HomeMy WebLinkAboutC.054.93011_0849 (2)If any subdivision, development and/or land use is found to be in violation of this Ordinance, the Iredell County Board of Commissioners mav, in addition to all other remedies available either in law or in equitv, instate a civil penalty by giving seven (7) days to bring the violation into compliance and notifying that the penalty for the violation is $100 for the first citation. If the owner comes into compliance within the seven (7) days, a $100 penalty will be collected. If the owner or occupant fails to conte into compliance, a second Citation will be issued extending the deadline by another seven (7) days and assessing a penalty of $100 per day for each day the violation continues thereafter. Further failure to come into compliance will result in the case being submitted to the County Attorney for enforcement and potential legal action. In addition, the N.C. Environmental Management Commission may assess civil penalties in accordance with G.S. 143-215.6(a). Each day that the violation continues shall constitute a separate offense. B. If the PlanningPireeter Watershed Administrator finds that any of the provisions of this ordinance are being violated, he shall notify in writing the person responsible for such violation, indicating the nature of the violation, and ordering the action necessary to correct it. He shall order discontinuance of the illegal use of land, buildings or structures; removal of illegal buildings or structures, or of additions, alterations or structural changes thereto; discontinuance of any illegal work being done; or shall take any action authorized by this Ordinance to ensure compliance with or to prevent violation of its provisions. If a ruling of the Xanning-Bi waf Watershed Administrator is questioned, the aggrieved party or parties may appeal such ruling to the Board of Adjustment in accordance with Section 502-3 of this Ordinance. Section 106. Severability. Should any section or provision of this Ordinance be declared invalid or unconstitutional by any court of competent jurisdiction, the declaration shall not affect the validity of this Ordinance as a whole or any part thereof that is not specifically declared to be invalid or unconstitutional. Section 107. Effective Date.
