HomeMy WebLinkAboutC.054.93011_1748 (2)IREDELL COUNTY BOARD OF COMMISSIONERS BRIEFING MINUTES DECEMBER 4, 2007 The Iredell County Board of Commissioners met in Briefing Session on Tuesday, December 4, 2007, at 5:00 P.M., in the Iredell County Government Center (South Wing Conference Room), 200 South Center Street, Statesville, NC. Board Members Present Chairman Marvin Norman Vice Chairman Sara Haire Tice Steve Johnson Ken Robertson Godfrey Williams Staff present: County Manager Joel Mashburn, Deputy County Manager Susan Blumenstein, Assistant County Manager Tracy Jackson, Planning & Development Director Ron Smith, Fire Marshal Lloyd Ramsey, Solid Waste Director David Lambert, Recycling Coordinator Diane Lewis, Purchasing Agent Dean Lail, and Clerk to the Board Jean Moore. CALL TO ORDER by Chairman Norman. REQUEST FOR THE ADOPTION OF A RESOLUTION CALLING FOR A PUBLIC HEARING CONCERNING THE FINANCING OF CERTAIN SCHOOL FACILITIES PURSUANT TO AN INSTALLMENT FINANCING AGREEMENT: Deputy County Manager Susan Blumenstein and Kent Lawrence, a representative of Citigroup, requested a public hearing on December 18 regarding the "not to exceed" $115,000,000 school bond. Blumenstein said financial leeway was needed in the paperwork, and it was not anticipated the full amount would be issued. Lawrence said the bonds would be sold on February 20. He said there was much volatility in the bond market right now, but the rates were low. REQUEST FROM THE IREDELL PROPERTY GROUP FOR THE REFUND OF A CONVEYANCE TAX IN THE AMOUNT OF $542: Deputy County Manager Susan Blumenstein said that after the November 6 meeting, when this matter was first discussed, the North Carolina Department of Revenue was contacted to determine whether or not the county could recover the tax overpayment. She said the Revenue/Conveyance Tax Division Head informed her the board of commissioners had to request refunds within six months after the tax was paid, and an explanation from the taxpayer had to be included. Blumenstein said this particular request would then be ineligible; however, the taxpayer could request a review by the Secretary of the Department of Revenue after the board's denial. She said the county had no statutory authority to make the refund. History of the Request: The Iredell Property Group, LLC paid a $1400 excise tax on a recorded deed dated November 28, 2006 In order to have qualified for a refund, the corporation needed to file a request by May 28, 2007. The corporation requested the refund, through a letter to the board, on October 24, 2007. REQUEST FOR A DECISION REGARDING AN ATTEMPT TO ENTER INTO A LEASE WITH THE NORTH CAROLINA DEPARTMENT OF TRANSPORTATION FOR THE USAGE OF FORMER PRISON PROPERTY: County Manager Joel Mashburn said a letter was sent to state officials about the county either purchasing or leasing the Vocational Training Facility located off Tumersburg Road. He said the state responded and indicated there were no plans to sell the site, and even if there were, first refusal rights would be offered to the Department of Transportation. Mashburn continued by saying that if the DOT had no interest, the site would be listed as surplus and sold by the State Property Office. With this information, the board was in consensus to remove the item from the agenda. All other agenda items were reviewed, and a summary about these may be found in the regular minutes.
