No one else desired to speak, and Vice Chairman Williams adjourned the public hearing. OTIO by Commissioner Norman to approve the rezoning request of Case No. 0505-2 (Fred E. Frye Heirs Property) from Residential Agricultural to Residential Office Zoning District. VOTING: Ayes — 4; Nays — 0. Vice Chairman Williams declared the meeting to be in a public hearing. Proposed Amendment 4o the Iredell County Subdivision Ordinance - Section 405.7.1, Curb & Gutter — Stormwater: Subdivision Administrator William Allison said the commissioners, at the Winter Planning Session, had discussed stormwater problems and related issues. He said since that time, the staff had studied the issue and determined that a large portion of the problem was from curb & gutter development and the water that funneled through them Mr. Allison said the staff had tried to focus on what could be done to limit the water problems and the impact on adjoining properties. He said that on May 4, 2005, the planning board voted (5-4) in favor of an amendment to the subdivision ordinance to address the problem. Allison said subdivisions having 25 or more lots having a topographical need would have to comply with the ordinance. (Originally, the amendment had 50 lots.) The proposed amendment is as follows: Amend. Section 405.71 (Curb & Gutter) Curb & Gutter When a proposed subdivision exceeds 38 25 lots, where there is a topographic need (such as steep slopes) and a public benefit will be realized, or where an adjoining subdivision already has curb and gutter in place, the Committee may recommend to the Subdivision Administrator where curb and gutter (designed in accordance with NCDOT specifications) shall be required. . Curb and gutter development shall only be permitted when 50% or more of the stormwater run-off is discharged into an on-site perennial or annual stream as determined by the most recent version of the U. S. G. S. topographic maps. No run-off may directly discharge into Lake Norman, Lookout Shoals Lake, or the Catawba River. In addition, the developer or his agent shall submit a surface water drainage plan, as drawn by a design professional, containing topography and depicting the natural drainage of the property prior to development. No one else desired to speak and Vice Chairman Williams adjourned the hearing. Mr. Williams announced that the board had chosen to delay action on the curb and gutter/stormwater amendment until the June 21 meeting. Request from the City of Statesville for the County to Pay $23,799 in Conjunction with an Engineering Recommendation for the Statesville Regional Airport's Sewer Line to be Increased from 12 to 15 inches in Diameter: Statesville City Manager Rob Hires said a 12 inch gravity line had been designed to carry sewer from a lift station on Third Creek approximately 3,500 feet to a point where an 8 -inch line was installed.
