VOTING: Ayes - 5; Nays - 0. No e: The June 2000 request was to rezone from RA TO HB (CUD). The February 2001 request to the planning board was to rezone from HB(CUD) to HB. (During the meeting, the auto auction withdrew the request, and stated it wished to appear before the planning board at the next meeting with a request to rezone from HB (CUD) to GB (CUD). The March 2001 request to the Iredell County Planning Board was to rezone from HB(CUD) to GB(CUD). Chairman Tice declared the meeting to be in a public hearing. REZONING REQUEST: INGLE'S MARKETS, INC., APPLICANT FOR THE NORMAN R- & JUDY M. ALDRIDGE PROPERTY, CASE NO. 0102-3, FROM RESIDENTIAL AGRICULTURAL TO HIGHWAY BUSINESS CONDITIONAL USE DISTRICT: Smith said the property involved in the request was located along River Highway at Ervin Road in Mooresville, NC and could be identified by PIN#s 4647-17-9859, 4647-17-9880, 4647-18-9020, 4647-27-0256, 4647-27-0357, 4647-27-0448, 4647-27-0539, 4647-27-0609 4647- 27-2272, 4647-27-2382, 4647-27-2494, 4647-27-2696, 4647-27-2766, 4647-27-2826, 4647-27- 3515, 4647-28-1061, and 4647-28-3238. Mr. Smith said the proposed usage of the property would be any/all uses in the Neighborhood Business District and with the additional uses being: photo finishing, ABC sales for on -premises consumption, and a garden center. He said the proposed initial use was for a grocery store/shopping center/convenience gas station. In addition, he said the Property encompassed 30 acres with existing land being residential. Smith said the rezoning request was in agreement with the Highway 150 Corridor Land Use Plan and the staff recommended approval. Mr. Smith said the planning board on February 7, 2001 recommended approval in a 9-0 vote. The conditions placed on the property were: 7 1) Limiting the Highway Business uses by allowing all uses of Neighborhood Business plus selected Highway Business uses, i.e., photo finishing, store/gas station. ABC sales for on -premises consumption, and a garden center. The proposed initial use is grocery store/shopping center/convenience 2) Implement the Roadway Protection Overlay along NC Hwy. 150 in accordance with recommendations of the Corridor Plan adopted in December of 2000. 3) Build to the new NC Hwy. 150 right -of --way specifications of 120 feet. 4) Provide driveway access cuts to Ervin Road for customer and delivery vehicles. 5) Provide internal vehicle interconnectivity between principle development and all out -parcels. CliffHomesley, the attorney for Ingles Markets, said the area was shown as commercial in the River Highway Land Use Plan. He said his client would honor the overlay plan (right-of-way) and when the time came to widen the road, there would not be any buildings/encroachments in the rezoned area. 7
