Vice Chairman Williams declared the meeting to be in a public hearing. Rezoning Request; Fred E. Frye Heirs Property, Case No. 0505-2 from Residential Agricultural to Residential Office Zoning District: Planning Supervisor Steve Warren explained the following staff report presented on behalf of applicants Ryan and Kristina Newman. OWNERS: Fred E. Frye Heirs 111 Kansas Lane Statesville, NC 28677 AGENT: Grant M. Miller 1401 West Morehead Street, Suite 125 Charlotte, NC 28208 APPLICANTS: Ryan & Kristina Newman 8300 Chapin Lane Sherrills Ford, NC 28673 LOCATION: 1228 Tumersburg Highway, more specifically identified as PIN# 475741-7954. Directions: 1-77 north to exit 54, turn right onto Highway 21 north/Tumersburg Highway, property on the right. REQUESTED ACTION AND CONDITIONS: Rezone a portion of the property from RA, Residential Agricultural Zoning District to RO, Residential Office Zoning District. PROPOSED USE: 5,000 to 8,000 square foot office building for Ryan Newman Foundation Inc., Ryan Newman Motorsports Inc., and Ryan Newman Transportation LLC, SIZE: The total parcel is 126.9 acres. The portion requested to be rezoned is 21.41 acres. EXISTING LAND USE: Residential SURROUNDING LAND USE: Residential and vacant WATERSHED REGULATIONS: The property is not located in a watershed TRAFFIC: The capacity for this stretch of Tumersburg Highway is 7,000 vehicles per day. In 2003, the estimated daily traffic count was 10,500 vehicles per day. Rezoning this property for the use as requested would not likely increase the traffic along this stretch of Tumersburg Highway. ZONING HISTORY: This property has been zoned RA since County -wide zoning went into effect in 1990. STAFF COMMENTS: There are other commercial uses close by, including the regional Department of Transportation facility. A church is located across the highway and another is in the process of construction on an adjacent property. Rezoning this property to RO would create a transitional barrier between the commercial uses and the church uses. The use requested will not generate a lot of additional traffic in the area. The County Land Use Plan recommends for residential uses, so the RO zoning still fits within the plan of development. Therefore, staff recommends in favor of this request.
