within the 2030 Horizon Plan Corridor Commercial area, it is surrounded by various existing commercial uses, the conditions of the request are consistent with surroundings, and the property will no longer be split-zoned. VOTING: Ayes – 5; Nays – 0 Iredell County PLANNING & DEVELOPMENT PLANNING STAFF REPORT REZONING CASE # 2101-1 STAFF PROJECT CONTACT: Leslie M. Meadows EXPLANATION OF THE REQUEST This is a request to rezone a split-zoned parcel of land, at the corner of Beech Tree Road and Blume Road (off Brawley School Road), approximately 2 acres, from Residential Agricultural/Neighborhood Business (RA/NB) to Highway Business Conditional District (HBCD). This request is conditional per the submitted application, and will be limited by allowing for only specific HB uses as attached to the request. OWNER/APPLICANT OWNER: JT Brown Heirs APPLICANT: Lee & Amanda Levandowski, Charlotte Ski Boats PROPERTY INFORMATION 8 February 2, 2021 ADDRESS/LOCATION: 105 Beech Tree Road, Corner of Beech Tree Road and Blume Road, off Brawley School Road. More specifically, PIN 4636277620.000. SURROUNDING LAND USE: There are a variety of NB, HB, and GB uses to the south, east, and southwest. However, properties directly to the north are residential in nature. SIZE: The total acreage to be rezoned includes approximately 2 acres. EXISTING LAND USE: Vacant, besides an abandoned SFD, built in 1969, that will be removed. Otherwise, heavily wooded. ZONING HISTORY: The property has been split-zoned, Residential Agricultural (RA) to the rear, and the front portion Neighborhood Business (NB), since county-wide zoning was established in 1990. OTHER JURISDICTIONAL INFORMATION: The property is just outside of the Town of Mooresville’s Long-Range Urban Service Area, to the southwest. The Town of Mooresville was made aware, and seems to agree the request appears to be consistent with most of the existing surrounding development. OTHER SITE CHARACTERISTICS: This property is located within the regulated WS-IV-CA Critical Watershed Area for Catawba/Lake Norman. Proposed new development will be limited to the Non-Residential Low Density Option for 24% built-upon area. The Non- Residential High Density Option is not an option along Brawley School Road in the County’s jurisdiction. The property is not located in a flood hazard zone. UTILITIES: This site is currently served by well and septic, but could have access to pu blic utilities through the Town of Mooresville. IMPACTS ON LOCAL INFRASTRUCTURE AND/OR FACILITES TRAFFIC: Beech Tree Road is not considered a major or minor thoroughfare according to the current CRTPO Comprehensive Transportation Plan. Thus, traffic capacities are unknown. The closest and most recent traffic count, east of the property along Brawley School Road, had a traffic count of 26,000 vehicles per day in 2016. The speed limit along this section of Beech Tree Road is 30 mph. SCHOOLS: This is a commercial rezoning and should have no implications on local schools. EMERGENCY SERVICES: This proposal has been reviewed by the Iredell County Fire Marshal’s Office and Iredell County EMS. Neither office addressed any concerns regarding the request. 9 February 2, 2021 REQUIRED REVIEWS BY OTHER AGENCIES LOCAL: The applicant must provide a site plan to the Planning & Development Department for review to develop the property. Zoning requirements such as parking, landscaping, and buffering will be reviewed at such time. Erosion & sedimentation control standards will also be reviewed for compliance. STATE: Other than building code, there should be no formal state agency review at this time. FEDERAL: None at this time. STAFF AND BOARD COMMENTS STAFF COMMENTS: The applicant represents Charlotte Ski Boats, a premier boat dealership that offers a variety of marine products. Future plans include use of a portion of the property in question for additional outdoor storage of boats. Note that this is a conditional rezoning and specific conditions imposed as part of the application are as follows: 1.) Only the following specific HB uses shall be permitted: Boat Dealer – Sales, Services, and Repairs, Motorcycle/ATV – Sales and Services, General Office Space. It is noted that these conditions, limiting the site to very specific and limited HB uses, are the same conditions agreed upon for Charlotte Ski Boats’ existing boat lot located just to the southwest of this property, HBCD Case#: 1608-1. Thus, the adjoining properties will have consistent conditions zoning-wise, and this split-zoned property will be brought under one zoning district. Being relatively adjacent to Brawley School Road, the parcel in question is inside what the 2030 Horizon Plan calls the Corridor Commercial area. Corridor Commercial areas include existing commercial, office, and/or retail uses that exist along major thoroughfares and highways or areas that will include commercial development in the future, and can contain both large and small mixed-use commercial centers. These areas are both within and outside the Iredell County Urban Service Areas. They may be serviced by and incorporated into one of the municipalities at some point in the future. According to the plan, commercial uses within this area generally should include retail, restaurants, entertainment centers, automobile services, personal services, other commercial uses, and office developments. The Planning staff can support the proposed rezoning request based on the following: The property lies within the 2030 Horizon Plan Corridor Commercial area, it is surroun ded by various existing commercial uses, the conditions of the request are consistent with surroundings, and the property will no longer be split-zoned. PUBLIC INPUT MEETING: A public input meeting was held on Thursday, November 12th, 2020 from 5:30pm - 6:30 pm at Charlotte Ski Boats on Brawley School Road. No 10 February 2, 2021 surrounding property owners from the area chose to attend. Staff members were present to hear their