The employee may decline the light duty and instead choose to exercise his/her FMLA righter However, workers' compensation benefits may be suspended under the State Workers' Compensation staintes. Absence due to an on-the-job injury wiU be counted against the employee's FMLA leave entitlement. Upon reinstatement, an employee's salary will be computed on the basis of the last salary earned plus any increment or other salary increase to which the employee would have been entitled during the disability covered by Worker's Compensation. Temporary employees will be placed in a leave without pay status and will receive all benefits for which they may be adjudged eligible under the Worker's Compensation Act. Section 15. Return -to -Work Program The purpose of this program is to return injured employees to ai_ob suitable to their work restrictions as soon as medically feasible. Early return -to -work and light duty programs promote a quicker recovery, improve morale, allow miured employees to earn their normal wages, and help departments maintain their productivity. A. Any employee with a work-related injury resulting in limitations of light duty will be eligible for this program. B. The attending physician will provide dear, written restrictions and approve light duty work assigned to the employee based on those restrictions. C. To the extent possible, employees participating in this program will he returned to their normal depardnent When limitations prevent light duty work in the normal deportment or work within the limitations a not available, the workers compensation adndnistrator will locate an assignment in a different department that is compatible with restrictions. D. Employees in this program will be assigned a temporary supervisor if moved to a d fierent work unit or department The employee will be subject to the same work rules and regulations as any other employee, and will be required to perform work within the limitations established by the treating physician. E Employees participating in this program will receive their normal wage for each hour worked, and the cost will be charged to the employee's normal work department F. The light duty assignment wig be temporary and may be discontinued when: L the treating physician returns the employee tofaff duty, 2 the physician prohibits the employee from participating in a light duty assigmmeu4 3. the physician indicates the employee has reached m®rirmum medical improvement and will not be able to return to regular position, 4. there a no longer an appropriate task within the County that would accommodate the employee's capabilities, or an employee has been on light duty for a period of six month AN light duty cases will receive a thorough re-evaluation at this point to determine if such duty is to be continued.
