said the attorney had rendered an opinion indicating that the rezoning would not constitute an
illegal spot zoning. He said the proposed M-2 district would not be contiguous to another nornt-
residential district; however, according to the attorney, the facts indicating (1) the business was in
operation prior to county -wide zoning, and (2) that it had expanded at least twice with no problems
on the surrounding neighborhood, outweighed the "island" issue; thus reducing the potential of a
spot zoning claim.
Edward Bissell said he and his wife were the owners/applicants, and he was present to
answer any questions.
No one else spoke, and Chairman Tice adjourned the hearing.
MOTION by Commissioner Williams toamend the Iredell County Land Development Plan
in reference to Case No. 0012-2.

MOTION by Commissioner Bowles, after reviewing the four findings of fact, to grant the
rezoning request ofCase No.0012-2 from RA & GB, Residential Agricultural & General Business
to M-2 (CUD), Heavy Manufacturing Conditional Use District.

Chairman Tice declared the meeting to be in a public hearing. All speakers desiring to speak
in reference to the next case were sworn in.
REZONING REQUEST; ELEANOR ORRELL PROPERTY, CASE N0. 0012-3.
FROM R-20, SINGLE FAMILY RESIDENTIAL TO RA, CUD RESIDENTIAL.
AGRICULTURAL CONDITIONAL. USE DISTRICT (The property is located at 493 Airport
Road, Statesville, NC.): Smith said the owner (Eleanor Orrell) and applicant (Realco Development
Corporation) desired to build a manufactured home subdivision on the property with the following
conditions:
(1) Limit residential construction types to new double -wide or modular units only.
(2) Each unit shall include: vinyl lap siding, asphalt -shingle roofing, masonry
foundation, masonry front porch, and concrete driveway.
Smith said the 54 acres of property could be identified by PIN #4723-68-8883. He said the
existing land use was residential and agricultural and the surrounding land use was residential.

Jimmie McKnight, part owner of Realco Development, said he had unsuccessfully
attempted to obtain water and sewer for the area. McKnight said he had tried with the City of
Statesville and West Iredell Water Corporation. Mr. McKnight said the RA -CUD zoning best suited
the area since there was a single and double wide mobile home subdivision adjacent tothe property.
Eleanor Orrell, the owner of the property, said she was 80 years old and had lived in a
house on the site for the past 50 years. Mrs. Orrell said she needed to sell the property to eliminate
paying the taxes and the utility bills. Orrell said she intended to retire if the request were granted.