proposal and ask questions about future development. A copy of the applicant’s summary of said public input meeting has been included at the end of this report. SITE REVIEW COMMITTEE: Staff visited site on December 18, 2020. PLANNING BOARD ACTION: On January 6, 2021, the Planning Board held a public meeting to hear the rezoning request. The applicant presented a vision board rendering of the proposed boat storage lot. No neighboring landowners present commented in opposition. The board voted 8-0 to recommend approval of the rezoning. * * * Consider a request from owner/applicants Clifton & Barbara Benge and Gary & Christine Edwards, to rezone approximately 1.3 acres along West Memorial Highway: County Manager Beth Jones explained the Board held a public hearing for the rezoning on February 2, 2021. VOTING: Ayes – 5; Nays – 0 Iredell County PLANNING & DEVELOPMENT PLANNING STAFF REPORT REZONING CASE # 2101-2 STAFF PROJECT CONTACT: Leslie M. Meadows EXPLANATION OF THE REQUEST This is a request to rezone an approximately 1.3 acre property in Union Grove, along West Memorial Highway, from Residential Agricultural (RA) to General Business (GB). This is a straight rezoning and no conditions are proposed at this time. OWNER/APPLICANT OWNER/APPLICANT(S): Clifton & Barbara Benge and Gary & Christine Edwards PROPERTY INFORMATION ADDRESS/LOCATION: 11 February 2, 2021 1511 West Memorial Highway; more specifically, PIN 4852572506. SURROUNDING LAND USE: There are GB commercial uses directly surrounding the site. To the north are residential agricultural lands. SIZE: The total acreage to be rezoned is approximately 1.3 acres. EXISTING LAND USE: The parcel recently became vacant. The property formerly contained a manufactured home, which has been removed. ZONING HISTORY: This property has been zoned Residential Agricultural (RA) since county- wide zoning was established in 1990. OTHER JURISDICTIONAL INFORMATION: This rural property is located entirely within the County’s jurisdiction, and is not in close proximity to any municipal Urban Service Area. OTHER SITE CHARACTERISTICS: The rear portion of this property is not located within a regulated Watershed Area. However, the front half falls within the Hunting Creek WS -III- Balance of Watershed Area, which allows for 70% built upon area, with only 12% after 10% built upon (10/70 Rule). The property is not located in a flood hazard zone. UTILITIES: Iredell Water Corporation, as well as, well and septic options would currently serve this site. IMPACTS ON LOCAL INFRASTRUCTURE AND/OR FACILITES TRAFFIC: The closest traffic count along West Memorial Highway is to the east near the on/off ramp for I-77, which had a traffic count of 5,700 vehicles per day in 2018. According to the Comprehensive Transportation Plan 2008 Study Report for Iredell County, the capacity for this section of West Memorial Highway is approximately 13,800 vehicles per day through the year 2030. The speed limit along this portion of West Memorial Highway is 50 mph. SCHOOLS: This is a commercial rezoning and should have no implications on local schools. EMERGENCY SERVICES: This proposal has been reviewed by the Iredell County Fire Marshal’s Office and Iredell County EMS. Neither office addressed any concerns regarding the request. REQUIRED REVIEWS BY OTHER AGENCIES 12 February 2, 2021 LOCAL: The applicant must provide a site plan to the Planning & Development Department for review to develop the property. STAFF AND BOARD COMMENTS STAFF COMMENTS: The applicant is requesting a straight commercial rezoning of the vacant parcel to allow for all General Business uses. Various other GB properties already surround this property. Most recently, in December 2020, a portion of the adjoining property to the west was rezoned to straight GB. Thus, rezoning the property in question would primarily bring uniformity to an existing block of GB district. Also, the relatively small size of the property would aid in limiting some of the more intensive GB uses. Being just off I-77, the site is highly visible, and along such a major thoroughfare/highway. This property is within what the 2030 Horizon Plan calls a Highway Interchange Commercial area. Highway Interchange Commercial areas include existing or future commercial, retail, and service uses located proximate to interstate interchanges on major arterial roadways. Traditional strip commercial development is discouraged within these areas. Instead, developments should be designed to provide greater connectivity within and to adjacent developments; pedestrian access should be a priority, and landscaping, signage, and building design and orientation should be consistent within individual developments. Uses within these areas generally should include gas stations, hotel/motels, restaurants, and other highway travel related businesses. Secondary uses may include retail, office developments, and higher-density residential uses. The Planning staff can support the proposed rezoning request based on the following: The property is within the Highway Interchange Commercial corridor according to the 2030 Horizon Plan, it is surrounded by various existing GB commercial properties, and traffic impacts should not exceed road capacity. UNFINISHED BUSINESS (None) PUBLIC COMMENT PERIOD Christine Harvey, 3970 Taylorsville Highway, spoke in support of the Confederate Monument. She said the monument is a part of history and if it is taken down, history is bound to repeat itself. Harvey spoke against signs with curse words being used on the streets downtown. She also suggested that the NAACP used donations to support African American Veterans or a Civil Rights leader in NC instead of threatening legal action. Tommy Hamel, 934 Kentwood Drive, asked if the NAACP filed a lawsuit regarding the statue. He said it is a conflict of interest to recognize the recognize the NAACP while they are threatening a lawsuit. Hamel said, “You can’t butter both sides of the bread.
